STEPHEN'S ESTATES PART LOT 8, CONCESSION 2, FORMER TOWN OF BOWMANVILLE Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PSD-023-01 be received; 2. THAT the request for Removal of Part Lot Control with respect to Lots 66, 67, 68, 69,72,73,74 and 75 on Plan 40M-2048 be APPROVED; 3. THAT the attached Part Lot Control By-law be APPROVED and forwarded to the Regional Municipality of Durham pursuant to Section 50(7.1) of the Planning Act; and, 4. THAT the all other parties listed here to be forwarded a copy of this report and any delegations be advised of Council's decision. Submitted by: Reviewed ,-) f7tAJ2Q~ ~ Franklin Wu Chief Administrative Officer SA*L T*DC*df September 24, 2001 642 , REPORT NO.: PSD-023-01 PAGE 2 v 1.0 BACKGROUND 1.1 Applicant: Legends Consulting on behalf of St. Stephen's Estates 1.2 Location: Part Lot 8, Concession 2, former Town of Bowmanville (see Attachment 1). 2.0 BACKGROUND 2.1 On September 17, 2001, Staff received a request from Legends Consulting on behalf of St. Stephen's Estates for the removal of Part Lot Control in respect to Lots 66, 67, 68, 69, 72, 73, 74 and 75, and Block 84 on Plan 40M-2048 (see Attachment 1). 2.2 Plan of Subdivision 40M-2048 received approval for 70 single detached dwelling and 8 lots for 16 semi-detached units. At this time, the applicant requests removal of Part Lot Control for 8 lots for semi-detached dwellings. The removal of Part Lot Control would facilitate the construction of semi-detached dwelling units on each of the lots. The process will enable the lots to be divided and resurveyed after the dwelling foundations are in place. The lots are within a registered plan of subdivision, therefore, there is an existing agreement in place to cover the Municipality's financial interest, including payment of parkland dedication. 2.3 Block 84 abuts the valley lands of the Soper Creek and requires further approvals from Central Lake Ontario Conservation (CLOC). Planning Services Staff have yet to receive confirmation from CLOC that their requirements have been satisfied. Therefore, Block 84 is not included in the Part Lot Control By-law at this time. When approval is given, a Part Lot Control By-law will be forwarded to Council for consideration. 643 , REPORT NO.: PSD-023-01 PAGE 3 3.0 STAFF COMMENTS 3.1 Staff have no objection to the approval of a By-law exempting Lots 66, 67, 68, 69, 72, 73, 74 and 75 from Part Lot Control. Attached is a By-law to exempt the above noted lands from Section 50 (5) of the Planning Act pursuant to the provisions of Section 50 (7) of the Planning Act. The Part Lot Control By-law requires the approval of Council and the Regional Municipality of Durham 4.0 RECOMMENDATIONS 4.1 In accordance with Subsection 7.3 of Section 50 of the Planning Act. Staff recommend that the By-law be in force for a three (3) year period following Council approval, ending October 15, 2004. That Subsection 5 of Section 50 of the Pianning Act shall not apply to those lands described in Paragraph 2 within the By-law. 2. That this By-law shall come into effect upon being approved by the Regional Municipality of Durham and thereafter Subsection 5 of Section 50 shall cease to apply to the following lands: a) Lots 66, 67, 68, 69, 72, 73, 74 and 75, inciusive on Registered Plan 40M-2048. 3. Pursuant to Subsection 7.3 of Section 50 of the Planning Act, this By-law shall be in force for a period of three (3) years ending on October 15, 2004.
