THAT Report PD-067-00 be received; 2. THAT the application to amend Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, submitted by D.G. Biddle & Associates Limited on behalf of 1319164 Ontario Limited be APPROVED; 3. THAT the amending By-law attached to Report PD-067-00 be forwarded to Council for approval; 4. THAT a copy of Report PD-067..00 and the amending By-law be forwarded to the Durham Region Planning Department; and, 5. THAT all interested parties listed in this report and any delegation be advised of Council's decision. 1. APPLICANT 1.1 Applicant: 1.2 Agent: 1.3 Rezoning: 1.4 Site Area: 1319164 Ontario Limited D.G. Biddle & Associates Limited From "Holding - Urban Residential (H(R1)) Zone" to "Urban Residential Exception (R2-15)", to permit six (6) single detached dwelling units. 1704 m2 (0.42 ac) 641 " ~ REPORT PD-067-00 PAGE 2 2. LOCATION 2.1 The subject lands are located at the rear of 483 King Street East in Newcastle (See Attachment #1). The property is contained within Part Lot 26, Concession 1, in the former Village of Newcastle. 3. BACKGROUND 3.1 On February 25, 2000, the agent submitted a rezoning application to the Municipality of Clarington to rezone the rear portion of 483 King Street East to permit the development of six residential lots. 3.2 This subject parcel is abutted on the east, west and south sides by Draft Approval Plan of Subdivision 18T-88061. The draft approved plan creates a parcel described as Block 253 which was designated to meld with the subject lot to allow the development of six residential lots. 4. SITE CHARACTERISTICS AND SURROUNDING USES 4.1 The northerly portion of the property contains a single detached dwelling unit that has frontage and access to King Street East. 4.2 Surrounding Uses: East: Residential (Draft Approved 18T-88061) North: Residential West: Residential (Draft Approved 18T-88061) South: Residential (Draft Approved 18T-88061) 5. OFFICIAL PLAN POLICES 5.1 The lands are designated "Living Area" within the Durham Region Official Plan. The goal of the Living Area designation is to provide a full range of housing. 5.2 Within Clarington Official Plan, the subject lands are designated "Urban Residential". 6. ZONING BY-LAW CONFORMITY 6.1. The subject lands are currently zoned "Holding - Urban Residential (H(Rl)) Zone", which permits single detached dwelling units with a minimum 15 metres of frontage. 642 REPORT PD-067-00 PAGE 3 The block (Block 253 of Draft Approved l8T-8806l) to which this land will be melded is currently zoned "Urban Residential Exception (R2-l5)" which would permit single detached dwellings with a minimum 12 metres of frontage. As a result, a rezoning application was submitted for consideration. 7. PUBLIC NOTICE AND SUBMISSION 7.1 Public notice was given by mail to each landowner within 120 metres of the subject site and a public meeting notice sign was installed on the lands. 7.2 As ofthe writing ofthis report, no inquiries have been received on this application. 8. AGENCY COMMENTS 8.1 The Clarington Fire Department, Veridian Connections, Ganaraska Region Conservation Authority, Peterborough, Victoria, Northumberland and Clarington Catholic District School Board and the Kawartha Pine Ridge District School Board have no objections to the proposal. 8.2 The Clarington Public Works Department has no objections. The following requirements will be required at the Land Division stage: . All utilities such as hydro, telephone, and cable television must be installed underground; . All engineering and other works must conform to the approved engineering drawings for adjacent plan of subdivision l8T-8806l; . The Applicant/Owner must provide this department with a Lot Grading Plan satisfactory to the Director of Public Works; . The applicant will be required to make application for property access in conjunction with this proposal. The applicant is responsible for any costs necessary to facilitate the construction of an entrance from the subject property to William Jose Court. The cost of providing a connecting access may include utility relocation, entrance paving, restoration etc.; . The applicant must provide a total of six street trees, which form a portion of the connecting boulevard. All planted trees must conform to Municipal standards. . All works and services must be designated and constructed in accordance with the Municipality of Clarington Design Criteria and Standard Drawings, provisions of the Municipality Development By-law and all applicable legislation and to the satisfaction of the Director of Public Works; . The applicant must provide appropriate cash contribution in lieu of the normal parkland dedication. 64.5 REPORT PD-067-00 PAGE 4 9. COMMENTS 9.1 The subject parcel will be developed in conjunction with Block 253 of Draft Approved Plan of Subdivision l8T-88061. This subdivision received draft approval on August 10, 1992 and has subsequently been amended five times, receiving approval of the fifth amendment on December 22, 1999. 9.2 The first phase of this subdivision (40M-1976) located southeast of this subject parcel is currently under construction. 9.3 Staff recommend that a Holding symbol not be placed on the property as the Land Division process will ensure that all conditions required by the various agencies and departments are met through the Land Division process. The Holding symbol, on the land to be melded with the subject parcel, has had the Holding symbol removed by By- law. 10. CONCLUSIONS 10.1 Based on the comments contained in this report, it is respectfully recommended that the rezoning application be APPROVED. WHEREAS the Council of the Corporation of the Municipality ofClarington deems it advisable to amend By-law 84-63, as amended, of the Corporation of the former To\VIl of Newcastle to implement ZBA 2000-006; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality ofClarington enacts as follows: 1, Schedule "5" to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Holding - Urban Residential Type One (H(Rl))" to "Urban Residential Exception (R2- 15)" Zone as illustrated on the attached Schednle "A" hereto, 2, Schedule "A" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act. BY-LAW read a frrsttime this day of 2000.
