Recommendations:
It is respectfully recommended that the General Purpose and Administration CDmmittee
recommend to Council the following:
I. THAT Report WD-32-00 be received;
2. THAT the Oak Ridges Trail AssociatiDn (ORTA) be granted approval to use the specified
unopened road allowances (except through the Ganaraska Forest), as shown on the attached
map (Attaclunent No. I);
3. THAT the propDSed by-law attached to Report WD-32-00, be passed by CDuncil,
authorizing the use of the unopened road allowances as shown on the attached map
(Attaclunent No.1);
4. THAT Roy Forrester, Clarington Chapter, and the property owners who expressed concern
be advised of Council's decision; and
5. THAT the Townships ofManvers, Scugog and Hope be advised DfCouncil's decision.

2.0 BACKGROUND
2.1 Council at its meeting of February 15, 1999 passed Resolution #GPA-86-99 and approved
the following Recommendations in Report WD-l 0-99 (Attachment No.2):
"THAT the Oak Ridges Trail Association (ORTA) be granted
approval, in principle, to use specified road allowances
within the former Township of Clarke, to extend the Oak
Ridges Moraine Trail, subject tD ORTA fulfilling all
conditions, as specified in Attachment No.2, to the
satisfaction of the Director of Public Works;
THAT the Townships Df Manvers and Hope be provided
with a copy of this report and advised of Council's decision;
THAT the Mayor and Clerk be authorized to execute the
proposed by-law authorizing use of the specified unopened
road allowances when all conditions have been fulfilled to
the satisfaction of the Director of Public Works; and
THAT Mr. Roy Forrester, ORTA Chair, Clarington Chapter,
be advised of Council's decision."
2.2 Council at its meeting of March 22, 1999 passed Resolution #C-212-99:
"THAT the proposed amendment to Report WD-1O-99, as
requested in correspondence dated March 17, 1999, from
Roy Forrester, be approved in principle, subject to the same
conditions specified in Report WD-I0-99 and as approved by
Resolution #GP A-86-99;

THAT the Townships of Manvers and Hope be provided
with a copy of the correspondence and map and advised of
Council's decision; and
TIIAT Roy Forrester, ORTA Chair, Clarington Chapter, be
advised of Council's decision."
2.3 As a result Dfnotification by ORTA to abutting property owners, a number of these owners
submitted cDrrespondence and made delegatiDns to Council in opposition to the proposed
trail. The correspondence was referred to the Public Works Department to be cDnsidered in
conjunction with this report, as follows:

2.4 Two Public Information Meetings were held by ORTA in the Orono Town Hall:
1. Tuesday, April 20, 1999
2. Tuesday, January 25, 2000
2.5 Report WD-IO-99, Recommendation No.2, set out specific conditions to be satisfied by
ORTA to obtain final approval from the Municipality. ORTA has advised the Municipality
that they have satisfied the conditions as specified and they are asking Council to grant
approval of the trail route.

Conditions Imposed by the Municipality in Report WD-l 0-99 (Attachment No.2):
1. Notification of Abutting Property Owners:
ORTA has advised the Director of Public Works that all abutting property owners,
,
as listed in the assessment rolls of the Municipality, have been nDtified, in writing, of
the proposed trail route. A listing of the abutting owners who were notified is on file
in the Public WDrks Department. It should be noted that the assessment records,
where property ownership had recently changed, were nDt current. However, the
Director of Public Works is satisfied, through newspaper ads and notification, that
every effort has been made to ensure notification to all abutting owners.
2. Liability Insurance:
ORTA has provided proof of Liability Insurance satisfactory to the Director of
Public Works. A copy of the Policy is on file in the Public Works Department.
3. Release, Waiver and Indemnity Document:
ORTA has executed a Release, Waiver and Indemnity Form satisfactory to the
Director of Public Works. A copy is on file in the Public Works Department.
4. Conditions 4, 5 and 6 relate to damage to road allowances, modificatiDns to road
allowances and continued use of road allowance.
The Director of Public Works is satisfied that the Association will maintain the trail
and continue to work with the Municipality to ensure the public's safety and protect
the environment. The Public Works Department will inspect the trail from time to
time to ensure cDntinued maintenance.
7. Signage of the Trail:
UpDn receipt of final approval from the Municipality, ORTA will supply a map
indicating directiDnal signing.

