THAT Report PSD-018-01 be received; 2. THAT Council authorize the preparation of a Waterfront Master Plan for the Port of Newcastle Neighbourhood in accordance with the process outlined in Report PSD-018- 01; 3. THAT funds not to exceed $7,000 be authorized to hire a peer consultant to review the proposed Waterfront Master Plan on behalf of the Municipality, such funds to be drawn from Account 2900-1-X Working Funds Reserve; 4. THAT a Memorandum of Understanding between 1138337 Ontario Inc. and Municipality of Clarington be prepared to address the responsibilities of each party in accordance with Section 3.0 of report PSD-018-01, and that the Mayor and Clerk be authorized to execute a Memorandum of Understanding on behalf of the Municipality of Clarington; 5. THAT the attached by-law authorizing execution of the Memorandum be forwarded to Council for approval; and 6. THAT Mr. Daniell of 1138337 Ontario Inc. be advised of Council's decision. Franklin Wu Director, Planning Services Chief Administrative Officer CS*BN*DC*sh September 12,2001 693 REPORT: PSD 018-01 PAGE 2 , - 1.0 BACKGROUND 1.1 On June 27, 2001, Mayor Mutton and Staff met with Mr. Bill Daniell and Mr. Kelvin Whalen of 1138337 Ontario Inc. (The Kaitlin Group) and a consultant from Marshall Macklin Monaghan to discuss the redevelopment of the Port of Newcastle Marina, in particular the clubhouse. Mr. Daniell is proposing that a new 1858 m2 (20,000 sq.ft.) clubhouse be constructed adjacent to the channel. At that meeting, Mr. Daniell proposed that the redevelopment of the clubhouse would be an opportunity for the Municipality to develop some public facilities on those lands owned by the Municipality or held by easement including linking the Waterfront Trail to the Samuel Wilmot Nature Area. Mr. Daniell agreed to retain a consultant to prepare a Waterfront Master Plan. The Plan would form the basis for the Municipality's application to the next round SuperBuild Ontario Funding Program which will be announced this fall (see Attachment 1). 1.2 The Director of Planning Services and the Director of Engineering Services concurred with the proposal by the Kaitlin Group as a good approach for stimulating public and private investment of waterfront lands. 1.3 The purpose of this report is to: . Briefly describe the process for the Waterfront Master Plan study . Seek Council's approval to retain a consultant to undertake a peer review of Marshall Macklin Monaghan's Waterfront Master Plan on behalf of the Municipality of Clarington . Seek Council's authorization to enter into a Memorandum of Understanding with the Kaitlin Group for the preparation of the study 2.0 WATERFRONT MASTER PLAN STUDY In order to meet the tight deadlines of the Superbuild applications, the Kaitlin Group has retained Marshall Macklin Monaghan to prepare a Waterfront Master Plan for the Port of Newcastle Marina lands. This is a multi-disciplinary consultant firm. It has prepared similar plans for waterfront areas in the Village of Rosseau, Town of Goderich and Fort Erie. 694 , REPORT: PSD 018-01 PAGE 3 The study is currently underway. Staff have met with Kaitlin Group and the consultant on two occasions to discuss study process and expectations. 2.1 The Study Area The study area includes all of the waterfront lands from and including the Port of Newcastle marina to the east limit of the Samuel Wilmot Nature Area. 2.2 The Study Process The Study process will include the examination of existing background data, and the constraints and opportunities for the site. Some options for the development of the lands will be produced for discussion purposes prior to finalizing the plan. Council will be required to approve the plan before development proceeds. 2.3 Public Consultation Process The public will be consulted throughout the process. The consultant is recommending the following consultation process: · A workshop with the landowners, Newcastle-Bond Head Ratepayers Association, Newcastle Village BIA, Board of Trade and other public agencies to determine their vision for the waterfront · A meeting with the community-at-Iarge to determine their visions and aspirations for the Newcastle waterfront · A meeting with the community-at-Iarge to present some options for the waterfront and receive feedback · A meeting with the community-at-Iarge to present a draft plan, and · A final meeting with the community-at-Iarge to present the final plan Staff of the Planning Services and Engineering Services Departments will be responsible for arrangements at the meetings. The workshop is scheduled for late September. Staff will advise Council of the date, time and venues of the meeting upon confirmation. 