THAT Report PSD-020-01 be received; 2. THAT the application to amend Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, submitted by Barry Jones on behalf of Di Adamo Holdings & Enterprises be referred back to staff for further processing and the preparation of a subsequent report following the receipt of the outstanding agency comments; and 3. THAT all interested parties listed in this report and any delegation be advised of Council's decision. Director, Planning Services BR*L T*DC*df September 20,2001 601 REPORT NO.: PSD-020-D1 PAGE 2 . 1.0 APPLICATION DETAILS 1.1 Owners: Di Adamo Holdings & Enterprises 1.2 Agent: Barry Jones 1.3 Zoning: Continued use of these lands for a golf driving range and related activities on a temporary basis for a period of up to three (3) years. 1.4 Area: 13.88 hectares (34.30 acres) 2.0 BACKGROUND 2.1 On August 14, 2001, the Planning Services Department received an application to amend Zoning By-law 84-63 in order to permit the continued use of the lands for a golf driving range and related activities on a temporary basis for a period of up to three (3) years. 2.2 The area subject to the proposal is located northeast of the intersection of Highway 35/115 and Concession Road 3. The municipal street address is 3171 Highway 35/115. The more formal location description is Part Lot 28, Concession 3, former Township of Clarke. 3.0 LAND CHARACTERISTICS AND SURROUNDING USES 3.1 The property is partially occupied by the existing golf driving range. A residence and a barn are also on the property. Foster Creek runs through the south end of the property and the eastern half of the property is vacant grassland. The topography is generally flat. 602 , REPORT NO.: PSD.020.01 PAGE 3 3.2 The surrounding land uses are as follows: North - the Pines Senior Public School and Clarke High School South - Agricultural East - Agricultural West - Commercial with frontage on Highway 35/115 4.0 PUBLIC NOTICE AND SUBMISSIONS 4.1 Public notice was given by mail to each landowner within 120 metres of the subject property and a public notice sign was installed on the Highway 35/115 frontag e. 4.2 As a result of the public notification process, to date, the Planning Services Department has received one (1) telephone inquiry. The person expressed great concern regarding the continuation of the problem of numerous stray golf balls. Through the processing of this application, staff will investigate methods of addressing this concern. 5.0 OFFICIAL PLAN CONFORMITY 5.1 Within the Durham Regional Official Plan, the subject property is designated as "Permanent Agricultural Reserve". 5.2 Within the Clarington Official Plan, the subject property is designated generally as "Prime Agricultural Area" with the south end designated "Environmental Protection Area" due to the presence of Foster Creek. Section 23.4.4 of the Clarington Official Plan states that temporary use by-laws may be passed to permit the use of lands, buildings or structures on a temporary basis provided that: 603 . REPORT NO.: PSD-020-01 PAGE 4 . the proposed use is temporary in nature; . the proposed use is compatible with adjacent existing land uses and has a minimal impact on any natural features; . there will be no adverse impacts on traffic or transportation facilities; . adequate access and parking are provided; . the use can be removed and the site can be restored to its original condition; . adequate sewage disposal and water services are available in compliance with provincial and regional standards; . the long term implementation of the Official Plan is not jeopardized; and . generally, the extension of the temporary use by-law does not extend beyond 10 years. 6.0 ZONING BY-LAW COMPLIANCE 6.1 Within Comprehensive Zoning By-law 84-63 of the former Town of Newcastle, the large majority of the subject property is zoned "Agricultural Exception (A-63)" which is the zone for the golf driving range and the associated temporary use by- law. The Foster Creek Valley lands are zoned "Environmental Protection (EP)" and to the south of them there is a small portion of "Agricultural Exception (A-1)" zoned land. The Highway 35/115 frontage of the property north of the Creek is zoned "Special Purpose Commercial (C4)". 6.2 The Temporary Use By-law extension applied for permits the continuation of a temporary use for up to three (3) years. The current temporary use expires on January 24, 2003. 604 . REPORT NO.: PSD-020-01 PAGE 5 7.0 AGENCY COMMENTS 7.1 The rezoning application was circulated to various agencies and other departments by the Planning Services Department. Comments received to date are as follows. 7.2 The Clarington Emergency Services Department had no fire safety concerns. 7.3 The Engineering Services Department-Building Division had no concems. 7.4 The Kawartha Pine Ridge District School Board, owner of the abutting property to the north, had no objections. 7.5 The Regional Planning Department noted the subject property is designated "Permanent Agricultural Reserve" in the Regional Official Plan and that municipal services are not available to the subject property, nor are there plans to make such services available to it. Should there be upgrades to plumbing on the property through new construction, Regional Health Department approval is required. 7.6 Comments remain outstanding from Engineering Services Department- Engineering/Parks Division, Hydro One Networks Inc., Ganaraska Region Conservation, Regional Health Department and the Ministry of Transportation. 8.0 STAFF COMMENTS 8.1 As the purpose of this report is to give the status of the application for the public meeting, it is appropriate to have the application referred back to staff for further processing. 605 .