8. BDundary Roads - Abutting Municipal Approvals:
The Townships of ScugDg and Manvers have endorsed the development of the trail
and the use of the Boundary Roads as part of the Oak Ridges Trail. Copies of the
approvals are on file in the Public WDrks Department.
SUMMARY:
The Director of Public Works is satisfied that ORTA has fulfilled the conditions of
approval set out in Report WD-l 0-99 (Attachment No.2).
2.6 OppositiDn by Abutting Property Owners:
1. Correspondence from Mrs. Fran Harvie, undated (Attachment No.3):
Mrs. Harvie, 8801 Mosport Road, has a Purchase and Sale Agreement with Dufferin
Aggregates for the property shown on Attachment No. 1. Mrs. Harvie's
correspondence states that "this ''trail'' has caused my right to quiet enjoyment" to be
breached and the safety of not Dnly my home and outbuildings, my family and my
immediate environment including wildlife to be compromised."
The route of the proposed trail abuts the subject property as shown Dn Attachment
#1. The trail link referred to in Mrs. Harvie's letter is shown as a forced road, closed
by By-law #79-17. Ownership has not been confrrmed. IfORTA wish to use this
section as a loop trail or as a part of their trail, it is recommended that before
approval is considered, ownership must be legally confirmed.
2. Correspondence from~. and Mrs. B. Niklaus (Attachment No.4):
Mr. and Mrs. Niklaus own the property shown on Attachment 1. Mr. and Mrs.
Niklaus report broken fences and damage to property by trespassers.
There will be no change required to the road allowance in this location. In the case
where fences are on the road allowance, they will remain. Stiles will be provided by
ORTA to avoid damage tD fences and to discourage mDtorized vehicles.

3. Correspondence from Mr. and Mrs. David Gould (Attachment No.5):
Mr. and Mrs. Gould own the property shown on Attachment 1. Mr. and Mrs. Gould
report continuous problems with trespassers trying to gain illegal access to Mosport
Park. They are also concerned about users staying on the trail.
There is no way for ORTA to guarantee only ORTA members will use the road
allowance. Further, they have no influence on trespassers attempting to gain illegal
access to Mosport Park.
The unopened road allowance in this location will be signed and the entire trail will
be signed at regular intervals advising users to "stay to marked trail and respect
owners' property". There is no alteration required to the unopened road allDwance
in the vicinity of the Gould's property. Some brushing will be required at the
westerly end of the road allowance.
4. Correspondence from Mr. and Mrs. Leigh Parker (Attachment No.6):
Mr. and Mrs. Parker own the property shown on Attachment No. 1. Mr. and Mrs.
Parker advised that the lDcation of an existing trail is on private property and that the
existing fence divided their property and the Kennedy's.
On the advice of the Public Works Department, ORTA engaged the services of
Doug Coggan, Ontario Land Surveyor, to establish the boundaries of the road
allowance in relation to the Parker and Kennedy properties. Roy Forrester has given
assurance to Public Works that the trail will not go on private property. Where the
fence is located on the road allowance abutting the Kennedy property, ORTA have
committed to providing stiles in this location. Some minor brushing and clearing
will be required for the trail.
5. Other Correspondence:
Correspondence was received from Mr. and Mrs. Stephen Tinmouth (Attachment
No. 10), Diane Schwartz (Attachment No. 11) and Katherine Braid, in opposition to

the establislnnent of the trail in CDncession 9, between Lots 20 and 21. Public
Works reviewed this location and agreed that since there was an alternative location,
this road allowance should not be used. The proposed north/south location of the
trail has been changed to the unopened road allowance between Lots 18 and 19, in
Concession 9. The trail location proposed at the north end of these properties is
recommended.
2.7 Public Information Meetings:
Meeting of April 20, 1999 - Register is Attaclnnent ND. 7
Concerns:
1. Lome Thompson
Concerned with putting cross country skiers and snowmobiles on the same trail.
Correspondence was received from Keevan McCrum, President, Long Sault Ridge
Runners SnDwmobile Club dated February 6, 1999. Mr. McCrum states that he does
not see a cDnflict as they currently share use with cross country skiers and dDg
trainer teams without problems (Attaclnnent No.8).
2. Diane Schwartz
Trail location is changed.
3. Debbie Tinmouth
Trail location is changed.
4. Alex and Connie Wiseman - Lot 9, Concession 9
Concerned about motorized vehicles leaving trail to explore and cause damage and
liability issues.

