Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PD-l13-00 be received;
2. THAT Report PD-I13-00 be adopted as the Municipality's comments with respect to the
regionally initiated official plan amendment regarding the allocation of servicing
capacity; and
3. THAT the Region of Durham Planning Department be forwarded a copy of this report
and be advised of Council's decision.
1. BACKGROUND
1.1 On September 8, 2000, the Municipal Clerks Department received notice of a new
application to amend the Durham Regional Official Plan (File: OP A 2000-007, Our File:
ROPA 2000-007). Regional Council had previously authorized the initiation of this
proposed official plan amendment.
1.2 The Region of Durham held a public meeting on October 10, 2000 to discuss the staff
report on this proposed amendment. No delegations were received with respect to the
application, however, support for the application was received from the Town of Whitby
and the Town of Ajax, a request for clarification was received from the Township of
Uxbridge and the Township of Scugog provided comments. Committee recommended
that the report be received for information and that all submissions received be referred to
the Regional Planning Department for their consideration.

2. THE AMENDMENT
2.1 The Region is proposing to amend Sections 5.3.21 and 8.3.8 of the Durham Regional
Official Plan (see Attachment 1). These policies address the allocation and reassignment
of servicing capacity in Durham Region's smaller urban areas, including Orono. These
two policies provide for the allocation of servicing capacity at the time of draft plan
approval, and allow for the reassignment of servicing allocation from one development
proposal to another, if a development did not proceed within 3 years of draft approval.
This option is not available in the other urban areas such as Bowmanville, Newcastle or
Courtice. In these urban areas, the current Regional Official Plan policies require an
applicant to enter into a servicing agreement with the Region prior to registration of a
plan of subdivision.
2.2 The proposed modification to the Official Plan will help clarify the process of allocation
and reassignment of servicing capacity in Durham's smaller urban areas, including Orono,
ensuring that the Official Plan policies reflect the Region's procedure for the allocation of
servicing capacity.
3. STAFF COMMENTS
3.1 Orono is the only smaller urban area in which this proposed amendment is applicable
within Clarington. The Clarington Official Plan identifies population targets for Orono
and recognizes that growth will be limited until such time as servicing alternatives are
considered. Specifically, Table 5-1 in the Clarington Official Plan identifies Orono as
having a population target of 2000 people. With respect to servicing, Section 17.3.1 of
the Clarington Official Plan requires a study to identifY the feasibility of extending lake-
based sanitary sewer and water supply services to Orono to allow for possible future
urban expansion.
3.2 There has been no subdivision development activity in Orono since 1986. Furthermore,
until the urban area boundary of Orono is expanded, development in Orono is
predominantly limited to infilling.

3.3 The proposed amendment only removes the ability to reassign servicing capacity within
the smaller urban areas, leaving the remainder of Section 5.3.21 intact. If this amendment
is approved in its current form, then Section 5.3.21 will allow the Region to withdraw
draft approval of any plan of subdivision proposed in Beaverton, Cannington,
Sunderland, Uxbridge, Port Perry and Orono if the plan of subdivision is not registered
within three years of draft approval.
4. CONCLUSION
4.1 The Municipality of Clarington does not have any concerns with the proposed
amendment as it will not impact development in Orono. The proposed amendment will
not require a revision to be made to Clarington's existing Official Plan Policies or for a
new policy to be added to the Official Plan.

Proposed Amendment to the Durham Regional Official Plan
Purpose:
The purpose of this amendment is to modify the Durham
Regional Official Plan to clarify the process of allocation and
reassignment of seNicing capacity in the Region's smaller
urban areas (Beaverton, Cannington, Sunderland, Uxbridge,
Port Perry and Orono).
Basis:
Policies 5.3.21 and 8.3.8 of the Durham Regional Official Plan,
when read together, provide that seNicing capacity is allocated
to a development proposal at the time of draft plan approval,
and that the seNicing allocations may be reassigned from one
development proposal to another, if development does not
proceed on a timely basis.
The policies prevent the granting of draft plan approval of a plan
of subdivision in circumstances where capacity is not
immediately available (due to the timing of implementation of
improvements/expansions), even though the needed capacity is
within the design capacity of the overall system. This is not
consistent with the Regional Development Control Program.
The Regional Development Control Program provides that a
firm commitment by the Region to reseNe seNicing capacities
will only be made upon the signing of a development agreement
with the Region. In effect, seNicing capacity is allocated on a
"first come, first seNed" basis, based on executed development
agreements and payment of securities. This approach lends
itself to the efficient utilization of the Region's existing
infrastructure and plant capacities, and avoids premature
improvements/expansions.
An amendment is required to ensure the policies reflect the
Region's procedure for the allocation of seNicing capacity.

Actual
Amendment:
The Durham Regional Official Plan is hereby amended by:
a) deleting from Section 5.3.21 the words "and reassign its
servicing capacity to other areas within the
respective urban are;i' so that Section 5.3.21 reads as
follows:
"5.3.21 In the urban areas of Beaverton, Cannington,
Sunderland, Uxbridge, Port Perry and Orono,
Regional Council may, notwithstanding any other
provisions in this Plan to the contrary, withdraw the
draft approval of a plan of subdivision and roaE:sign its

urban aroa in the event that the plan of subdivision is
not registered within three years of draft approval.";
and
b) deleting from Section 8.3.8 , clause a) of the third
paragraph, being "a) reallocation of existing capacity
as described in Section 5.3.21;" and renumbering the
remaining subsections, so that Section 8.3.8 reads as
follows:
"8.3.8 Notwithstanding Section 8.2.3, Map 'A' designates
areas within urban areas to be developed on . . .
Prior to any development on partial or full private
services, Regional Council shall investigate the
feasibility of providing full municipal services through:
a) roallocaticm of oxisting oapacity as doscribod in
Soction 5.3.21;
a) Bf additional capacity resulting from water supply
or sanitary sewage plant expansions; or
b) Gt servicing alternatives such as communal
systems."
