Recommendations:
i
It is respectfully recommended that Council approve the following:
1 . That Report ADMIN. 27-95 be received;
2 . That the attached letter dated September 18 1995 from Mr.
Dennis Hefferon with respect to the Offer of Purchase and Sale
by Clarington Place Limited be received, and the closing date
of September 30, 1995 be extended for ninety (90) days with
the terms and conditions remaining the same; and
3 . That Mr. Dennis Hefferon, Shibley Righton be advised of
Council' s decision.

Re: Clarington Place Limited Purchase of lands from the Municipality

The Agreement of Purchase and Sale made by Clarington Place Limited with the
Municipality of Clarington dated June 14, 1995 provides for its completion on the earlier
to occur of:
(a) within ten (10) days following the day on which a building permit(s) is issued
for the buildings proposed to be constructed on the Abutting Real Property !
... as referred to below in this Agreement of Purchase and Sale; or
(b) September 30, 1.995; or
(c) thirty (30) days after receipt of written notice by the Vendor from the
Purchaser requesting the closing be advanced,

On September 14, 1995 Mr, Ronald F. Worboy, the solicitor for Clarington Place
Urnited, wrote to me requesting an extension of the completion date now scheduled for
September 30, 1995 to December 31, 1995. I enclose a copy of Mr. Worboy's letter.
It is unlikely that the Order of the Ontario Municipal Board approving the rezoning
of Clarington Place Limited's lands which adjoin the land which is the subject of the
Agreement of Purchase and Sale will be issued before September 30, 1995, and therefore
some extension of the completion date would appear to be reasonable.
Would you please advise whether Mr. Worboy's requested extension of the
completion date is acceptable to the Municipality, Since the Agreement of Purchase and
Sale has been executed on behalf of the Municipality, it would be desirable if Council
authorized an approval of any extension.
