RECOMMENDATIONS:
It is respectfully recommended to Council the following:
1. THAT Report TR-49-01 be received;
2. THAT Aquicon Construction Co. Ltd., Brampton, ON, with a total revised bid in an
approximate amount of $8,481.500.00 (plus approximately $255,000.00 G.S.T.),
being the lowest responsible bidder meeting all terms, conditions and
specifications of Tender CL2001-1, be awarded the contract for the Clarington
Public Library and Municipal Office Expansion;
3. THAT funds required in the amount of approximately $8,736,500.00 be charged
to Account # 7027-4-501 and financed as follows:
Debenture $8,100,000.00
Working Funds Reserve $400,000.00
Municipal Capital Works Reserve Fund
(and balance of approximately) $236,500.00
4. THAT funds for a diesel generator in an approximate amount of $205,000.00 be
drawn from the separately approved 2001 Capital Budget Account #7020-X-501
($175,000.00) and $30,000.00 from Working Funds Reserve per TR-35-99;
5. THAT the attached By-law marked Schedule "A" providing authorization to request
the issuance of a debenture through the Region of Durham in an amount of
$8,100,000.00 be approved;
6. THAT, to the extent possible, repayment of the debenture be funded from
development charges; and
7. THAT the attached By-law marked Schedule "B" authorizing the Mayor and Clerk
to execute the agreement be approved.

BACKGROUND AND COMMENT
A Pre-qualification of prospective bidders took place with five (5) firms being invited to bid.
A summary of the bids received is attached marked Schedule "C".
Report Admin-19-00 provided that upon the tender award a final project budget be
identified for Council approval. In an effort to bring forward the most effective project cost
negotiations with the low bidder were entered into.
Changes to the tender in an approximate amount of $230,000.00 have been agreed upon
and result in reducing the total bid amount to approximate $8,481,500.00. These
changes are included in the final cost and are cosmetic in nature and will not affect the
integrity of the building.
As reflected in the 2001 Capital Budget, page 165, $175,000.00 was approved, and
$30,000.00 was carried over from the Y2K budget of 1999 for the purchase of a diesel
generator for the Municipal Administrative Centre. For the ease of installation, this
generator has been included in the total tender package. This item was required and
identified as part of the emergency plans (Y2K I Nuclear I Non Nuclear) and is to be
budgeted over the 2001 and 2002 budget years. In 2002, the funding is identified as the
General Municipal Reserve Fund for approximately $145,000.00.
After further review and analysis of the costs by the Building Committee, the Purchasing
Manager and the Library Director it is recommended that the contract for the construction
of the new Clarington Library and Municipal Administrative Centre be awarded to Aquicon
Construction Co. Ltd., in an approximate amount of $8,481,500.00, and that the funding
be provided as outlined in the recommendations of this report.

The Treasurer has reviewed the funding requirements and concurs with the
recommendation. Queries with respect to department needs, specifications, etc., should
be referred to the Library Director.
The subject firm has previously performed satisfactorily for the Municipal of Clarington in
the in the past and was the successful contractor for the construction of the Courtice
Community Complex.

BY-LAW 2001-
Being a By-Law to antborize tbe debenturing of $8,100,000
to assist in tbe construction of tbe Library Main Brancb
and expansion oftbe Municipal Administration Building
located at Plan Grant Blk M Lot 129, Now RP 40RI8882 Part I,
former geograpbic Townsbip of Bowmanville, in tbe Municipality of Clarington.
WHEREAS Section 123 ofthe Ontario Municipal Act, R.S.O. 1990, provides that By-Laws may be passed to
allow for borrowing for the purpose of the Corporation and the issuance of debentures thereof;
WHEREAS the Council of the Corporation of the Municipality of Clarington wishes construction to proceed on
a new Library Main Branch and the expansion of the Municipal Administration Building for Municipal
operations;
WHEREAS the Council of the Corporation of the Municipality ofClarington has approved Report TR-49-0l at
its meeting of June 25, 200 I for the Library Main Branch and the expansion of the Municipal Administration
Building;
WHEREAS the Treasurer has updated the Municipality's annual debenture limit and this limit has not been
exceeded, therefore, the Ontario Municipal Board approval is not required;
NOW THEREFORE, Be It Enacted and It is Enacted as a By-law ofthe Corporation of the Municipality of
Clarington as follows:
I. THAT the Municipality proceed with the constrnction of a new Library Main Branch and the expansion
of the Municipal Administration Building for municipal operations, located at Plan Grant Blk M Lot
129, Now RP 40Rl8882 Part I, fonner geographic Township of Bow manville, now in the Municipality
of Clarington;
2. THAT the snm of$8,100,000 be debentured over a period not to exceed fifteen (15) years; and
3. THAT the funds to repay the principal and interest of the debenture be raised through a tax levy on the
ratepayers, to the extent possible through development charges, and from the debenture repayment
reserve fund, as approved in Admin-33-99.

BY-LAW #2001-
Being a By-law to authorize a contract between the
Corporation of the Municipality of Clarington and Aquicon
Construction Co. Ltd., Brampton, Ontario to enter into an
agreement for the construction of the Clarington Public Library
and Municipal Office Expansion.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS
AS FOLLOWS:
THAT the Mayor and Clerk are hereby authorized to execute,
on behalf of the Corporation of the Municipality of Clarington
with the Corporation Seal, a contract between Aquicon
Construction Co. Ltd., Brampton, Ontario and said
Corporation; and
2. THAT this agreement attached hereto as Schedule "B" form part of this By-law.