The trail is not intended for use by motorized vehicles. In some locations however,
motorized vehicles are presently using the unopened road allowances, without
authorization.
5. W. and V. Griffin - Lot 2, Concession 9
Concerned that additional people will result in more damage to their property. They
are requesting that the trail be fenced to protect their property.
ORTA have agreed that they will maintain the trail, however, the request to build a
fence is not financially possible for the Association.
6. Sylvie and Leigh Parker
Refer to correspondence from Mr. and Mrs. Parker (Attaclunent No.6) and Section
2.6(4) of this report.
7. Wayne Kennedy
Mr. Kennedy's questions are: who will pay for fencing; who will ensure
snowmobiles etc. do not use trail; who will pay for survey; clean up debris; who will
ensure cars do not block driveways; and will it affect taxes?
Fencing will not be affected by the trail. Stiles will be used where the trail is
intersected by fencing. Actually, existing fencing and obstacles will remain as a
deterrent to mDtorized vehicles. As stated previously, ORTA will maintain the trail.
Parking locations have been identified on the trail map (Attaclunent No. I). In this
location, the property boundaries and road allowances were identified and marked
by an Ontario Land Surveyor.

Correspondence was addressed directly to Council and referred to Public Works by Council
Resolution.

2.8 Correspondence in Support of Trail:
1. Correspondence from Doug Ferguson dated August 28, 1999
Support for volunteers and advising he is offering to help with the trail.
2. Correspondence from Durham Regional Police received March 30, 1999
Durham RegiDnal Police advising they support this endeavDur that promotes
conservation and healthy lifestyles.
3. Correspondence from Dufferin Aggregates (Attachment No.7):
Confinning the proposal for a joint venture to educate the public on pit operations,
rehabilitation, etc. and acknowledgement of support for the project.
2.9 Approval of Abutting Municipalities:
The Townships of Scugog (Attachment No. 14) and Manvers (Attachment No. 15) have
endorsed the establishment of the Oak Ridges Trail.
2.10 The Draft Report:
Correspondence was received in response to the recommendations in the Draft Report WD-
32-00 as follows (summary of correspondence shown in italics):
Correspondence from Leigh Parker dated June 15, 2000 (Attachment No. 17).
. Mr. Parker advises that he disagrees with the boundaries of the road allowance
identified by the surveyor.
. Staff confirmed with the Ontario Land Surveyor that in fact, the iron bars are placed
correctly and the locations were actually identified from a survey of Mr. Parker's
property completed by the surveyor in 1963 (Attachment No. 18).

Correspondence to R. Forrester, Oak Ridges Trail Association, from Peter Attfield dated
June 16,2000 (Attaclunent ND. 19).
. Suggestions for incorporating educational area in conjunction with Dufferin
Aggregates.
Correspondence from B. Niklaus dated June 19, 2000 (Attaclunent No. 20).
. Mr. Nildaus advises that signs can be put up and taken down. He demands that his
property line be properly fenced. He fUrther advises of illegal hunting on his land. He
feels the land sold by the Municipality on Morgan's Road was undervalued and should
have been given to ORTA instead of being sold, etc.
. Mr. Niklaus owns the vacant property south of the proposed trail. Fencing private
property is not within the financial scope of ORTA. The illegal hunting etc., and the
issue of trespassers is not within the Municipality's Dr ORTA'sjurisdiction; it is a police
matter. ORTA has committed to placing signs advising trail users to stay on the trail.
Correspondence from Myles Brandt, Mosport International Raceway dated June 21, 2000
(Attaclunent No. 21).
. Mr. Brandt is opposed to the ORTA trail because it would create openings for
trespassers to Mosport property and it would be impossible to tell who was littering the
trail and who would be responsible for cleanup.
. ORTA has agreed to eliminate the parking area at the Darlington/Clarke Boundary at
Concession Road 8 as it would be difficult to determine whether people were there for a
Mosport function or hiking. ORTA have committed to maintain the trail and advise that
they will be responsible for cleanup of the trail in the area ofMosport.

. Mosport property boundaries have no security fencing in the area of the proposed trail.
ORTA further agreed to close the trail and to not schedule hiking events (during major
events at Mosport).
. In telephone conversations with Mr. Brandt, he has indicated that trespass during race
events has decreased over recent years. AlthDugh Mosport would prefer not to see a trail
adjacent to their unfenced property boundary, they are generally satisfied with the
measures as proposed by ORTA, which are outlined above.
Correspondence from Stephen McMullen, Ganaraska Forest Co-ordinator, Ganaraska
Region Conservation Authority, dated June 22, 2000 (Attachment No. 22), outlines the
following concerns.
. That the Municipality has confirmed that the trail is following municipal road
allowances throughout its length in the area in which it passes through the Ganaraska
Forest.
. That during trail construction the road allowances can be located and that the trail is
established within these road allowances.
. That during trail construction no damage occurs to adjacent forest property.
. The Conservation Authority would prefer that no new trails be cut on the road
allowances that pass through the forest as it is felt that there are enough existing trails
in the west forest area.
. ORTA should be aware that any new trails established in the western part of the forest
will be subject to a variety of recreational uses including motorized use.
. There are concerns with the locations of the parking areas, most notably the one shown
at the Ganaraska Forest Centre and the first lot shown east of Highway 115 along

