SUBJECT: UPGRADING OF THE ROAD ALLOWANCE BETWEEN LOTS 26 and 27, CONCESSION 8,
FORMER TOWNSHIP OF CLARKE.
"YEAR ROUND ACCESS - MR. WILLIAM ALLIN" .
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommends to Council the following:
1 . That report ADMIN 69 - 86 be received; and
2. That report WD 38 - 86 be lifted from the Table and dealt with
at this time.
BACKGROUND AND COMMENT:
Members of Committee will recall , that the question of constructing the
road allowance between lots 26 and 27, Concession 8, former Clarke, to a
standard sufficient to provide Mr. Allin with year round access to his
property has been the subject of considerable debate both at Committee
and between staff and Mr. Allin 's solicitor.

Resolution GPA - 464 - 86 tabled report WD 38 - 86 pending a meeting
between the former administrator, the Mayor and Mr. Allin. The options
discussed by these parties have proven to be unacceptable to Mr. Allin
and, his solicitor, Mr. Timothy W. Johnston, 189 Kent Street West, Lindsay,
Ontario K9V 4S5, has by letter dated July 15th , 1986, requested that the
Town of Newcastle recognize the obligation of the municipality to keep this
road allowance in a state of repair and commence the work necessary to
affect the repairs.
Since the only option available to the Town is to carry out the necessary
work, the Director of Public Works is awaiting the Councils ' direction and
authorization of the funds necessary to carry out the work. It would be
appropriate therefore to lift report WD 38 - 86 from the Table and deal
with it at this time.
