RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1 . That Report ADMIN. 17 - 87 be received for information; and
2. That a copy of Report ADMIN. 17 - 87 be forwarded to Mr. G. W. Westgarth
REPORT:
Recently Mr. G. W. Westgarth submitted a letter to the Town of Newcastle in order
to seek Council 's comments or suggestions regarding the name change of the Nel-Gor
Castle Nursing Home facility in the Newcastle Village Urban Area to Newcastle Health
Care Centre. This was brought about by the purchase of the Nel-Gor Castle Nursing Home
by ReliaCARE Inc. on March 1 1987.
Mr. Westgarth 's correspondence was considered by Council at its meeting of
April 13 1987 at which time the matter was referred to the Chief Administrative Officer
for investigation and subsequent report, in particular regarding the legal implications

of the request (refer to Resolution #C-378-87) . Subsequently, a legal opinion
was sought and received from Mr. David Sims, the Town's Solicitor (refer to
Attachment #1) .
Mr. Sims ' letter is explicit with respect to the request in that there
is no legal basis on which to object to the use of the proposed name "Newcastle
Health Care Centre" as proposed by ReliaCARE Inc. However, Mr. Sims raises a
relevant point regarding the fact that the use of the name as proposed may be
misleading to the general public suggesting that there may be a broad range of
health care services being provided or sponsored by the Town of Newcastle.
It would be appropriate that Mr. Westgarth be advised of these comments and the
concern expressed regarding any confusion to the public which may result.

Re : ReliaCARE Inc .
I am responding to your letter of April 23rd,
1987 seeking my comments on the proposed change of the
name of Net-Gor Castle Nursing Home facility to the
Newcastle Health Care Centre .
First, let me observe that the Corporation of
the Town of Newcastle has no proprietary claim to the
exclusive use of the word "Newcastle" and therefore we
have no legal basis on which to object to the use of
the proposed name "Newcastle Health Care Centre" .
However, it is not inappropriate for the Town to
express whatever views they may hold as to the use of
the name . In this regard, I note that the inference
that could be drawn from the proposed title is that
somehow the Town of Newcastle is directly involved or
sponsors the Health Care Centre . To this extent the
use of the title might be mileading to the general.
public . Moreover, the title Newcastle Health Care
Centre suggests that there is a broad range of health
care services being provided. From their letter their
principle operations would be the operation of the
nursing home with the provision of some health care
services to the elderly, both in the facility and in
the community. Thus, the proposed title might be

considered to be too general in nature . However, as
noted above these are simply comments and have no
binding or legal effect .
