By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: MARCH 3 1986 REPORT #: AnMTN_ 19 - 86 FILE #: SUBJECT: EXTENSION OF VISUAL ARTS CENTRE LEASE RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Administrator's report ADMIN. 19 - 86 be received; 2. That the request for lease extension be granted subject to the Visual Arts Centre signing the attached lease and that the Mayor and Clerk be authorized by by-law to sign the necessary documents; and 3. That the Visual Arts Centre be advised of Council 's actions. BACKGROUND AND COMMENT: Staff received a request from the Visual Arts Centre with respect to the extension of the term of their lease. Staff in conjunction with the Visual Arts Centre have reviewed this matter together with the previous lease. The proposed lease is identical to the previous lease save and except for the first page. This lease has been altered to reflect the increased term and to delete the obligation on the part of the Tenant to provide fire insurance on the premises. ADMIN. 19 - 86 -2- In accordance with earlier Town-wide policy revisions the Town has provided fire insurance to the property without charge for the past number of years, as such, it is appropriate to delete this requirement. The liability insurance that is carried by the Visual Arts Centre is designed to cover their liability for activities undertaken by the Arts Centre. In addition, a minor amendment has been made to clarify the role that the Visual Arts Centre of Newcastle will have with respect to the maintenance of the structure. The proposed changes have been discussed with the Visual Arts Centre and they are in concurrence with the proposed revisions. The extension of the lease to twenty-five years will permit the Visual Arts Centre to be eligible for a number of senior government capital improvement grants that otherwise would be unavailable.
