SUBJECT: A~END~ENT TO RESPONSmLE PET OWNERS BV-LAW
Recommendations:
It is respectfully recommended to Council, the following;
1. THAT Report CD-47-00 be received; and
2. THAT the Responsible Pet Owners By-law be amended by creating a fee requirement for
kennels.
BACKGROUND:
On June 28, 1999 Council passed By-law 99-90, the Responsible Pet Owner's By-law. Among other things the
by-law established fees for dog and cat adoption, licences, surrender and impound fees. Section 8 of the By-law
deals with Kennels and prohibits a person from owning or operating a kennel unless they have obtained a
licence and paid the prescribed fees. At that time the fees schedule was not added to the by-law.
Staff are therefore proposing to amend the By-law by adding Schedule "E" Kennel Fees. Since the fee per dog
is set at $30.00 and a kennel will by definition have at least four dogs, staff believe $90.00 would be a fair and
reasonable price. Breeding kennels, because of the fact that they are an actual business operation will be
required to pay $100.00.

While the fees may appear steep, the by-law sets out specific requirements for the condition of the kennel prior
to licencing and would therefore require at least one site inspection to ensure compliance. The granting of a
municipal licence indicates that the Municipality has approved of the licence holder's operation, Without
inspections, there can be no guarantee that any of the licence requirements are being met. Section 257.1 of the
Municipal Act allows for a Municipality to recover part of the cost of enforcing its by-laws through the actual
licence fee charged.

BY-LAW
being a by-law to amend By-law 99-90 and establish
Kennel Licence fees
WHEREAS the Municipal Act, R.S.O. 1990, chap. M.45 authorizes a municipality to pass
by-laws to prohibit, regulate and licence certain businesses, trades and callings within the
Municipality;
AND WHEREAS The Corporation of the Municipality of Clarington deems it desirable to
amend By-law 99-90 to include licence fees for Kennels;
NOW THEREFORE the Council of the Corporation of the Municipality of Clarington hereby
enacts as follows:
1. Section 1.5 is hereby amended by inserting the following immediately after
Schedule "D"-List of Locations Where Dog/Cat Licences Can Be Purchased
Schedule "E" - Kennel Licence Fees
2. By-law 99-90 is further amended by adding thereto the following;
