REPORT NO. : P-177-80 SUBJECT: Hamlet Development Plan - Enniskillen File: 3.3 BACKGROUND: i On January 28, 1980, Council adopted resolution PD-23-80 of the Planning and Development Committee (attachment 1) . Said resolution forwarded the proposed Enniskillen Hamlet Development Plan to Regional Council for comments, accompanied by a request for an Amendment to the Durham Regional Official Plan. At the same time, it provided for the advertising of a Public Meeting once the Region's comments had been re- ceived and staff were in a position to report back to Committee. In February of this year, staff set up public displays of the proposed hamlet plan in the Enniskillen General Store and the Town's Municipal Offices in Hampton. On October 8, 1980, the Town received the Region's comments in respect of the proposed plan and the requested Official Plan amendment (attachment 2) . In effect, the Region indicated that they had no objection to the proposed development plan, subject to certain modifications specified - 2 - within the Regional Planning staff report (see attachment 2) ; and that, the requested Official Plan Amendment had been approved and would be forwarded to the Minister of Housing for approval. COMMENTS: Staff have reviewed the requested modifications and have incorporated the changes within the text of the Hamlet Development Plan, included as Attachment 3 to this report. Staff have also advertised a public notice of this meeting, inviting public participation, pursuant to Council's direction of January 28, 1980. The proposed Hamlet Development Plan for Enniskillen may now be formally adopted by the Town of Newcastle, conditional upon Ministerial approval of Amendment No. 41 to the Durham Regional Official Plan. As with other hamlets, previously approved by the Town, an amendment is also required to the Darlington Official Plan in order to identify Enniskillen as a hamlet for which a Development Plan has been prepared, pursuant to Section 10.4.2.1 of the Durham Plan. A draft amendment is included as Attachment 4. RECOMMENDATION: That the Planning and Development Committee recommend to Council the following: 1. That report P-177-80 be received; and that 2. The Hamlet Development Plan for Enniskillen, included as Attachment I to report P-177-80 be adopted; and that 3. Planning staff prepare the necessary amendment to By-law 2111, in order to bring it into conformity with the approved Hamlet Development Plan for Enniskillen; and that r" 3 - 4. The Region of Durham be forwarded a copy of staff report P-177-80, and requested to initiate the required amend- ment to the Darlington Official Plan, as contained in Attachment 4 to said report; and that 5. REPORT 1 . Background Section 10.4.2.2 of the Durham Regional Official Plan requires that an area municipality consult with Regional Council prior to the adoption of a development plan for a hamlet. The Hamlet Development Plan for Enniskillen has been forwarded to Regional Council for comment in response to the following resolutions of the Council of the Town of Newcastle adopted at its meeting of January 28, 1980. 7 b J.U N �ommi ss i oner' s Report No. 80-215 Page 2 "1) That report P-8-80 be received; and that 2) Staff forward the revised Hamlet Development Plan for Enniskillen to the Region of Durham in accordance with Section 10.4.2.2 of the Durham Regional Official Plan; and that 3) The Region of Durham be requested to initiate an Official Plan Amendment to redesignate Enniskillen as a hamlet for growth and 'to delete the word convenience from Section 10.4.1.1 in order to permit limited comercial development within hamlets; and that 4) Staff report back to the Planning Committee at its next appropriate regular evening meeting, which shall be duly advertised in a local paper inviting public participation from residents of Enniskillen, and that the proposed development plan be put on public display with Town Planning staff to forward the plan to Regional Council for comments prior to the public meeting, as per recommendation #2." 2. Location The Hamlet of Enniskillen is located in part of Lots 19 and 20, Concession VII and VIII , in the former Township of Darlington, now within the Town of Newcastle. It is located at the intersection of Old Scugog Road and Regional Road 3. 3. Public Meeting The Town of Newcastle Planning and Development Committee held a public meeting on July 27, 1973 in the Enniskillen Public School for the purpose of obtaining public input to the Plan for the Hamlet of Enniskillen. 