Boundary Road. These concerns should be resolved through discussion between the
Conservation Authority and ORTA.
. ORTA advised Staff that they have corresponded and met with Ganaraska Staff
regarding the use of existing trails.
. Staff met with members of ORTA on Monday, June 26, 2000 regarding the proposed
trail link using unopened road allowances through the Ganaraska Forest. It was agreed
that approvals to use unopened road allowances from Lot 15 easterly in the Ganaraska
would be withheld at this time to allow ORTA to continue to negotiate with GRCA to
obtain approval from the Board to use existing trails within the Ganaraska Forest. The
next meeting of the GRCA is July 20, 2000.
. The CDncem regarding parking areas has been resolved. ORTA has agreed to eliminate
the parking areas.
Correspondence from Wayne Fairbrother, Templeton, Menninga dated June 23, 2000
(Attachment No. 23).
. Templeton, Menninga are the solicitors representing LaFarge Canada Inc. They are
advising the Municipality that they will be applying for licence to expand the existing pit
area. The application will include the unopened road allowance between LDts 18 and 19
in Concessions 9 and 10. They do not object to the ORTA request but they do not wish
to have any pennissions that may be granted to ORTA prejudice the company's
expansion plans.
. Staff, during its meeting with members of ORTA on June 26, 2000, confirmed with
them that they are agreeable to work with LaFarge should the applicatiDn for licence be
jeopardized by the Oak Ridges Trail being on the road allowances being Concession
Road 10 and between Lots 18 and 19.

3.0 CONCLUSION
3.1 The Public Works Department has worked directly with ORTA to establish an Oak Ridges
Trail link in Clarington. There are a number of locations where the abutting property
owners are opposed to the proposed traillDcatiDn. In each case, ORTA has investigated
whether equal or preferable alternatives existed. Where other practical alternatives were
available, ORTA was encouraged to use the alternatives and/or satisfy the property owner.
A draft copy of Report WD-32-00 was distributed and the comments received in response to
the Report are included in this report. Unfortunately, there are still a few locations, as noted,
where abutting owners do not support and are opposed tD the location of the trail.
The Public Works Department is satisfied that the conditions set out as Attachment No.2 to
Report WD-I0-99 have been satisfied. The Director is also satisfied that the Association
has made every practical effort to satisfy the concerns of the abutting property owners.
The Public Works Department will continue to work with ORTA to ensure the trail is
maintained and that the public's safety is a priority. If situations arise where there are
problems, relocation of portions Dfthe trail shall be considered.
3.2 The Public Works Department is supportive of the proposed trail location as shown in
Attachment No. 1. It is, therefore, recommended that Council pass the proposed by-law
authorizing the trail route proposed by the Oak Ridges Trail Association as shown on the
attached map (Attachment No. I).

Being a by-law to authorize the use of the unopened road allowances
shown on the Map attached as Schedule A by the Oak Ridges Trail
Association, Clarington Chapter
WHEREAS Council at its meeting of July 10, 2000, approved the recommendations in
Report WD-32-00, and authorized the use of the unopened road allowances as shown on
the Map attached as Schedule A to By-law 2000-
AND WHEREAS the Oak Ridges Trail Association bas satisfied the conditions specified
in Report WD-32-OO;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Municipality of
Clarington approves the use of the unopened road allowances shown on the Map as
Schedule A to this by-law.
By-law read a first and second time this 10" day of July 2000.

2.1 Council, at itS meeting of January 9, 1999, passed Resolution #C-17-99, as follows:

Roy Forrester, ORTA Chair, made a presentation to Council to obtain approval to oal ..
the Oak Ridges Moraine Trail system as shown in Attachment No. I. The preferred route
sclected by the Association includes parts of unopened road allowances in the former
CJmb TOWII8bip. OR.TA is rcqu~ Council's approval to use the unopened road

3.0 REVIEW AND COMMENT
3.1 The 0ekRid.gcs Trail Association (ORTA) is requesting Council's approval to use a
nwnber of unopened road allowances as part of the Oak Ridges Trail System.
Mr. Forrester and Carl Schenk met with Public Works and Planning staff to determine the
most suitable trail location. The Public Works and Planning Departments have no
objection, in principle, provided that certain conditions are satisfied to ensure public
safety and protect the Municipality from liability.

