THAT Report WD-27-00 be received; 2. THAT regulatory weight restriction signing be posted as per the Manual of Uniform Traffic Control Devices, at bridges, at the prescribed weight limits, as recommended during Engineering Inspections and detailed in this report; and 3. THAT the by-laws attached to report WD-27-00 (Attachment Nos. 2 to 10) be passed by Council and fOIwarded to Totten Sims Hubicki Associates for completion of the Engineers Statement being Schedule "A" to each by-law. REPORT 1.0 ATTACHMENTS No.1: Key Map No.2: Proposed by-law to restrict the weight over Bridge 094023, Prospect Street No.3: Proposed by-law to restrict the weight over Bridge 094025, Jackman Road No.4: Proposed by-law to restrict the weight over Bridge 098003, Lakeshore Road No.5: Proposed by-law to restrict the weight over Bridge 098011, Nichols Road No.6: Proposed by-law to restrict the weight over Bridge 098013, Nichols Road No.7: Proposed by-law to restrict the weight over Bridge 099015, Providence Road No.8: Proposed by-law to restrict the weight over Bridge 099023, Old Scugog Road No.9: Proposed by-law to restrict the weight over Bridge 099043, Cedar Park Road No. 10: Proposed by-law to restrict the weight over Bridge 099045, Holt Road 11 01 ;. ~ , REPORT NO.: WD-27-00 PAGE 2 2.0 BACKGROUND 2.1 Due to the obsolescence or weakening of bridges, it is often necessary for municipalities to limit the gross weight of vehicles on bridges on ;l temporary, seasonal or permanent basis under authority of the Highway Traffic Act., RS.O. 1990, c H.8, as amended from time to time, including H.T.A.(Section 123 (2)) and the Bridges Act (Section 2). 3.0 REVIEW AND COMMENT 3.1 During January, 2000 Totten Sims Hubicki Associates forwarded to the municipality the 1999 Roads Needs Study Update, Bridge and Culvert Appraisals, covering approximately one-third of the Municipality's structures. Based on this information, nine Bridge Weight By-laws have been prepared for Council's consideration. Under the new guidelines the Ministry of Transportation no longer needs to approve Bridge Weight By-laws. However, once approved by Council, the Engineers Statement, which is Schedule "A" to each by-law, must be sigued and sealed by two registered professional engineers. 3.2 The two connecting timber bridges on Nichols Road will always be posted with the same weight restriction, with the lowest rating applying to both. 3.3 Where the weight restrictions calculated by the municipality's consultant and those requested by the rail authority differ, the lower rating shall be applied. 4.0 CONCLUSIONS 4.1 To protect the Municipality from liability risk, and permit enforcement of desired weight restrictions, the attached by-laws should be approved by Council and then sigued by two professional engineers. R.S.O. 1990, c. H.8, as amended. WHEREAS Section 123 (2) of the Highway Traffic Act. R.S.O. 1990 c.H.8. as amended provides that a mwticipal corporation or other authority having jurisdiction over a bridge may by by-law limit the gross vehicle weight of any vehicle or any class thereof passing over the bridge; AND WHEREAS the COlmed of the Corporation of the Municipality of Clarington deems it advisable to enact a by-law to limit the gross weight of any class thereof pa8.'Sing over a bridge under the jurisdiction of the Corporation of the Municipality of Qarington; NOW THEREFORE the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. 1HA T in this by-law "gross vehicle weighf' means the total weight in tonnes transmitted to the highway by a vehicle or combination of vehicles and load. 2. No vehicle or combination of any class thereof with a gross vehicle weight in excess of 2 tormes, shall he operated over Bridge 094023, Prospect Street, 0.10 km south of OdeD Street BoWJDaDville, also known as Canadian Pacific Railway, Belleville Subdivision Line, Mileage 164.15. } 3. This by-law shall not become effective until a notice of the limit of gross vehicle weight pennitteq legibly printed. has been posted in a oonspicuous place at each end of the bridge. 4. Every person who contravenes the provisions of the by-law is guilty of an offence and on conviction is liable to a fine as provided in the Highway Traffic Act, R.S.o. 1 990, c.RB, as amended from time to time. 5. That the Engineers' Statement verifying the gross vehicle weight limit, specified in Section 2 of this by-law, is set out in Schedule "A" attached hereto and forms part of this by-law. 6. By-law Number 97-44 is hereby repealed to delete any reference to the subject bridge described in Section 2 of this by-law. BY-LAW read a first and second time this It' day of June 2000. Effective as of the date of approval of this by-law, I agree with the recommended gross vehicle weight limit as set out in By-law No 2000- for a period of twenty-four months. No vehicle or combination of any class thereof shall be operated over Bridge 094025, Jackman Road, 0.50 km east of Durham Regional Road 57, where: a) in the case of a single unit vehicle, the gross vehicle exceeds 15 tonnes; b) in the case of a tractor trailer or tractor semi-trailer combination, the gross vehicle weight exceeds 24 tonnes; c) in the case of a single unit vehicle and more than one trailer combination, the gross vehicle weight exceeds 34 tonnes; 3. This by-law shall not become effective until a notice of the limit of gross vehicle weight permitted, legibly printed, has been posted in a conspicuous place at each end of the bridge. 4. Every person who contravenes the provisions of the by-law is guilty of an offence and on conviction is liable to a fine as provided in the Highway Traffic Act, R.S.o.1990,c.H.8, as amended from time to time. 5. That the Engineers' Statement verifying the gross vehicle weight lirot, specified in Section 2 of this by-law, is set out in Schedule "A" attached hereto and forms part of this by-law. 6. This by-law shall not become effective lliltil a notice of the limit of gross vehicle weight permitted, legibly printed, has been posted in a conspicuous place at each end of the bridge. 4. Every person who contravenes the provisions of the by-law is guilty of an offence and on conviction is liable to a fine as provided in the Highway Traffic Act, R.S.O.1990, c.H.8, as amended from time to time. 5. 'That the Engineers' Statement verifying the gross vehicle weight limit, speciied in Section 2 of this by-law, is set out in Schedule "A" attached hereto and forms part of this by-law. 6. Effective as of the date of approval of this by-law. I agree with the recommended gross vehicle weight limit as set out in By-law No 2000- for a period of twenty-four months. Signature Signature DATED: 1 1 7 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2000- Being a By~law to limit the gross weight of any vehicle or any class thereof passing over a bridge under the jurisdiction of the Corporation of the Municipality of Clarington pursuant to the Highway Traffic Act, R.S.O. 1990, c. B.S, as amended. WHEREAS Section 123 (2) of the Highway Traffic Act, R.S.O. 1990 c.H.8, as amended provides that a municipal corporation or other authority having jurisdiction over a bridge may by by-law limit the gross vehicle weight of any vehicle or any class thereof passing over the bridge; AND WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to enact a by-law to limit the gross weight of any class thereof passing over a bridge under the jurisdiction of the Corporation of the Municipality of Clarington; ~ow THEREFORE the Council of the Corporation of the Municipality ofClarington enacts as follows: 1. TIIAT in this by-law "gross vehicle weight" means the total weight in tonnes transmitted to the highway by a vehicle or combination of vehicles and load. 2. No vehicle or combination of any class thereofwith a gross vehicle weight in exa:ss of 5 tonnes shall be operated over Bridge 099043~ Cedar Park Road, 0.60 kin north of Concession Road 6, former DarHngton Township. 3. This by-law shall not become effective until a notice of the limit of gross vehicle weight permitted, legibly printed, has been posted in a conspicuous place at each end of the bridge. 4. Every person who contravenes the provisions of the by-law is guilty of an offence and on conviction is liable to a fine as provided in the Highway Traffic Act, R.S.O.1990,c.H.8, as amended from time to time. 5. That the Engineers' Statement verifying the gross vehicle weight limit, specified in Section 2 of this by-law, is set out in Schedule "A" attached hereto and forms part of this by-law. 6.