2.4 Peer Review The Waterfront Master Plan is being produced at the direction of the Kaitlin Group. Municipal Staff will have input into the study and consultation process. However, to ensure that the Plan meets the Municipality's desire to create a 695 REPORT: PSD 018-01 PAGE 4 c public place on the waterfront that is integrated with the private sector interests, Staff is recommending that a consultant be retained to conduct a peer review of Marshall Macklin Monaghan's plan. Staff is suggesting that Carolyn Woodland of the consulting firm of Hough Woodland Naylor Dance Lienster be retained to conduct the peer review. Ms. Woodland is very familiar with Clarington's waterfront, as she is a former resident of Newcastle Village and her firm was retained to prepare the Port Darlington Secondary Plan and Samuel Wilmot Nature Area. 3.0 MEMORANDUM OF UNDERSTANDING 3.1 If Council approves Staffs recommendations to participate in the study process, Staff recommends that the two parties enter into a Memorandum of Understanding to define the roles and responsibilities in the preparation for the Plan (see Attachment 3). Highlights of the Memorandum of Understanding are as follows: The Kaitlin Group will be responsible for: · The costs associated with retaining the consultants to prepare the Plan, conducting the public consultation process, including the cost of hall rental, and preparing display materials, booklets and flyers · Consulting with outside agencies throughout the study process, and · The costs for additional studies, if required as a result of proposed changes to the marina, lands associated with the marina operation and the new clubhouse The Municipality of Clarington will be responsible for: · Providing background information · Committing staff time to assist with the study · Coordinating and scheduling the venues for the public consultation processes; including advertising and providing staff from the Planning Services and Engineering Services Departments to attend the meetings · Cost associated with retaining consultant to conduct a peer review of the draft Plan · Costs for additional studies if required as a result of the proposed improvements to the municipality's lands, and · Preparing the application to SuperBuild Ontario 696 , REPORT: PSD 018-01 PAGE 5 Once the plan is approved by Council, it will form the basis of the 2002 Ontario SuperBuild Ontario Program. If the Municipality of Clarington is successful in obtaining funding for the proposed improvements, a subsequent Memorandum of Understanding will be required to define the roles and responsibilities of each party in the implementation of the Plan. 3.2 This report has been prepared in consultation with the Director of Engineering Services. 4.0 CONCLUSION The Port of Newcastle is identified as a Tourism Node in the Clarington Official Plan. Although a number of uses are permitted, development activity to date has been limited to the approved residential subdivision. The Waterfront Master Plan for the Port of Newcastle will not only provide for the future improvements to the marina and marina operations, but also for improved public access to the waterfront. It is therefore respectfully recommended that Council confirm the arrangements and authorize the Mayor and Clerk to sign a Memorandum of Understanding between the Municipality of Clarington and the 1138337 Ontario Limited (The Kaitlin Group) for the Study process. For your information, we are now proceeding towards a dclailed site plan submis.sion for the clubhouse and immediatc marina area and hope to see this significant facility established at the earllest possible opportunity. As I had mentioned 10 you, we will be proposing a building of .approximately 10-\2,000 square feet likely over 2 floors_ The intended uses would include a rc,taurant and bamluct f.,eility as well as serving as a community clubhouse with recreational ond social aetivitics for the members. Nominally, the study would be done on behalf of the Municipality, however there would not be allY ou(]ay of costs by the Municipalily for the pl"Ll'aration of the study. The Municipality would however, nero to commit firstly to the principle of the application and provide necessary staff time to assist with the compilation and review of the report and the subsequent application. Furthermore, for the application to demonstrate that it has had public input and participation, there may be a need to hold one or more public inCormation session.s, which would require some degree of organi7.alion by the Municipality, As mentioned in our meeting. we are aware of a number of other similar applications that have currently been made to Supcrbuild including a S 5 Million dollar waterfront redevelopment project for the Village of Rosscau, and a significantly larger undertaking for Lake Muskoka by the Township nfMuskoka Lakes. Indications are as well that tbe Town of Port Hope will be submitting an applie'tion for their waterfront projcct. This suggests that there is a sig/lifieant ,mounl. of competition for available funding and that there is some urgency for Claringlon 10 id'ontify and express its own intentions. My underslanding is thaI 'Superbuild' is currently assessing the first round ofapplicalions that were submitted earlier this spring, and that very shortly there will be an announcement of the neKt round of appliealions. Il is important that when this happens, that the Municipality is prepared in order Il1allhe opportunhy not be lost for assistance from Ihis signilkanl funding partner. As a gencrallimeframe, I wOI,ld suggest that a target date be st.1 as October I, 200 I for tho application 10 be completed.
