THAT Report COD-023-04 be received; 2. THAT M.J. Dixon Construction Ltd., Mississauga, Ontario with a total amended bid in the amount of $3,358,248.00, being the lowest responsible bidder meeting all terms, conditions, and specifications of Tender CL2004-019, be awarded the contract for the Indoor Soccer Facility and Outdoor Lacrosse Bowl as required by the Community Services Department; 3. THAT the total funds required in the amount of $3,868,500.00 ($3,358,248.00 tender + $194,000.00 Architectural Consulting Services + $316,252.00 utility connections, equipmenUfurnishing, project contingency) be drawn from Accounts as follows: a. $3,350,000 from Clarington Indoor Soccer Facility Capital Account #110-42- 421-84226-7401 (to be debentured) b. $518,500 from Engineering Account # 110-32-325-83252-7401 (Bowmanville Community Park Project) 4. THAT the Director of Finance/Treasurer be authorized to make application to the Region of Durham for a debenture in the amount of $3,350,000 plus debenture costs; 5. Caruana, ctor of Community Services MM\LM\LAB\NT\JC\km REPORT NO.: COD-023.Q4 PAGE 3 BACKGROUND AND COMMENT Tender specifications were provided by Barry-Bryan Associates (1991) Ltd., Whitby, Ontario, for the Indoor Soccer Facility and Outdoor Lacrosse Facility within the Municipality of Clarington, as required by the Community Services Department. A pre-qualification process took place with seven (7) firms being invited to bid. Subsequently, tenders were received and tabulated as per Schedule "B" attached. As the low bid exceeded the funds of $2,700,000 which were allocated through the 2003 Capital Budget, negotiations were entered into with the low bidder, M.J. Dixon Construction. Through this process, revised pricing was received for such items as relocating water/fire protection lines and roofing specifications, which realized a cost savings of approximately $54,752.00. This results in a revised tender bid of $3,358,248.00 The total funds required in the amount of $3,868,500.00 ($3,358,248.00 tender + $194,000.00 Architectural Consulting Services + $316,252.00 utility connections, equipment/furnishing, and project contingency) be drawn from Account #110-42-421- 84226-7401 ($3,350,000) and the balance of $518,500 from Account # 110-32-325- 83252-7401 (Bowmanville Community Park Project). As noted in the 2004 capital budget, financing from the Assessment Appeals Reserve Fund is contingent upon regulations being signed by the Minister of Finance. This portion of financing for the Bowmanville Community Park Project is from the other sources of financing identified for the project in the capital budget. Originally, the cost was projected at $2,700,000. A debenture of $3,350,000 over a period of 15 years would result in an estimated annual repayment amount of $339,314. The exact amount of the repayment would be determined at the time of the debenture issuance by the Region of Durham. In the 2004 budget, 50% of the original estimate of the debenture repayment based on the original project cost was included at a value of $139,000. As a result, there will be an additional tax levy impact for 2005 of $200,314, " REPORT NO.: COC-023-04 PAGE 4 less any fundraising received from the respective groups (Darlington Soccer Club and the Lacrosse Club). Although no development charges financings is available at this time it is necessary for Council to express its intent to pursue this avenue in the future should financing become available. The Director of Finance has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc., should be referred to the Director of Community Services. After further review and analysis of the bids by the Community Services Department, Barry-Bryan Associates (1991) Ltd. and Purchasing, it was mutually agreed that the low bidder, M.J. Dixon Construction Ltd., Mississauga, Ontario, be recommended for the contract for the Indoor Soccer Facility and Outdoor Lacrosse Bowl. Dixon Construction Ltd., Mississauga, Ontario, to enter into agreement for the Indoor Soccer Facility and Outdoor Lacrosse Bowl. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington and seal with the Corporation Seal, a contract between, M.J. Dixon Construction Ltd., Mississauga, Ontario, and said Corporation; and 2. THAT the contract attached hereto as Schedule "A" form part of this By-law.
