Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-084-00 be received;
2. THAT Council concur with the decisions of the Committee of Adjustment made on July
13, August 3 and August 24, 2000 for applications A99/024, A2000/024 to A2000/035
inclusive, A2000/037 and A2000/038; and
3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the
decisions of the Committee of Adjustment for applications A99/024, A2000/024 to
A2000/035, inclusive, A2000/037 and A2000/038, in the event of an appeal.
1. In accordance with Section 45 of the Planning Act RS.O. 1990, all applications received
by the Municipality for minor variance are scheduled to be heard within 30 days of being
received by the Secretary Treasurer. The decisions ofthe Committee are detailed below.
2. The purpose of these minor variance applications and the Committee's decisions are
detailed in Attachment No.1.
3. JULY 13,2000 COMMITTEE OF ADJUSTMENT MEETING
3.1 Application A2000/024 was amended by the applicant to include additional items noted

by staff during a site inspection. Only the application as originally filed was heard at this
meeting. APPROVAL was given to reduce the exterior side yard setback to 1.2 metres
for a swimming pool and to reduce the rear yard setback of the existing deck to 3.4
metres.
The amended portion of the application, to reduce the interior side yard setback of the
existing steps and landing was TABLED to the next Committee meeting, August 3, 2000.
This is to allow the applicant and staff to meet the sign and circulation requirements of
the Planning Act for the additional variance.
3.2 Application A20001025 received APPROVAL for the increase in the total footprint of all
accessory buildings and structures to 50.5% (600 fr2). The portion of the application
requesting an increase in height to 5.5 metres, was DENIED.
3.3 Application A20001026 was APPROVED for an increase in the total footprint of all
accessory buildings to 70% (980 ft2) and for an increase in height to 5.34 metres.
3.4 Application A20001027 was APPROVED as applied for.
3.5 Application A20001028 was APPROVED by the Committee. Although the approval was
not consistent with staffs recommendations, it is staffs opinion that it would not be
prudent for the Municipality to appeal the application. The applicant or any interested
party has the opportunity to file an appeal to the Ontario Municipal Board if they so wish.
The Committee of Adjustment has not always concurred with staffs recommendation. It
has not been Council's practice to appeal these decisions leaving that option with the
applicant or an interested party.

4. AUGIST 3, 2000 COMMITTEE OF ADJUSTMENT MEETING
4.1 Previously at the July 13, 2000 meeting the amended portion of Application A2000/024
to reduce the interior side yard setback of the existing steps and landing was TABLED to
allow the applicant and staff to meet the sign and circulation requirements of the Planning
Act for the additional variance.
At the August 3, 2000 Committee meeting the reduction in interior side yard setback for
the existing steps and landing was APPROVED.
4.2 Application A2000/029 was TABLED to allow the applicant time for further discussion
with municipal staff regarding the pool fence sight triangle.
4.3 Application A2000/030 was TABLED for a period of 12 months, to allow time for the
ownership of the Church Street and John Street road allowances to be resolved.
4.4 Applications A2000/031, A2000/032, A2000/033 and A2000/034 were APPROVED as
applied for.
4.5 Application A2000/035 was TABLED as the applicant did not show at the meeting to
answer Committee's and the public's questions.
5. AUGUST 24, 2000 COMMITTEE OF ADJUSTMENT MEETING
5.1 Applications A99/24 had been previously TABLED on June 24, 1999 for a nine-month
period and on March 30, 2000 for a six-month period. Discussion with the applicant
indicated that the revised site plan would comply with the zoning by-law and thus the
application is no longer required. This application was DISMISSED without prejudice.
5.2 Applications A2000/035, A2000/037 and A2000/038 were APPROVED as applied for.

6. Staff reviewed the Committee's decisions and are satisfied that the applications which
received approval, with the exception of the application noted in paragraph 3.5, are in
conformity with the Official Plan policies, consistent with the intent ofthe Zoning By-
law and those approved are minor in nature and desirable. Council's concurrence with
the Committee of Adjustment decisions is required in order to afford staff's official status
before the Ontario Municipal Board in the event of an appeal of any decision of the
Committee of Adjustment.
7. As noted in Section 3.5 above, staff do not recommend the appeal of Application
A20001028, submitted by Rick and Heidi Traynor.
