THAT Report WD-37-00 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services, which include final stage roads and other related Works, constructed within Plans 10M-840 (part of), 40M-1670, 40M-I714 and 40M-I723, and; 3. THAT Council approve the by-law attached to Report WD-37-00, assuming the streets within Plans 10M-840 (part of), 40M-1670, 40M-1714 and 40M-I723 as Public Highways. REPORT 1.0 ATTACHMENTS No.1: KeyMap No.2: Road Dedication By-law for Plan 10M-840 (part of) No.3: Road Dedication By-law for Plan 40M-1670 No.4: Road Dedication By-law for Plan 40M-1714 No.5: Road Dedication By-law for Plan 40M-I723 1101 REPORT NO.: WD-37-00 PAGE 2 2.0 BACKGROUND 2.1 The former Corporation of the Town of Newcastle, now The Corporation of the Municipality of Clarington, entered into a Subdivision Agreement, registered April 18, 1991, with Eiram Development Corporation to develop lands by plan of subdivision, located in Bowmanville and described as Plans lOM-840, 40M-1670, 40M-I714 and 40M-I723 (Attaclunent No.1). The agreement required the developer to construct all roadworks, including hot-mix paving, sidewalks, curb and gutter, street trees, a storm drainage system and streetlights, hereinafter referred to as the ' Works' . 2.2 The Subdivision Agreement provides for the separation of the Works into three (3) stages: (a) Storm Sewer Works including Storm Sewer Work: on Mearns Avenue; (b) Tributary Stormwater Management Works Exclusive of Soper Creek Erosion Works and; ( c) Roads and Above Ground Services 2.3 The Storm Sewer Works including Storm Sewer Work: on Mearns Avenue were issued a 'Certificate of Completion' and subsequent 'Certificate of Acceptance' by the Director of Public Works, as per the maintenance requirements set out in the Subdivision Agreement. 2.4 The Tributary Stormwater Management Works Exclusive of Soper Creek Erosion Works were issued a 'Certificate of Completion' and subsequent 'Certificate of Acceptance' by the Director of Public Works, as per the maintenance requirements set out in the Subdivision Agreement. 2.5 The Roads and Above Ground Services for Plans 10M-840 (part of), 40M-1670, 40M-1714 and 40M-I723 were issued a 'Certificate of Completion' dated September 30, 1997. This initiated a two (2) year maintenance period which expired on September 30, 1999. The Works have been reinspected and all deficiencies have now been rectified to the satisfactioll of the Director of Public Works. 1102 , REPORT NO.: WD-37-00 PAGE 3 2.6 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services for Plans IOM-840 (part of), 40M-1670, 40M-1714 and 40M-I723. The Subdivision Agreement requires Council approval prior to the issuance of any 'Acceptance Certificate' for Roads and Above Ground Services. 2.7 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the Municipality to assume certain streets within Plans 10M-840 (part of), 40M-1670, 40M- 1714 and 40M-I723 as public highway (Attaclunent No.'s 2, 3, 4 and 5). NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington enacts as follows: THAT certain streets shown on Plan lOM-840 and listed below in this section, all being in the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use: Hanning Court Elford Drive Pomeroy Street Fenwick Avenue Jollow Drive Copeland Gate The portion of Freeland Avenue comprised of Parts 1,2 and 3 on Plan 40R-19820 Block 143 (Mearns Avenue widening) Block 144 (Concession Road 3 widening) BY-LAW read a first and second time this 11'" day of September, 2000.