4. Submissions a) The Town of Newcastle received a submission from Mr. Stuart Lamb, owner of land adjacent to the Hamlet of Enniskillen which was considered during the preparation of the Hamlet Development Plan. b) To date, no submissions from the public have been received by the Regional Planning Department. 5. Comments from Circulation Agencies a) Staff of the Town of Newcastle forwarded the Enniskillen Development Plan to the following agencies for comment: Town of Newcastle Public Works, Town of Newcastle Community Services , Region of Durham Planning and Works Departments , Region of' Durham Health Unit, Central Lake Ontario Conservation Authority, Northumberland and Newcastle Board of Education, Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board, Ministry of Natural Resources , Ministry of Agriculture and Food and the Ministry of the Environment. Staff of the Town of Newcastle incorporated revisions 8 . 631 Commissioner' s Report No. 80-215 Page 3 Z, in the Hamlet Development Plan to resolve the concerns indicated by the above agencies prior to the Development Plan being forwarded to the Region. b) Staff of the Regional Works Department reviewed the Development Plan and suggests that Section 4.3 be revised to more accurately reflect Section 10.4.2.6 of the Durham Regional Official Plan. Staff Comments " Staff has reviewed the Development Plan and have the following comments on the requested Durham Regional Official Plan Amendment. a) The Development Plan, which proposed a Hamlet of approximately 180 residential units, is not in conformity with the Durham Regional Official Plan which presently designates Enniskillen as a hamlet for minor internal infilling and/or minor additions to existing development. The Council of the Town of Newcastle has requested that the Durham Regional Official Plan be amended to include Enniskillen as a hamlet for growth. This request has been reviewed in light of the requirements of Section 10.4.2.5 of the Durham Regional Official Plan, the background information received and the comments received from circulation. The hamlet appears to have facilities sufficient to service a larger population; according to the Hamlet Servicing Study, the soils are suitable for the installation of septic tanks; there appears to be an adequate water supply and the Regional Health Unit has no objection to the to the proposed amount of growth. Staff is prepared to recommend that the Hamlet of Enniskillen be designated a growth hamlet to permit more than 150 residential units but not more than 200 residential units. In order to clarify the intent of Section 10.4.1 .2 which lists the hamlets for growth, staff is recommending an editorial revision to that Section as detailed in the attached Appendix I. b) Section 3.4 of the Development Plan permits a wider range of commercial uses than those permitted in Section 10.4.1.1 of the Durham Regional Official Plan. The Town of Newcastle has requested that Section 10.4.1.1 be amended to permit limited commercial rather than limited convenience commercial ' in hamlets. Staff has reviewed existing commercial uses found in other hamlets and is of the opinion that the term "convenience" restricts commercial development to a variety store whereas "limited commercial " would reflect more accurately the type of commercial establishments which locate in hamlets, i .e. antique stores. c) Section 4.2 of the Hamlet Plan refers to a municipal water system which would be capable of serving the entire hamlet. This is contrary to Section 10.4.1.5 of the, Durham Regional Official Plan which states that development within hamlets shall be serviced with a private drilled well and a private waste disposal system. However, Section 10.4.2.8 of the Durham Regional Official Plan identifies a subdivision, 18T-24002, located in Enniskillen which received draft approval prior to 1974. This draft approval included provisions for a private water system. Staff has examined the issue of permitting municipal water systems in hamlets and due to the circumstances in the Hamlet of Enniskillen and the problems inherent in permitting small municipal water systems it is suggested that the municipal water system for Enniskillen be permitted as an exception to the rule and that Section 10.4.1.5 of the Durham Regional Official Plan be amended accordingly. I 532 Commissioner' s Report No. 80-215 Page 4 d) Once the proposed Amendment to the Durham Regional Official Plan has been approved by the Minister of Housing, the Council of the Town of Newcastle can adopt the Development Plan for the Hamlet of Enniskillen and request that the Official Plan for the former Planning Area of the Township of Darlington be amended accordingly. The proposed Amendment to the Durham Regional Official Plan is attached to