LOT 11/12, CONCESSION 2, FORMER TOWN OF BOWMANVILLE FILE NO,: ZBA 2001-002 and DEV 96-029 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. 2. 3. 4. 5. THAT Report PD-O 12-0 I be received; THAT the request submitted by Halloway Holdings Ltd.lTowchester Developments Ltd. for removal of Part Lot Control with respect to Lots 1 to 7, inclusive and Blocks 16 to 19, inclusive on Plan 40M-2020; and Lots 1 to 12, inclusive and Blocks 69 to 72, inclusive on Plan 40M-2022 and that the removal of Holding Symbol with respect to Lots 1 to 13 and a portion of Longworth Avenue on Plan 40M-191O be APPROVED; THAT the attached Part Lot Control By-law be APPROVED and forwarded to the Regional Municipality of Durham pursuant to Section 50(7.1) of the Planning Act R.S.O. 1990, as amended; THAT the attached Amendment to Zoning By-law 84-63 be APPROVED; and THAT all interested parties listed in this report and any delegations be advised of Council's decision. 1. 1.1 APPLICATION DETAILS Applicant: Halloway Holdings Limited and Towchester Developments Limited 623 . REPORT NO.: PD-016-01 PAGE 2 1.2 Location: Part Lots II and 12, Concession 2, former Town of Bowmanville (Attachment I) 2. BACKGROUND 2.1 On January 15, 2001, Staff received a request from Halloway Holdings Limited and Towchester Developments Limited for the removal of Part Lot Control with respect to Lots I to 7, inclusive and Blocks 16 to 19, inclusive on Plan 40M-2020; and Lots I to 12, inclusive and Blocks 69 to 72, inclusive on Plan 40M-2022. 2.2 The removal of holding symbol was not completed for Registered Plan of Subdivision 40M-1910. This plan was registered on February 11, 1998. All of the associated building permits have already been issued. This Removal of Holding symbol by-law is necessary to complete the approvals necessary.. 2.3 Plan of Subdivision 18T-87087 received draft approval for Lots 28 to 34 as semi- detached lots for 14 dwelling units. These lots are equivalent to Lots I to 7 in Registered Plan 40M-2020. Plan of Subdivision l8T-87087 received draft approval for Part Lot Blocks (portions of semi-detached lots straddling a subdivision boundary). These part lot blocks are equivalent to Blocks 16, 17, 18 and 19 in Registered Plan 40M-2020. 2.4 Plan of Subdivision l8T-82037 received draft approval for Lots 1 to 12 as semi-detached lots for 24 dwelling units. These lots are equivalent to Lots I to 12 in Registered Plan 40M-4022. Plan of Subdivision l8T-82037 received approval for Part Lot Blocks (portions of semi-detached lots straddling a subdivision boundary). These part lot blocks are equivalent to Blocks 69, 70, 71 and 72 in Registered Plan 40M-2022. 2.5 The removal of Part Lot Control would facilitate the construction of semi-detachedllink dwelling units on each of the lots and the assembled part lot blocks. The process will enable the lots to be divided and re-surveyed after dwelling foundations are in place. 624 REPORT NO.: PO-o16-01 PAGE 3 There is an existing agreement in place to cover the Municipality's financial interest as all lots and blocks are within a registered plan of subdivision. 3. STAFF COMMENTS 3.1 Staff has no objection to the approval of a By-law exempting the subject lands from Part Lot Control. Attachment No. 3 is a By-law which has been prepared to exempt the subject lands from Section 50 (7) of the Planning Act. The Part Lot Control By-law requires the approval of Council and the Regional Municipality of Durham. 3.2 Staff has no objection to the removal for the Holding (H) Symbol as shown on the attached By-law and Schedule (see Attachment 5). 4. WHEREAS the Council of the COIporation of the Municipality ofClarington deems it advisable to exempt from Part Lot Control, Lots I to 7 and Blocks 16 to 19 all inclusive on Plan 40M-2020 and Lots I to 12 and Blocks 69 to 72, all inclusive on Plan 40M-2022, registered at the Land Titles Division of Whitby. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality ofClarington enacts as follows: I. THAT Subsection (5) of Section 50 of the Planning Act shall not apply to those lands described in Paragraph 2 within the By-law. 2. THAT this By-law shall come into effect upon being approved by the Regional Municipality of Durham and thereafter Subsection (5) of Section 50 shall cease to apply to the following lands: a) Lots I to 7 and Blocks 16 to 19, all inclusive on Registered Plan 40M-2020; and b) Lots I to 12 and Blocks 69 to 72, all inclusive on Plan 40M,2022. 3. Pursuant to Subsection 7 of Section 50 of the Planning Act, this By,law shall be in force for a period of three (3) years ending on February 12, 2004. BY,LA W read a first time this day of 2001. BY. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY,LAWNUMBER200I,_ being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the former To\VIl of Newcastle WHEREAS the Council of the Corporation of the Municipality ofClarington deems it advisable to amend By-law 84,63, as amended, of the Corporation of the former Town of Newcastle to implement DEV 96,029; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality ofClarington enacts as follows: 1. Schedule "3" to By-law S4,63 as amended, is hereby further amended by changing the zone designation from: "Holding - Urban Residential Type Two (H(R2)" to "Urban Residential Type Two (R2) Zone" as illustrated on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By,law. 3. This By,law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
