Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-028-01 be received;
2. THAT the application for minor variance to the Municipality of Clarington Sign By-
law 97-157, as amended, submitted by Paul Burton on behalf of Afterconxtion
Electrical Services Inc. to increase the sign area of an identification sign for a
residential use from 0.55 m2 to 2.98 m2 is not minor in nature and be DENIED;
and,
3. THAT the all other parties listed here to be forwarded a copy of this report and
any delegations be advised of Council's decision.

1.0 LEGISLATION
1.1 Section 207 of the Municipal Act, Subsection 146 allows Council to authorize
minor variances to the Sign By-law, if in the opinion of Council, the general intent
and purpose of the by-law is maintained.
2.0 BACKGROUND AND PROPOSED AMENDMENT
2.1 On August 29, 2001, the Municipality received an application to amend Sign By-
law 97-157 from Paul Burton on behalf of Afterconxtion Electrical Services Inc.
The proposed amendment is to permit a 2.98 m2 identification sign instead of the
permitted size of 0.55 m2 . which represents a 441.8% increase in sign area. The
proposed sign would be the size of a sheet of plywood (approximately 4 ft X 8 ft).
2.2 The applicant's property fronts on Doreen Crescent and backs onto Durham
Regional Road 57. The applicant's rear yard slopes upwards toward the Regional
roadway. The sign would be erected near the rear property line on the applicant's
lands.
2.3 As Durham Regional Road 57 is under regional jurisdiction, the Durham Regional
Public Works Department was circulated on the application. They have no
objections to the proposed sign amendment, provided that the sign is located
entirely on private property.
2.4 The Sign By-law permits an identification sign in the form of a ground sign or wall
sign with a maximum size of 0.55 m2, or 5.9 ft2. At the Director of Planning
Services discretion, he/she has the authority to make minor exceptions without
amendment to this By-law for sign area, not exceeding 10%. A 10% increase
would permit a sign area of 0.61 m2, significantly lower than the 2.98 m2 sign
area as requested.
2.5 The applicant is operating a business from the residence. Although the by-law
permits 0.55 m2 of signage on the Doreen Crescent frontage, the applicant has

indicated that this is insufficient for advertising purposes. As the property also
back onto Durham Regional Road 57, the applicant wishes to use this opportunity
for business advertising purposes. As the permitted sign area of 0.55 m2 is
insufficient, the applicant has requested an increase to permit a sign area of 2.98
m2.
3.0 STAFF COMMENTS
3.1 The Sign By-law recognizes that home-based businesses will occur with
residential neighbourhoods. While recognizing their need to advertise, the area is
not commercial but residential in nature. The Sign By-law therefore, seeks to
minimize the amount of signage within residential areas. The applicant proposes
a substantial increase of 441.8% in sign area within this residential area. Staff
considered residential properties with visibility to more than one road when the
regulations were developed; however, the area remains residential in nature and
properties with exposures to more than one road should not be permitted to erect
larger signs than those with exposure to only one road. The principle remains that
residential areas should not have billboard style commercial advertising.
3.2 A site inspection of the property did reveal that the permitted sign area of 0.55 m2
would not be highly visible from Durham Regional Road 57; however, there are
other means of advertising available to the applicant. Staff do not support the
proliferation of large signs for advertising impact in residential areas.
4.0 CONCLUSION
4.1 Staff do not support the application. The application does not conform to the
intent of the Sign By-law or the intent of the Official Plan for home occupation
uses in residential areas. Staff feel that large signs should not be introduced into
residential neighbourhoods, regardless of location. Approval of this application
could establish a precedent for other residential properties to request large signs.
Accordingly, it is recommended that the application be DENIED.
