Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-004-01 be received; and
2. THAT Council concur with decisions of the Committee of Adjustment made on
June 24, July 5, July 19, and August 9, 2001 for applications A2000/047 to
A2000/050, inclusive, A2001/001, A2001/029, A2001/032 to A2001/044,
inclusive, and that Staff be authorized to appear before the Ontario Municipal
board to defend the decisions of the Committee of Adjustment;
1.0 All applications received by the Municipality for minor variance are scheduled to
be heard within 30 days of being received by the Secretary-Treasurer. The
purpose of the minor variance applications and the committee's decisions are
detailed in Attachment No.1. The decisions of the Committee are detailed
below.

2.0 Committee denied applications A20001047, A2000/048 and A20001049 as they
felt it would be more appropriate for the developer to reduce the exterior side
yard setback requirements for all their corner lots through a rezoning application
rather than by minor variance applications. These recent decisions are
consistent with Committee's past decisions, that where compliance with the by-
law is possible and reasonable, a variance should not be granted for
convenience or monetary gain and that by reducing all exterior side yard setback
the appearance and character of a neighbourhood may be changed and that the
applications then are not minor in nature. Committee felt that dwellings could be
constructed upon these lots, without a minor variance, although possibly smaller
in size than what the developer is proposing.
3.0 Although this denial was not consistent with staff's recommendations, it is staff's
opinion that it would not be prudent for the Municipality to appeal the application.

The applicant, owner or any interested party has the opportunity to file an appeal
to the Ontario Municipal Board if they so wish.
4.0 The Committee of Adjustment has not always concurred with staff's
recommendations. It has not been Council's practice to appeal these decisions
leaving that option with the applicant or interested party.
5.0 Staff has reviewed the Committee's decisions and is satisfied that the
applications that received approval are in conformity with the Official Plan
policies, consistent with the intent of the Zoning By-law and are minor in nature
and desirable. Council's concurrence with the Committee of Adjustment
decisions is required in order to afford Staff's official status before the Ontario
Municipal Board in the event of an appeal of any decision of the Committee of
Adjustment.
