Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-056-00 be received;
2. THAT the request submitted by Larry Yanch on behalf of Wayne Jeffery Limited for
removal of the Holding (H) Symbol from the subject lands being Parts 1,2,3,4,5,6,7,
& 8, Plan 40R-19437, be APPROVED and that the amending By-law attached hereto be
forwarded to Council for approval;
3. THAT a copy of this Report be forwarded to the Region of Durham Plarming
Department; and
4. THAT all interested parties listed in this Report and any delegation be advised of
Council's decision.
1. BACKGROUND
1.1 The subject lands for which the removal of Holding (H) symbol application was made are
located in Part Lot 29, Concession 2, Former Township of Darlington. The subject lands
will be consolidated with the abutting lands to the north having access from Stagemaster
Crescent. The removal of the Holding (H) symbol will facilitate the issuance of building

permits on the subject lands. Once the subject lands have been melded with the front
portions in the abutting subdivision to the north, eight (8) semi-detached or link dwellings
are to be built.
1.2 The existing subdivision agreement between 290572 Ontario Limited and the
Municipality of Clarington is applicable for all phases of development. Among other
things, this agreement ensures adequate grading, drainage and performance guarantees,
are provided.
1.3 A by-law amendment to remove the "Holding (H)" symbol is not subject to the normal
appeal period afforded to a standard rezoning application and accordingly shall be
deemed final and bindings should Council grant approval of same.
2. COMMENTS
2.1 The Holding (H) symbol may be removed upon Council being satisfied that the uses to be
permitted will be for purposes intended by the By-law. In reviewing the proposal, Staff
is satisfied that the conditions required for the removal of holding have been met. The
removal of the Holding (H) symbol is recommended as illustrated in the attached By-law
(see Attachment #3).

BY-LAW NUMBER 2000-_
being a By-law to amend By-law 84-63, the Comprehensive Zoning
By-law for the COIporation of the fonner Town of Newcastle,
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to
amend By-law 84-63, as amended, of the Corporation of the fonner Town of Ne,wcastle to
implement ZBA 2000-15,
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality
of Clarington enacts as follows:
1, Schednle "4" to By-law 84-63 as amended, is hereby further amended by changing the zone
category from:
"Holding - Urban Residential Type One ((H)Rl)" to "Urban Residential Type One"
Zone, as illustrated on the attached Schedule "A" hereto,
2, Schedule "A" attached hereto shall fonn part of this By-law,
3, This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 34 and 36 of the Planning Act
