PLAN 40M-1688, 'CERTIFICATE OF ACCEPTANCE' FOR STORM
SEWER SYSTEM AND
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW'
FOR ROADS AND ABOVE GROUND SERVICES (STAGE A ONLY)
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report WD-33-OO be received;
2. THAT the Director of Public Works be authorized to issue a 'Certificate of Completion' 'for
the Storm Sewer System constructed within Plan 40M-1688, and;
3. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for
the Roads and Above Ground Services, which include final stage roads and other related
Works, constructed within part of Plan 40M-1688 (Edgerton Drive), and;
4. THAT Council approve the by-law attached to Report WD-33-00, assuming certain streets
within part of Plan 40M-1688 (Edgerton Drive) as Public Highway.

2.0 BACKGROUND
2.1 The former Corporation of the Town of Newcastle, now the Corporation of the Municipality
of Clarington, entered into a Subdivision Agreement, registered November 22, 1991, with
621182 Ontario Limited to develop lands by plan of subdivision, located in Bowmanville
and described as Plan 40M-1688 (Attaclunent No.1). The agreement required the
developer to construct all roadworks, including hot-mix paving, sidewalks, curb and gutter,
street trees, a storm drainage system and streetlights, hereinafter referred to as the 'Works'.
2.2 The Subdivision Agreement provides for the separation of the Works into three (3) stages:
(a) Storm Sewer System;
(b) Bradshaw Street Urban Upgrading Works and;
(c) Roads and Above Ground Services
2.3 The Storm Sewer System for all of Plan 40M-1688 was issued a 'Certificate of Completion'
July 31, 1992. This initiated a two (2) year maintenance period which expired on July 31,
1994. Upon inspection, there were deficiencies with the Works and ongoing delays in
rectifying the deficiencies. The Works have now been re-inspected and all deficiencies have
been rectified to the satisfaction of the Director of Public Works. It is now appropriate to
issue a 'Certificate of Acceptance' for the Storm Sewer System. This particular Subdivision
Agreement requires Council approval prior to the issuance of any 'Certificate of
Acceptance' for Storm Sewer Systems.
2.4 The Bradshaw Street Urban Upgrading Works were issued a 'Certificate of Completion'
dated January 5, 2000. This initiated a two (2) year maintenance period which will expire
on Jannary 5, 2002. At that time, providing all deficiencies have been rectified to the
satisfaction of the Director of Public Works, Staff will prepare a separate report to Council
recommending the issuance of a 'Certificate of Acceptance' for those Works.
2.5 The Roads and Above Ground Services for Stage A (Edgerton Drive), were issued a
'Certificate of Completion' dated November 30, 1993. This initiated a two (2) year

maintenance period which expired on November 30, 1995. Upon inspection, there were
deficiencies with the Works and ongoing delays in rectifying the deficiencies. The Works
have now been re-inspected and all deficiencies have been rectified to the satisfaction of the
Director of Public Works. It is now appropriate to issue a 'Certificate of Acceptance' for the
Roads and Above Ground Services for part of Plan 40M-1688 (Edgerton Drive). The
Subdivision Agreement requires Council approval prior to the issuance of any 'Acceptance
Certificate' for Roads and Above Ground Services.
2.6 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the
Municipality to assume certain streets and reserves within Plan 40M-1688 as public
highway (Attaclunent No.2).

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2000-
Being a By-law to establish, layout and dedicate certain
lands as public highways and to asswne certain streets within
the Municipality of Clarington as public highways in the
Municipality of Clarington.
NOW THEREFORE, the Council of the Corporation of the Municipality of Clarington enacts as
follows:
1. TIIAT the lands described as Blocks 107, 109, 115 and 116 on Plan 40M-1688, in the
Municipality of Clarington, Regional Municipality of Durham, are hereby established, laid
out, dedicated as public highway and assumed by the said Corporation for public use.
2. TIIAT the streets and blocks shown on Plan 4OM-1688 and listed below in this section, all
being in the Municipality ofClarington, in the Regional Municipality of Durham, are hereby
accepted by the Corporation of the Municipality of C1arington as public highways, and
assumed by the said Corporation for public use:
