Rickard, Mayor Councillor Keith Barr Councillor William Clarke Councillor Ann Cowman Councillor Ivan M. Hobbs Councillor Jasper W. Holliday Councillor Maurice Prout Town Clerk, J. M. Smith, Director of Planning Resolution #C-80=1420 Moved by Councillor Barr, seconded by Councillor Claxke Council THAT the Council Minutes of November 3 1980 meeting Minutes be approved as corrected, Resolution #C-80-1377 - Section 353 should read Section 354. Resolution #C-80-1378 - Director of Public Works should read Director of Planning ''CARRIED'' Mrs. Linda Allin requested Council to please reconsider ' the "No Parking" regulation on the north side of Queen Street from Ontario Street to Liberty Street, as previously requested. Mr. Andrew Orr, Ridge Pine Park Limited addressed Council with regard to rezoning application for Wilmot Creek Mobile Home Park. Mr. Orr presented another by-law in place of the one which was included in the agenda. He also mentioned difficulties he experienced in negotiating a development agreement. He undertook to z; deliver a letter within 2 days making certain commitments with regard to initial construction. He wished Council to approve the by-law for presentation to the O.M.B. . ''CARRIED As AMENDED'' Resolution #C-80-1423 Moved by Councillor Holliday, seconded by Councillor Cowman THAT the foregoing resolution be amended to refer the matter to the Regional Works Committee to give further consideration to locate ate a further stop sign on the island regulating traffic from West to east and to report back to this Council. "CARRIED" Resolution #C-80-1425 Moved by Councillor Prout, seconded by Councillor Holliday 7 Star THAT the letter dated November 5 1980 from The Liquor Family Licence Board of Ontario regarding 7 Star Family Restaurant Restaurant application for licence be received for information. "MOTION LOST" Resolution #C-80-1426 Moved by Councillor Holliday, seconded by Councillor Clarke THAT the foregoing letter be referred to Staff for a further report to the new Council. "CARRTID" Resolution #C-80=1427 Moved by Councillor Hobbs, seconded by Councillor Clarke Clarke THAT the letter dated November 1 1980 from the Town of Newcastle Museum Clarke Museum Board requesting board membership be increased Board from five members to possibly eight be referred to the 1A Striking Committee. "CARRIED" Resolution #C-80-1428 Moved by Councillor Cowman, seconded by Councillor Hobbs Baseline THAT the letter received from the Baseline Comnunity Hall Community Board dated November 3 1980 regarding construction of a new Hall Community Hall be forwarded to the Town Manager to be added Board to the file on the Baseline Community Centre and that he submit a report to the first business meeting of the new Council. w "CARRIED" i Council Minutes -4- November 17 1980 �r4 o '` Resolution #C-80=1429 Moved by Councillor Holliday, seconded by Councillor Hobbs City THAT the letter from the Corporation of the City of Stratford of dated November 4 1980 regarding program of involvement in Stratford the development of fusion technology be received for Resolution information. "CARRIED" Resolution #C-80=1430 Moved by Councillor Prout, seconded by Councillor Hobbs Regional THAT the letter dated November 5 1980 from the Regional Council Municipality of Durham regarding Regional Council Appointments Appointments be referred.: to the new Council. "CARRIED" Resolution #C-80-1431 Moved by Councillor Holliday, seconded by Councillor Cowman Recess THAT there be a five-minute recess. lm "CARRIED" r Resolution '#C-80-=1432 Moved by Councillor Holliday, seconded by Councillor Barr Ridge THAT whereas Ridge Pine Park Inc. have provided the Town Pine of Newcastle with an Undertaking in respect of a Development Park Agreement for the Wilmot Creek Mobile Home Park, which the Limited said Undertaking includes the following provisions: ill. We agree to enter into a Development Agreement similar in scope to thatre ared b Staff; p p Y , 2. We agree that under the provisions of Section 86(1) of The Ontario Municipal Board Act, that we will request that the Ontario Municipal Board, in approving the above- mentioned zoning by-law, issue its Order approving the zoning by-law for Ridge Pine. Parli[ Inc. , as of March 1 1981, or on the advice of the Town of Newcastle that they have entered into a Development Agreement with Ridge Pine Park Inc. , whichever comes first; 3. We also agree to pay all reasonable development charges to the Town of Newcastle relating to Wilmot Creek Home Park, which charges will be specified in the said Development Agreement." Council Minutes -5- November 17 1980 AND WHEREAS Council feel that the Undertaking meets the intent of requirements of By-Law 76-58 of the Town of Newcastle: BE IT NOW RESOLVED that the Town of Newcastle hereby approves the requested rezoning for the Wilmot Creek Mobile Home Park and hereby gives first, second and third readings to the said rezoning by-law conditional on the Ridge Pine Park Inc. providing a letter of undertaking of completing approximately $2,000,000 of works or buildings within one year of the approval of the sub-division agreement and on O.M.B. approval, whichever comes last and that a letter of credit in the amount of $500,000 payable to the Town in the event that this commitment is not met, and that this letter be delivered to the Town within three days. His Worship refused to accept the resolution and he declared it as ''Ultra Vires" in accordance with Section 244 of the Municipal Act.
