Subject: WESTSIDE CREEK MARSH
Recommendations:
it is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report ADMIN. 13 - 95 be received for information.
REPORT:
1. On April 5, 1995, Mr. Crombie from the Regeneration Trust held j
a second public meeting at the Municipal Administrative Centre
with respect to the various issues related to the Westside
Creek Marsh. Said public meeting is a follow-up to an earlier
public meeting held in December, 1994 .
2 . At the meeting, the Trust made a presentation and suggested
alternatives to save part of the Marsh. A fact sheet
explaining the Trust's proposal is attached.

3 . At the conclusion of the public meeting, Mr. Crombie invited
the residents and other parties to provide any comment or
feedback they may have within a couple weeks . In particular,
the Trust is most interested to find out whether or not there
is a willingness on the part of the community to take a
cooperative approach and to work towards solutions based on
the general framework of the Trust's proposal. j

The Trust's proposal contains certain suggestions such as the
closure and dedication of Waverly Road to St. Marys Cement as well
as Cove Road becoming an alternate access to Cedarcrest Beach.
Needless to say, for such proposals to come to fruition, there will
be a considerable amount of negotiations between all the parties
involved.
However, at this point in time, it is somewhat premature for the
Municipality to enter any negotiations as the Regeneration Trust is
still awaiting comments on their proposal from the surrounding
community.
Staff will continue to monitor the situation and keep Council
advised of future developments .

Waterfront Regeneration Trust
Westside Creek Marsh -- Proposal
April 5, 1995
Background
The Waterfront Regeneration Trust is an agency created by the Ontario Legislature in June,
1992. Its mandate includes consulting with the public and advising the Province on matters
related to waterfront lands. The Municipality of Clarington and St. Marys Cement requested that
Commissioner David Crombie and the Trust help find a resolution to issues related to St. Marys
development plans on the Clarington waterfront.
In December 1994, Commissioner Crombie held three public discussion sessions concerning St.
Marys plans to quarry limestone on its licensed property beneath the Westside Creek Marsh. The
company proposed an enhanced 37-acre marsh between Cedarcrest Beach Road and the licensed
limit of extraction to replace the existing 102-acre marsh. Members of the public and agency
representatives expressed concern about the loss of wetlands in general and this marsh in
particular. Neighbors spoke of their personal appreciation of the Westside Marsh and its value to
the local community. Others speakers pointed out the importance of the aggregate industry and
St. Marys to the economy of the Province and the municipality.
Information received during and after that meeting was considered by the Trust. A representative
of the Trust met with many stakeholders seeking a possible resolution with balanced consideration
for the environment, the economy and the community. Based on these discussions, the Trust
proposes the following possible solution.
The Trust Proposal for Discussion:
❑ Create a 120 acre "Port Darlington Greenway" to protect 64 acres of the Westside Marsh
and 56 acres of surrounding land, shield the neighbours and link Westside with the
Bowmanville Marsh;
❑ Clarington transfers 4 acres of Waverly Road to St Marys and thereby allows St. Marys
access to the limestone in 15 acres in the setbacks on either side of that road. In return,
St. Marys will make available 58 acres of marsh to be protected in the Greenway,
including 20 acres of marsh that exist between the southerly limit of extraction and
Cedarcrest Beach Road;
❑ Provide alternate access for Cedarcrest Beach via a new crossing and Cove Road;
❑ St. Marys replaces the northern 38 acres of Westside marsh that will be mined with
similar habitat on its own or adjacent properties, to ensure no net loss of wetland area or
function;

❑ Clarington provides an suitable industrial alternative location for CBM operations, and St
,Marys relocates CBM within two years and transfers 36 acres on West Beach Road to the
Greenway;
❑ Create a citizen/company/agency Committee to manage the Port Darlington Greenway;
❑ Establish a St. Marys Community Relations Committee to share information and seek
solutions to existing and future problems.
The proposed resolution would have the following results:
❑ The Westside Marsh would be 64 acres (58 from St Marys, 6 from others, total 64);
❑ The northern 38 acres of marsh would be lost to limestone mining but would be replaced
with comparable habitat;
❑ 120 acres of community Greenway would provide an increased buffer between quarry
operations and most neighbors. No one will have less than at present and most would
have 1000 ft or more;
❑ St. Marys access to limestone would be preserved along with its opportunities for growth,
development and additional contribution to the economy and community;
❑ The CBM stone crushing and redimix on Waverly Road would be removed promptly;
❑ A new access would be provided for Cedarcrest Beach via Cove Road to the east and
additional access for emergency vehicles would be provided via St. Marys private road
from the west.
❑ The Joint Management Committee for the proposed Port Darlington Greenway will
provide a new way for St. Marys and the community to work together;
❑ The proposed St. Marys Community Relations Committee will provide a means for the
company and its neighbors to share information and seek solutions to mutual problems;
and,
❑ A resolution of this conflict will free community energy for regeneration and positive
community development in Clarington.