this report as Appendix I . In addition to the comments on the proposed Official Plan Amendment , staff has specific comments regarding the Policies in the Enniskillen Development Plan: a) It is suggested that Section 4.3 be revised to more accurately reflect Section 10.4.2.6 of the Durham Regional Official Plan in accordance with the comments received from the Regional Works Department. b) In the attached Correspondence #281, Mrs. Gray, Deputy Clerk, Town of Newcastle, has forwarded staging policies for the hamlets of Enniskillen , Ne wtonville and Tyrone. The staging policies for Enniskillen have been prepared as an amendment to the Hamlet Development Plan. Staff has reviewed these staging policies and is of the opinion that a new Section 3.9 of the Development Plan should be added as requested by the Town. This necessitates a revision to Sections 3.2.1 (ii) and (iii) which refers to the proposed staging amendment. Schedule I also requires modification to indicate the sequence of development. The suggested modifications to the Development Plan are attached to this report as Appendix II. This report has been discussed with staff of the Town Newcastle and they concur with the contents and format of the proposed amendment. VC/LK Attachments: Appendices I and II i 10 633 APPENDIX I TO COMMISSIONER 'S REPORT NO. 215 Amendment No. 41 to the Durham Regional Official Plan Purpose: The purpose of this Amendment to the Durham Regional Official Plan is to permit limited comercial uses in hamlets to provide for residential development in the Hamlet of Enniskillen, Town of Newcastle to exceed 150 residential units , and to permit a municipal water system to service the Hamlet. V Basis; The Council of the Town of Newcastle has prepared a Development Plan for the Hamlet of Enniskillen. This amendment reflects that Development Plan. Actual Amendment: The Durham Regional Official Plan is hereby amended: a) by replacing the words "limited convenience commercial " in line 5 with "limited commercial " and deleting the words "Hamlet and its" after the word "the" underlined as indicated in the following Section 10.4.1.1. "10.4.1.1 Map 'A' shows the general location of hamlets. The predominant land use in Hamlets shall be for residential development. Home occupation uses, parks, community uses such as schools, places of worship and fraternal organizations , limited commercial and industrial uses , and farm implement dealerships primarily intended to serve the immediate surrounding agricultural community, may also be allowed, subject to the inclusion of appropriate requirements in the respective zoning by-law." b) by replacing Section 10.4.1 .2 with the following new Section. "10.4.1.2 Subject to the provisions of Section 10.4.2.1, additional residential development may be permitted in the following Hamlets for growth if deemed desirable by the Council of the respective area municipality: the Hamlets of Burketon Station and Enniskillen in the Town of Newcastle; Columbus in the City of Oshawa; Greenbank, Manchester, Nestleton, and Nestleton 'Station, and Seagrave in the Township of Scugog; Leaskdale, Sandford, Udora, and Zephyr in the Township of Uxbridge; and Ashburn and Myrtle Station in .the Town of Whitby. Generally these Hamlets shall not grow beyond a total of 150 residential units with the exception of the Hamlets of Enniskillen in the Town of Newcastle and Columbus in the City of Oshawa which shall not grow beyond a total of 200 residential units. 1j I I Y'41 c) by adding the words "With the exception of the Hamlet of Enniskillen, Town of Newcastle, which may have a municipal water system," to the beginning of Section 10.4. 1. 5 as follows: "10.4.1.5 With the exception of the Hamlet of Enniskillen, Town of Newcastle, which may have a municipal water s stem, development within Hamlets shall be serviced with a private drilled well , a private waste disposal system which complies with the standards of the Ministry of the Environment as amended from time to time and as administered by the Medical Officer of Health or otherwise." Page 10, Section 3.2.1 (ii ) Delete in its entirety and replace with the following Section: "(ii ) The staging of new residential lots to be developed within the area proptsed for "expansion" is contained in Section 3.9. Schedule 'A' indicates the maximum number of residential lots allowed within the designated areas and the sequence for staging development." 