3.2 Geographic Location of the Oak Ridges Trail Extension
The unopened road allowances proposed to form part of the trail are shown in Italics. All
other road allowances are currently open. Request for approval to use these road
allowances is the subject Df this report. In accordance with the Municipal Act, approval
to use Boundary Roads must be granted by both adjoining municipalities.

3.3 There are a number of issues identified for Council's information and consideration:
3.3.1 Abutting Property Owners
It is recommended that the abutting plUpcrty owners be contacted by the Association md
advised that the road or road allowance abutting their property is intended to be used fur
the Oak Ridges Trail. Abutting owners to the unopened road allowances should be aware
that the trail is being established. In the area of Best Road in Concession 10, a portiOftof
the trail is located adjacent to areas zoned for aggregate extraCtion, The zoning retleca
the location of licensed operations that are active or will become active. 1'be trail
aIi~ may have to be re-negotiated from time to time in order to avoid potential
conflicts and for safety reasons. A portion of the proposed trail is a permitted
snowmobile trail. Again, for safety reasons, certain arrangements should be i1egotiatIId
with the snowmobile club. Abutting municipalities must approve use oftbe bqnl~""'l
roads. Acknowledgement that this notification has been completed must be.,ub.. .t. 1 tIO
the Director of Public Works.
3.3.2 Private }\uperty
There is a section of the proposed trail, easterly from the end of the maintained portioDof
Wilcox Road to the road aJIowance between Lots 14 and 15, which is private Ploperty.
In order for the trail to connect, a legal agreement must be negotiated between the
I"operty owners and the Association.
3.3.3 Clarington Official Plan and Zoning By-law
Staffreviewed the proposed trail in the context of the CIarington Official Plan and
Zoning By-law.
Section 4.4.2 of the Official Plan states:
''The Municipality supports the establishment of an Oak Ridges Trail System as
part of the Municipality's integrated trail network. The Municipality will consult
with provincial agencies, the Conservation Authorities and the public interest to
such matters as trail location, design and funding."

Section 14.6.1 also states:
"Uses permitted in the Moraine shall be conservation, reforestation, agriculture,
and passive recreational uses such as pedestrian trails and horseback riding."
The Clarington Official Plan encourages the routing of a Trail in the Oak Ridges
Moraine.
3.3.4 Liability Protection for the Municipa1ity
In order to reduce the risk ofliabi1ity to the Municipality, it is recommended that die
Association be required to fulfill several conditions (Attachment No.2); sip a Lease.

4.0 CONCLUSION
The Municipality, through the Official Plan, endorses development of the Trail. The
Public Works Department has no objection to use of the unopened road allowances
provided that the Association fulfills the specified conditions to ensure public safety and
protect the Municipality from liability. As well, it is appropriate to advise abutting

CONDmONS FOR USE OF UNOPENED ROAD ALLOWANCES
1. All abutting property owners must be notified, in writing, that the portion of unopened
road allowance abutting their property will form part of the Oak Ridges Trail.
2. The Oak Ridges Trail Association will maintain in effect liability insurance ofnot less
than 52,000,000.00, naming the Corporation of the Municipality ofClarington as c0-
insured. A copy of the insurance certificate is to be filed with the Public Works
Department.
3. The Oak Ridges Trail Association is ,esponsible for any claims directly re1ated to tile
trail. The enclosed Release, Waiver and Indemnity document must be completed aod
returned to the Public Works Office prior to any use or undertaking of any works on the
trail.
4. Damages to the road allowance are the responsibility of the Association and will be
repaimI by the Association to the satisfaction of the Director of Public Works.
5. Trail improvements, modifications, etc., must be approved by the Director prior to
commencement of works.
6. Failure to comply with any subsequent direction from the Public Works Office with
regard to public safety or environmental concerns arising from the use of the unopened
road allowances will void this approval.
7. A map of the exact trail with signage and marking must be provided to the Public Works
Office.
8. That the abutting Municipality approve the location of the trail on the Boundary Road.

This "trail" has caused my "right to quiet enjoyment" to be
breached and the safety of not only my home and outbuildinss,

to be compromised. Old or current deer trails and pathways
that we use on the property are not public walking trails.
The original guidelines referred to "abutting or a~joining"
never did traversing enter into it. There appears to be nO
consideration or respect for other parties' property and L

