HILL TOP ESTATES SUBDIVISION, PHASE 2, ENNIS KILLEN
PLAN 40M-1826, 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION
BY-LAW', FINAL WORKS INCLUDING ROADS AND OTHER RELATED
WORKS
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report WD-02-01 be received;
2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for
the Final Works, which include final stage roads and other related Works, constructed
within Plan 40M-1826; and
3. THAT Council approve the by-law attached to Report WD-02-01, assuming the streets
within Plan 40M-1826 as Public Highways.

2.0 BACKGROUND
2.1 The Corporation of the Municipality of Clarington entered into a Subdivision Agreement,
registered June 29, 1995, with Kalee Investments Limited to develop lands by plan of
subdivision, located in Enniskillen and described as Plan 40M-1826 (Attachment No.1).

The agreement required the developer to construct all roadworks, including hot-mix paving,
sodded ditches, a storm drainage system and streetlights, hereinafter referred to as the
'Works'.
2.2 The subdivision agreement provides for the separation of the Works into four (4) stages:
(a) Initial Works;
(b) Street Lighting System;
(c) Final Works; and
(d) Stormwater Management System
2.3 The Initial Works and Street Lighting System Works were issued 'Certificates of
Completion' and subsequent 'Certificates of Acceptance' by the Director of Public Works,
as per the maintenance requirements set out in the Subdivision Agreement.
2.4 There are no Stormwater Management System Works associated with this project.
2.5 The Final Works were issued a 'Certificate of Completion' dated December 1, 1999. This
initiated a one (I) year maintenance period which expired on December 1, 2000. The
Works have been re-inspected and all deficiencies have now been rectified to the
satisfaction of the Director of Public Works.
2.6 It is now appropriate to issue a 'Certificate of Acceptance' for the Final Works. The
subdivision agreement requires Council approval prior to the issuance of any 'Acceptance
Certificate' for Final Works.
2.7 Further to the issuance of a 'Certificate of Acceptance', a by-law is required to permit the
Municipality to assume certain streets within Plan 40M-1826 as public highway
(Attachment No.2).

THE CORPORATION OF THE MUNICIPALITY OF CLARlNGTON
BY-LAW 2001-
Being a By-law to establish, layout and dedicate certain lands as public
highways and to assume certain streets within the Municipality of
Clarington as public highways in the Municipality of Clarington.
NOW THEREFORE the Council of the Corporation of the Municipality of Clarington hereby enacts as
follows:
1. THAT the street and blocks shown on Plan 40M-1826 and listed below and listed in this section,
all being in the Municipality of Clarington, in the Regional Municipality of Durham, are hereby
accepted by the Corporation of the Municipality of Clarington as public highways, and assumed
by the said Corporation for public use:
Virtue Court
Blocks 21 and 22 (street widenings)
BY.LAW read a first and second time this l~ day of February 2001.
BY-LAW read a third time and finally passed this It" day of February 2001.
