Recommendations:
It is respectfully recommended to Council the following:
1. THAT Report Addendum to PD-114-00 be received for information;
2. THAT Council provide a pre-budget authorization for the funds estimated at $15,000.00
for a planning consultant to appear at the Ontario Municipal Board to provide expert
testimony in support of Council's position.
1. At the General Purpose and Administration Committee meeting on Monday, January 8,
2001, Committee adopted a resolution to authorize the Solicitor to attend the upcoming
OMB hearing with respect to the application by Mr. Joe Domitrovic. In addition, the
Solicitor was instructed to call an outside planning consultant to be an expert wituess in
support of Council's position.
2. The motion at Committee did not deal with the funding required for legal costs and a
planning consultant. Total legal and planning consulting costs for the hearing are
estimated at between $20,000.00 to $30,000.00. The Planning Department budget
annually incorporates funds for legal costs in anticipation of OMB hearings and other
legal work. There is no similar provision for hiring a planning consultant.

Because this situation differs from the Municipality's normal business process and after
consulting with the Treasurer, it has been determined that a pre-budget authorization
should be granted for the additional funds to be incorporated in the 2001 Planning
Department budget.