I. The line fence between lot 25 and lot 24 has a 66 foot offset. Half the
road allowance is on 'Kennedy's property' and half is on 'Parker's
"'U~ty.' Thus a revised line fence will be required.
2. Tbe~Dt path is not on the road allowance. It is on private property.
3. Num.erous trees will have to be cut to open the road allowance.
4. Signs. tines and mechanical barriers will not stop motorised vehicles.
Dirt bikes. four wheelers, and snowmobiles are currently some problem

members of council on that Monday evening in the matter of the Oak Ridges Trail

As to multi-use hiking trails - we are all for it!! My husband and I own 3 horses and I
have beenridiDgin the Ganaraska Forest for over 10 years. We know the beauty of the
forest and woodlands, the joy of a glimpse of wildlife, the rejuvenation of the heart and
soul that can be found in the wilds. Our concern lies around the central issue of where
one's right to enjoy the walking trails comes into conflict with the rights of property-
owners who abut such trails. Users of the Ganaraska Forest recognize the 'red' circles
which designate private property and we believe that with 11,000 acres offorestland
available to the public use, there is absolutely no need to disrespect one's private property
by insisting on having access to it.
Madam Mayor, I'm sure you are aware that some residents have voiced their opposition
to the proposed location of certain sections of the Oak Ridges Trail. I shall deal
exclusively with our issues pertaining to Lots 20 and 21 where.the Association indicates

between Lots 21 and 20 to unopen concession 10 which runs east ofHwy 115.
On the evening of Sunday, July 18 we invited Mr. Forrester to attend our home and
property to try to work on a compromise to the situation; to show him alternative trails
and explain our numerous concerns. In the spirit of co-operation and in good faith, we
spent over an hour with him, we went over his maps (which were inaccurate as to the
location of the next north/south unopen road allowance), we took him in our vehicle to
show him at least 3 alternative trails running east/west and an additional 3 trails running
north/south that are already existing, require little or no construction or clearance work,
and are a1ready available to the public because they are on GRCA property. Most
importantly, these areas are uninhabited and consequently, do not disturb any residents.
Imagine our anger to hear Mr. Forrester distil our valid concerns into one wholly
misleading statement, and I quote - "I went to one of their houses - the trail is blocked by
brush and - they simply don't want it."
We were so shocked in light of the perception that the Association is 'respectful' of
residents and wants to use 'existing natural walkways.' Ms Hamre, there are no existing
natural walkways on our property nor on Ms Schwartz'. When we questioned Mr.
Forrester as to why he would insist on accessing this particular unopen concession, he
replied in a rather meanspirited tone "because I can".
I shall take an organized approach to setting out Dur issues:
History of Lots 21 and 20, Wilcox Road, Township ofClarington
For 100 years, Lots and 21 and 20 were one farm consisting of 200 acres of agricultural
land. How long the unopen road allowance has existed is not known to me.
Approximately 15 years ago, the total farm was purchased by the Bustiger Corporation
(Diane Schw..tz who has also submitted her written opposition). Shortly thereafter,
Bustiger severed 100 acres of agricuhura11and to Katharine Braid. Ms Braid built a
home and garage which she sold to us in May, Diane Schwartz remains the owner of Lot
21 to this day. I have attached Exhibit "A" to this letter to better illustrate the location of
buildings, the shared fence lines and horse paddocks, hay fields and a large barn facility
that houses both Ms Schwartz' 2 horses and our 3. Our two farms are the quintessential
example of good neighbors - we watch over each other's properties because we are so
isolated, we feed and water each other's horses when on vacation, we share a woodlot, we
have a lane running between the two farms to allow for movement of farm vehicles and
hay wagons, our horses share the same barn and all of our winter hay requirements are
stored in the barn on Lot 21 due to our limited storage on Lot 20. We are the last 2
residences on Wilcox Road, and there are no further neighbors for 14 miles behind us.
Both of our farms are under hay cultivation by Mr. Jim Stevenson. Indeed, Mr. Stevenson
spent considerable expense and effort in the last year fertilizing and seeding both
properties. There are no fences dividing the huge hayfield that lies behind our respective
horse paddocks. We have grave concern about public access to our cropland - this
hayfield feeds Mr. Stevenson's cattle and our combined 5 horses..

