THAT Report WD-3-95 be received; 2. THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, street lights and other related Works, constructed within Plan 10M-839; and 3. THAT Council approve the proposed by-law attached to Report WD-3-95 assuming certain streets within Plan 10M-839 as public highways. REPORT 1 .0 ATTACHMENTS No. 1 : Key Map No. 2: Proposed Road Dedication By-law for Plan 10M-839 2.0 BACKGROUND 2.1 The former Town of Newcastle entered into a subdivision agreement registered on August 9, 1990, with Sandbury Building (Courtice) Corporation to develop lands by plan of subdivision, located in Courtice and described as Plan 10M-839 (Attachment No. 1) . The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights, hereinafter referred to as the 'Works' . I 2.2 The subdivision agreement provides for the separation of the Works into two (2) stages: (a) Storm Sewer System; and (b) Roads and Above Ground Services. 1UU9 REC PA PER R PA PIEq RECYCLE TH6I PRINTEDCN BE CYCLED PAPER REPORT NO. : WD-3-95 PAGE 2 2.3 Council previously approved Report WD-9-93, which authorized the issuance of a 'Certificate of Acceptance' for the Storm Sewer System for Plan 1OM- 839. 2.4 The Roads and Above Ground Services were completed and a 'Certificate of Completion' was issued dated September 14, 1992. The Works were placed on a two (2) year maintenance period which expired on September 14, 1994. These Works were subsequently inspected and all deficiencies have now been rectified to the satisfaction of the Director. 2.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. 2.6 Further to the issuance of a 'Certificate of Acceptance' , a by-law is required to permit the Municipality to assume certain streets within Plan 1OM-839 as public highway (Attachment No. 2) . THAT the lands described as Blocks 154 and 155, Plan 10M-839, in the former Town of Newcastle, now known as the Municipality of Clarington, in the Regional Municipality of Durham, are hereby established, laid out, dedicated as public highway and assumed by the said Corporation for public use. 2. THAT the streets described in Registered Plan 10M-839 (described in Schedule "A" attached hereto and forming part of this By-law) all being in the former Town of Newcastle, now known as the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use. BY-LAW read a first and second time this 30th day of January, 1995. BY-LAW read a third time and finally passed this 30th day of January, 1995.
