TIRES 1995) PART LOT 15, BROKEN FRONT CONCESSION FORMER TOWNSHIP OF DARLINGTON FILE: ZBA 2001-007 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PSD-008-01 be received; 2. THAT the attached by-law to remove the Holding (H) symbol be APPROVED and forwarded to the Regional Municipality of Durham; and 3. THAT all interested parties listed in this report and any delegations be advised of Council's decision. 1.0 APPLICATION DETAILS 1.1 Applicant: 1106443 Ontario Limited (G.D. Tires 1995). 1.2 Rezoning: Removal of "Holding (H)" symbol from "Holding - Light Industrial ((H)M1)" to "Light Industrial (M1)". 1.3 Location: Part Lot 15, Broken Front Concession, former Township of Darlington (Attachment 1). 2.0 LOCATION 2.1 On February 28, 2001, Staff received a request from Russ Gibson of Hull Drafting, on behalf of 1106443 Ontario Limited (G.D. Tires 1995) for the removal of the "Holding (H)" provision from 2415 South Service Road. Attachment 1 shows the location of the lot zoned "Holding - Light Industrial ((H)M1). 6990D9 , REPORT: PSD-008-01 PAGE 2 , 2.2 The application was not brought forward at that time, as the site plan was not finalized. The applicant has now completed the site plan process and the agreement and drawings are finalized to the satisfaction of Municipal Staff. Subsequently Staff are recommending the Holding symbol be removed at this time to facilitate development at the site. 2.3 G.D. Tires 1995 is currently located at the northeast comer of 2427 South Service Road. This was initially established as a short-term location using trailers and fencing instead of a more comprehensive site incorporating building design, site design and landscaping. The owner of 2427 South Service Road severed a 0.68 ha lot, now called 2415 South Service Road, for the purpose of creating a new industrial lot. GoO. Tires 1995 intends to re-establish their business here on a permanent basis and thus are entering into a site plan agreement with the Municipality for this location. 2.4 An amending application to make 2427 South Service Road a permanent use was submitted in 1995 but was never finalized. Under the terms of the original agreement the site plan agreement terminated within a year of registration. As this is the agreement in affect at this time, Staff will require the owner to ensure the removal of all buildings, structures, goods and materials, signs, light fixtures, refuse and refuse containers, utility appurtenances, fencing, and remove any contaminants within sixty (60) days of occupancy of the new property at 2415 South Service Road. The owner has been advised of this requirement and has concurred in writing. 3.0 STAFF COMMENTS 3.1 The subject property is presently zoned "Holding - Light Industrial ((H)M1)". The provisions of the Zoning By-law allow for the removal of the "Holding (H)" symbol, by by-law, upon Council being satisfied that the uses to be permitted will be adequately serviced, have appropriate access, and will be used for the purposes intended by the by-law. 3.2 It is noted that pursuant to Section 36 of the Planning Act, a by-law amendment to remove the "Holding (H)" symbol is not subject to the normal appeal period afforded to a standard rezoning application, and accordingly shall be deemed final and binding should Council grant approval of same. 4.0 RECOMMENDATIONS 4.1 In consideration of the comments noted above approval of the removal of the "Holding (H)" symbol as shown on the attached by-law and schedule (Attachment 2) is recommended. 699010 , REPORT: PSD-008-01 PAGE 3 Respectfully submitted, '~-~. ~. avid J. II ! ... ," !I . ~. 1 ~ ! ~ i ! 1,1 ~ U.; ri.O j Ii ~ I y THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 2001 being a by-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the former Town of Newcastle WHEREAS the Council of the Corporation of the Municipality of Clarington deems It advisable to amend By-law 84-63, as amended, of the Corporation of the former Town of Newcastle to implement ZBA 2001-007; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipal~y of Clarington enacts as follows: 1, Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from: "Holding - Light Industrial ((H)M1) Zone" to "Light Industrial (M1) Zone", 2, Schedule "A" attached hereto shall form part of the By-law. 3, This By-law shall come Into effect on the date of passing hereof, subject to the provisions of Sections 34 and 36 of the Planning Act.