Residents of the Ganaraska have long been severely challenged by dirk-bike and
snowmobile access to our property. The GRCA stand on trail use is clear - all trails are
multi-use. Mr. Forrester made the comment to us himself that once the trail was built, he
would have no policing authority Dver it. Madam Mayor, if a trail is built across our
properties that accesses the GRCA lands, I believe the expression is "build it and they
will come!" Build this trail on our lands and we will have no control whatsoever over
motorized access to and damage of our hayfields, our woodlot will become another dirt-
bike enduro site, our livestock will be totally exposed to the roaring noise and fear
inspired in them by such motorized use. Unfortunately, people often don't just leave their
footprints - they leave their drink cans, lunch rappers, empty film cannisters and shell
casings. It would only take one lit cigarette to destroy our hayfields at this time of year.
In closing on this issue, establishment of a trail at this. point would require movement of
fences and gates, installation offencing to keep the pu!>lic off the cultivated lands and
considerable expense by the Association to do so. The 'jog' around the gated portions
would bring the Association onto our privately held lands and we are not prepared to
grant any access whatsoever.
Liability Issues
The proposed trail travels north along our fence line which houses our horses, to a point
where a system of2 existing gates open. east and west across the farm lane (see attached
Exhibit" A") which join the horse pastures next door. The public would at all times have
access to our horses. Our horses are not visible or accessible at any other point on our
property. This is deliberate and for a number of reasons - people simple cannot resist
climbing on the fences, taking pictures of, wanting to pet and/or feed the horses!. They
simply do not rea1ize the danger! Horses are large, they are fast, they are herd animals
and their instinct in what they perceive to be danger, is to run - regardless of what it is
front of them. Did you know that f....Ail1g them grass out of your hand can cause them to
choke? That they have food allergies just like people do? That they wear steel shoes on
all four feet? Did you know that they can only see to each side, they do not have a direct
frontal siteline which means they do bite big and little fmgers alike! Ms Hamre,
inexperienced but well meaning hikers WILL climb onto the fence, will feed them
something out of their hands, walk closer to take pictures, and the end result can be
severe injury and even death. Obviously, we carry third party liability but it requires us
to notifY our inSurance company when we take horses off the property, when they are
being transported or if we are hosting an 'event'.
Madam Mayor, I worked in a major downtown law firm for over 6 years. I can assure
you that a waiver means nothing, that if! put up signs saying "please don't feed the horses
or approach them" I am admitting liability in advance, that there is not an insurance
company in the land that will offer to pay a claim. I simply do not wish to be put in the
position Dfhaving the Association's insurance carrier and mine pitting themselves
opposite in court trying tD get the other one to pay. I would remind you of the case a few
years ago wherein a young boy 'broke' into the Metro Toronto Zoo after hours. He

climbed over a clearly marked perimeter fence and teased the resident wolves into a
frenzy and they subsequently bit his arm off. The Zoo was held liable and the damages
were in excess of $750,000.
In addition, because of the very remoteness of our property, we have encouraged the
growth of surrounding bush so that the house and its contents are not so visible and
tempting to potential thieves. Allowing public access within sight of our house destroys
that which Ms Braid and ourselves have worked to accomplish to shield the house from
public view.
Parking
As you are aware, Wilcox Road as it pertains to Lot 20 is not maintained by the
Township ofClarington. All road maintenance and snow clearing ends at Lot 21. My
husband and I blow the snow, plow the road, fill the pot holes and grade the section of
road that travels over Lot 21 and Lot 20 until it reaches our driveway. Although we
recognize that we pay the full amount of property tax due, we do not have road
maintenace of any kind and it is questionable access for fire, police or ambulance to our
particular property. Again, Lot 21 and 20 have experienced numerous unpleasant parkiDg
issues because of our proximity to the Ganaraska Forest. We have cars parking to offload
snowmobiles and/or dirtbikes all year road. Unfortunately, we have had to ask people'
numerous times not to block the 'driveway' and in essence, Wilcox Road as it travels"",,,,,
across lots 21 and 20 is on private property. The road width at this point is apprOJ,j... IIJl'f"
8 feet. ..
By establishing a trail head at this particular unopen concession, you are inviting the
public to park there and offload. There will not be sufficient room for our vehicles to
pass by any parked cars to access our driveway. There most certainly would not be
sufficient width for access by any fire, police, ambulance or emergency vehicles to get to
our home.
The answers to all ofthe above are so simple - there are no less than 3 alternative existing
north/south trails and 3 east/west trails within 1/4 mile of this unopen road allowance!
Madano Mayor, we sold our home in Whitby and cottage in Gravenhurst because we so
desired to 'restore ourselves' just as the President of the Association mentiDned in his
presentation. We have invested our lifesavings, given a great deal of thought to our
lifestyles. We each commute more than 3 hours a day to our jobs because we believe we
have purchased a piece of heaven in the Municipality of Clarington for our home. It is
private, quiet and peaceful and we are passionate about protecting it!. Please give your
due cDnsideration to our very real CDncerns.

