That Report ADMIN. 36-95 be received; 2 . That subject to written concurrence of Clarington Place Limited to an extension of the closing date being received by the Municipality prior to December 29, 1995, the closing date of the Agreement of Purchase and Sale between the Municipality and Clarington Place Limited which was authorized by Council' s approval of report PD-58-95 be extended to March 31, 1996, with the other terms and conditions of the Agreement remaining the same; and 3 . That Mr. Dennis Hefferon, Shibley Righton be advised of Council' s decision. REPORT: At the meeting on September 25 1995, Council adopted the recommendations contained in report ADMIN. 27-95 that the closing date of September 30 1995 specified in the Agreement of Purchase and Sale between the Municipality and Clarington Place Limited which was authorized by Council' s approval of PD-58-95, should be extended for ninety days . The other terms and conditions contained in the Agreement were to remain the same . The reason for the recommended extension was the delay which was being experienced in finalizing the Order of the Ontario Municipal Board respecting the rezoning of Clarington Place Limited' s lands which adjoin the land which is the subject of the Agreement of j Purchase and Sale. The issuance of the Order of the Ontario Municipal Board is a condition of the Agreement . YCLflED EA PIEfl PAP R CYCLE iHiS 6 P.MEDM RECYCLED PAPER Mr. Dennis Hefferon advises me that the Order of the Ontario Municipal Board has not been issued as yet but that he anticipates that it will be issued in the near future. In these circumstances, therefore, it would be prudent for the Municipality and Clarington Place Limited to agree to extend the closing date to March 31 1996 with the other terms and conditions of the Agreement of Purchase and Sale remaining the same.