2. Page 10, Section 3.2.1 (iii ) Delete in its entirety and replace with the following Section: "(iii ) The staging of new residential lots to be developed within the area proposed for "rural residential " is contained in Section 3.9. Schedule '1' indicates the maximum number of lots allowed within the designated area." 3. Page 15 Add the following new Section 3.9 Staging: "3.9 Staging New development within the areas designated for expansion, shall be staged in order to control the hamlet's rate of growth. This is intended to minimize development impacts upon existing supplies and the operation of septic tanks and tile beds. 3.9.1 Policies (i ) New development within the areas designated for expansion shall .be to 15 lots per annum. Determination of the annual limit was based upon an evaluation of existing development, proposed development historic growth rates , servicing limitations and other development restrictions within the hamlet. (ii ) Schedule 1 identifies alphabetically the areas designated for expansion and this shall represent the sequence for staging development and shall proceed in accordance with the extension of the municipal water system. ( iii) The Council of the Town of Newcastle may recommend draft approval of one or more plans of subdivision within a designated area as identified in (ii) above. However, any lots approved in excess of the annual limit shall be given a deferred designation in the implementing restricted area by-law. Development of a designated area for expansion shall be substantially completed prior to the Town considering further draft approvals within subsequent areas. ` bJ �i a V ( i v) The annual limit of lots to be permitted within the hamlet, shall be allocated to subdividers, within a designated area for expansion, in proportion to the number of approved lots within their subdivisions . (v) The Town of Newcastle shall undertake an annual monitoring of building activity; in conjunction with Regional monitoring of groundwater supplies and quality within the hamlet, and may adjust staging accordingly. If building permits have not been applied for and/or granted for appropriately zoned lots, then the number of lots potentially released in successive years shall equal the annual limit less any residual, from the previous year. In those instances where the annual limit has been divided among a number of subdividers, failure to make use of an allocation by a subdivider shall not limit the allocations of other subdividers in subsequent years and shall only affect subsequent allocations to the subdivider which has a residual . (vi ) The policies of this section shall not be interpreted as being applicable to areas designated for infilling. (vii ) In the case of the areas designated as rural residential , staging will only be required for proposals in excess of three lots, and shall be implemented through the provisions of a subdivision agreement. 4. OF -.f MUNICIPALITY CHAIRMAN CLERK I I I ' 7 Amendment No. 41 to the Durham Regional Official Plan Purpose_ The purpose of this Amendment to the Durham Regional Official Plan is to permit limited comercial uses in hamlets to provide for residential development in the Hamlet of Enniskillen, Town of Newcastle to exceed 150 residential units, and to permit a municipal water system to service the Hamlet. Basis; The Council of the Town of Newcastle has prepared a Development Plan for the Hamlet of Enniskillen. This amendment reflects that Development Plan. Actual Amendment: The Durham Regional Official Plan is hereby amended: a) by replacing the words "limited convenience commercial " in line 5 with "limited commercial " and deleting the words "Hamlet and its" after the word "the" underlined as indicated in the following Section 10.4.1.1. "10.4.1.1 Map 'A' shows the general location of hamlets . The predominant land use in Hamlets shall be for residential development. Horne occupation uses, parks, community uses such as schools, places of worship and fraternal organizations , limited commercial and industrial uses, and farm implement dealerships primarily intended to serve the immediate surrounding agricultural community, may also be allowed, subject to the inclusion of appropriate requirements in the respective zoning by-law." b) by replacing Section 10.4. 1 .2 with the following new Section. "10.4.1 .2 Subject to the provisions of Section 10.4.2.1, additional residential development may be permitted in the following Hamlets for growth if deemed desirable by the Council of the respective area municipality: the Hamlets of Burketon Station and Enniskillen in the Town of Newcastle; Columbus in the City of Oshawa; Greenbank, Manchester, Nestleton, and Nestleton Station, and Seagrave in the Township of Scugog; Leaskdale, Sandford, Udora , and Zephyr in the Township of Uxbridge; and Ashburn and Myrtle Station in the Town of Whitby.
