'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW'
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1 . THAT Report WD-2-95 be received;
2. THAT the Director of Public Works be authorized to issue a 'Certificate
of Acceptance' for the roads, street lights and other related Works,
constructed within Plan 1OM-833; and
3. THAT Council approve the proposed By-law attached to Report WD-2-95
assuming certain streets within Plan 1OM-833 as public highways.

2.0 BACKGROUND
I
2.1 The former Town of Newcastle entered into a subdivision agreement
registered on January 3, 1990, with Kiddicorp Investments Ltd. to develop
lands by plan of subdivision, located in Bowmanville and described as Plan
1OM-833 (Attachment No. 1) . The agreement required the, developer to
construct all roadworks, including hot-mix paving, curb and gutter,
sidewalks, boulevard sodding and street trees, a storm drainage system and
street lights, hereinafter referred to as the 'Works' .

2.2 The subdivision agreement provides for the separation of the Works into
two (2) stages:
(a) Storm Sewer Systems; and

(b) Roads and Above Ground Services.
2.3 Council previously approved Report WD-1 -93, which authorized the issuance
of a 'Certificate of Acceptance' for the Storm Sewer System for plan 10M-
833.
2.4 The Roads and Above Ground Services were completed and a 'Certificate of
Completion' was issued dated December 2, 1992. The Works were placed on
a two (2) year maintenance period which expired on December 2, 1994.
These Works were subsequently inspected and all deficiencies have now been
rectified to the satisfaction of the Director.

2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads
and Above Ground Services. The subdivision agreement provides for this
certificate to be issued by the Director of Public Works, subject to the
approval of Council.

2.6 Further to the issuance of a 'Certificate of Acceptance' , a by-law is
required to permit the Municipality to assume certain streets with Plan
10M-833 as public highways (Attachment No. 2) .

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 95-
Being a By-law to assume certain streets within the
Municipality of Clarington as public highways in the
Municipality of Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality of Clarington
enacts as follows:
1. THAT the streets and the street widening Block 101 described in Registered
Plan 1OM-833 (described in schedule .All attached hereto and forming part
of this By-law) all being in the former Town of Newcastle, now known as
the Municipality of Clarington, in the Regional Municipality of Durham,
are hereby accepted by The Corporation of the Municipality of Clarington
as public highways, and assumed by the said corporation for public use.
BY-LAW read a first and second time this 30th day of January, 1995.
BY-LAW read a third time and finally passed this 30th day of January, 1995.
