DISPOSITION OF CLEAN FILL FROM TOWN CONSTRUCTION
PROJECTS AND PRESENTATION OF MRS. MARY NOVAK,
SEPTEMBER 28 1987
RECOMMENDATIONS:
It is respectfully recommended to Council:
1. That Administrator's report ADMIN. 22 - 87 be received for information;
2. That a copy of report ADMIN. 22 - 87 be forwarded to Mrs. Mary Novak.
REPORT:
Recently, Mrs. Mary Novak (Pebblestone Road, Lot 29, Concession 4, former Township
of Darlington) addressed Committee and Council regarding aspects related to the
matter of the Town providing clean fill in order to reclaim a portion of her
property. Specifically, her written brief of September 28 1987 was referred
to the Administrator for review and report. It would appear that a considerable
amount of dialogue has taken place regarding this matter which has led to some
confusion and requires clarification.
Without attempting to reconstruct all events which have occurred in the past,
this matter has been reviewed from the point of view of the manner in which the
Town may dispose of surplus fill from construction projects in appropriate
locations and where it is cost effective from the Town's perspective.

In the particular case at hand, fill from the Bradley Street project was placed
on a site (Regional Road 34, Lot 28, Concession 3) in close proximity to that
of Mrs. Novak after the landowner was approached by Town staff to deposit such
fill (refer to report WD-54-87 considered on September 28 1987) . Staff have
indicated that they were unaware of Mrs. Novak's need for fill while discussion
with Mrs. Novak has provided conflicting information.
The essence of the various discussions, presentations to Council, and letters
provided by Mrs. Novak would indicate that the existing system could be improved
in order to avoid any misunderstandings such as those related to this case.
In order to complement the present practice of disposing of fill from Town road
construction projects in instances where the fill is not required for other
municipal projects, the following scenario will be implemented.
From time to time, the Public Works Department is in receipt of requests for
fill which may or may not coincide with any municipal projects in the vicinity
of the request. As indicated previously (Report WD-54-87) the disposition of
fill is based mainly on economic considerations (e.g. access to disposal site,
proximity to disposal site, condition of haul roads, etc.) .
In the future such requests will be recorded and when and where appropriate, the
specific landowner will be contacted as the need arises to dispose of fill from Town
projects. It is felt that such an approach is fair and takes into account staff and
other changes, etc. which may occur over time. If a considerable time elapses from
the date of the original request, the landowner would be contacted to confirm the
earlier interest in receiving fill when fill is removed from a construction site
in close proximity. Staff feel that such an approach would better structure this
process and can be implemented with relative ease.
It is understood, however, that there would be no obligation on behalf of the
Town to provide any landowner with clean fill unless the circumstances warrant
such disposition. In addition, the order of dealing with such requests would
be based on the present practice of general proximity to the construction site (i.e.
economic considerations) .

Furthermore, as expressed by Mrs. Novak, it may be appropriate for a landowner
requesting fill to provide their own transportation (private trucks) to move fill
from the construction site to the private property. This may be appropriate in
certain circumstances where a landowner of a site in close proximity to
the closest disposal of fill site has requested fill. The recording process
described above could accommodate these circumstances through the call back mechanism
for sites in the vicinity of Town construction projects. A landowner
requesting fill at the second closest disposal site could make arrangements at their
expense to transport excess fill if timing coincides with the needs of the Town.
Notwithstanding the above process, it is also understood that at times the Town
may seek a location close to the construction site for the disposal of clean
fill. This was the case related to the circumstances and site located in close
proximity to Mrs. Novak wherein the landowner was approached by the Town for
the disposition of fill.
In the meantime, a minimum of 25 to 30 truckloads of fill were provided to Mrs.
Novak as a result of the Bradley Street project. Now that the requirements of
Mrs. Novak have been clarified, fill may be available and/or provided in the
future, based on Town construction projects in this general area of the
municipality.
Aspects related to access permits to various properties and the possible lack
thereof is presently being examined by staff and appropriate action will be
taken as required. It should be noted, however, that some access points previously
discussed and mentioned may be located on roadways under the jurisdiction of the
Region of Durham.
It is felt that the matters raised by Mrs. Novak and the actions to be taken
will assist in streamlining the process related to the disposition of fill from
Town construction projects where appropriate. It should be emphasized and
understood that this process is provided and based on convenience to the Town.