We remain committed to helping the Association achieve their ends. We simply ask they
give the same respect and recognition to us as they are asking for themselves. We are
available at almost any time for conversation with the Association and certainly invite
yourself or any member of Council to attend our home and 'see for themselves'. In light
of the mi~l~csentatiOns made by Mr. Forrester as to the content of our discussions with
him, we feel unable to continue any worthwhile conversations with him but would
welcome hearing from some other member of the Association. However, in light ofhis
misrepresentation and diminishment of our concerns, I wonder how many other property
owners have had a similiar experience?
One fina1 note of encouragement - Mr. Steve Vokes and Ms Jan O'Neil have contacted us
directly as they were aware of our written opposition. They have very kindly offered to
attend our farm on the morning of Tuesday, July 27 at 8:30 for an on-site visit.

Hello Roy,
I was pleased to read in ORTA's "Trail Talk" that you are setting up a rest/picnic/educational area on the Trail in conjunction
with DutIerin Aggregates.
If it an aggregate pit is within sight there or nearby, here are some ideas for your consideration. Feel free to share theae with
DutIerin Aggregates if you wish:
I. Could ask DutIerin Aggregates to provide a modest-sized pile of each of the common grades of aggregate, with a label to
tell what it is used for. (E.g., round versus crushed; road foundations, drainage, filters, landscaping, winter road traction,
bricks, mortar, concrete, paving stones, asphalt, glass, steel production, etc. )
Could maybe even show samples of some of these finished products, e.g., bricks, mortar, paving stones, asphalt, glass, etc.
Perhaps set them in _ so they couldn~ be stolen!
2. Since ~ are m-.-ed by the tonne, maybe DutIerin could provide a pile of one tonne to show what one_
actually looks like. If that was not possible, perhaps build a wooden box or a wood or metal frame to show the volwne that
is occupied by one tonne. (l think it's about one metre by one metre by one-half metre.)
3. Perhaps a sign could point out some of the features of that particular pit, e.g.:
- any layers visible in the sides of the pit;
- any weigh scale or other facilities or equipment;
- any piles of soil stored OIl site to use in rehabilitation;
- any rehabilitation that's already progressed;
- a picture of bow the site might look after it has been closed and rehabilitated.
4. Here are some statistics that I found interesting:
- Aggregate is consumed in Ontario at a rate of 20 tonnes per person per year.
- About half of this goes to road construction, repair and maintenance. Most of the rest goes to construction of buildings.
- It takes about 325 tonnes of aggregate to build one house.
- It takes about 24,000 tonnes of aggregate to build one kilometre of highway.
- About 18 million tonnnes of aggregate are taken from about 300 active pits on the Oak Ridges Moraine each year. That's
roughly about 50,000 toa.- per day, or about 2,000 truck lo8ds per day. (Assuming a mix of single and tandem trudr;s.)
- The aggregate ~ were brought to the Moraine by advmciDg glacier ice, and sorted acrording to size by &lacier
meltwater.
5. We can put some infonnation about the site into the Guidebook, but there is limited space. You would have more room
on a sign or signs.
, 6. The Caledon Hills Bruce Trail Club has a good design for a very simple rest bcnch. It is a platfonn of2x4s (or 2x6s??),
i about one metre wide and two metres long, supported on four legs. Because it has no particular front or back, and no bade.
support, it can be sat on in any number of ways by a wide range of group sizes - e.g., one or two people sprawled out, up to
ten people sitting close together. If you're interested, I'l1 contact them to ask for a sketch or design. Of course standard
picnic tables are ideal for picnicking!

Our client is desiroWl of submitting an application to the Municipality and the Province for
obtaining the necessary approvals to expand the existing licenscd area presently located on
Lot 18, Concession X. To that end, a pre-submission consultation meeting WlIII haW with
rcpI'CS<.'Iltativcs of the Mwricipality on Monday, June 19". This was purely an ~, [lu.y
m~ and provided an opportunity for representatives of Lafarge to acquUd the
Municipality with their intentions and ascertain the nature of thc issues to he addnlsIe d in
proceeding with such applications. A portion ofthc meeting was spent discussina ORT A's
request for appl'ovalto use the above-notcd unopened road allowances as part of its trail
system.
On behalf of our client, we wish to advise the Municipality and the General Purpose and
Administration Committee of the following:

It is the intent of Lafarge and its affiliated company to submit in due course
applications for the necessary approvals to permit an expansion of the existiug pit
onto other lands owned by our client in ConcessioDS IX and X as described above.
In seeking such approvals, pennission from the Municipality willlibly be. aequircd
to cross over or have access to all or a portion of the unopened m\lJ1icipa1 road
allowances located between our client's land holdings in Concessions IX IIId X.
As COJItmlp!ated by the Municipality's poliq foe the clO8Ul1l and c:onveyIDte of
municipal roed allowances, our client proposes to deal with any ~ roed
closure in conjunction with its development application.
