1.0 BACKGROUND
1.1 Applicant: Legends Consulting on behalf of St. Stephen's Estates
1.2 Location: Part Lot 8, Concession 2, former Town of Bowmanville (see
Attachment 1).
2.0 BACKGROUND
2.1 On September 17, 2001, Staff received a request from Legends Consulting on
behalf of St. Stephen's Estates for the removal of Part Lot Control in respect to
Lots 66, 67, 68, 69, 72, 73, 74 and 75, and Block 84 on Plan 40M-2048 (see
Attachment 1).
2.2 Plan of Subdivision 40M-2048 received approval for 70 single detached dwelling
and 8 lots for 16 semi-detached units. At this time, the applicant requests removal
of Part Lot Control for 8 lots for semi-detached dwellings. The removal of Part Lot
Control would facilitate the construction of semi-detached dwelling units on each
of the lots. The process will enable the lots to be divided and resurveyed after the
dwelling foundations are in place. The lots are within a registered plan of
subdivision, therefore, there is an existing agreement in place to cover the
Municipality's financial interest, including payment of parkland dedication.
2.3 Block 84 abuts the valley lands of the Soper Creek and requires further approvals
from Central Lake Ontario Conservation (CLOC). Planning Services Staff have
yet to receive confirmation from CLOC that their requirements have been
satisfied. Therefore, Block 84 is not included in the Part Lot Control By-law at this
time. When approval is given, a Part Lot Control By-law will be forwarded to
Council for consideration.

3.0 STAFF COMMENTS
3.1 Staff have no objection to the approval of a By-law exempting Lots 66, 67, 68, 69,
72, 73, 74 and 75 from Part Lot Control. Attached is a By-law to exempt the
above noted lands from Section 50 (5) of the Planning Act pursuant to the
provisions of Section 50 (7) of the Planning Act. The Part Lot Control By-law
requires the approval of Council and the Regional Municipality of Durham
4.0 RECOMMENDATIONS
4.1 In accordance with Subsection 7.3 of Section 50 of the Planning Act. Staff
recommend that the By-law be in force for a three (3) year period following
Council approval, ending October 15, 2004.
