Subject: SPRINGFIELDS SUBDIVISION, PHASE 1, PLAN 40M-1669, COURTICE,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY—LAW', ROADS,
STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-7-95 be received;
2. THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Plan 10M-1669; and
3. THAT Council approve the by-law attached to Report WD-7-95
assuming certain streets within Plan 40M-1669 as public
highways.

2.0 BACKGROUND
2. 1 The former Town of Newcastle entered into a subdivision
agreement registered on September 20, 1991, with 708545

located in Courtice and described as Plan 40M-1669 (Attachment
No. 1) . The agreement required the developer to construct all
roadworks., including hot-mix paving, curb and gutter,
sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works ' .
2.2 The subdivision agreement provides for the separation of the
Works into four (4 ) stages:
(a) Storm Sewer System,
(b) Roads and Above Ground Services,
(c) Tributary Stormwater Management Works, and
(d) Stormwater Detention Work and Water Quality Work.
3.0 REVIEW AND COMMENT
3. 1 Council previously approved Report WD-6-94 , which authorized
the issuance of a 'Certificate of Acceptance' for the Storm
Sewer System for Plan 40M-1669.
3.2 The Roads and Above Ground Services were completed and a
'Certificate of Completion' was issued dated November 6, 1992.
The Works were placed on a two year maintenance period which
expired on November 6, 1994 . These Works were subsequently
inspected and all deficiencies have now been rectified to the
satisfaction of the Director.
3.3 It is now appropriate to issue a 'Certificate of Acceptance'
for the Roads and Above Ground Services. The subdivision
agreement provides for this certificate to be issued by the
Director of Public Works, subject to the approval of Council.
3.4 Further to the issuance of a 'Certificate of Acceptance' , a

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 95- L�
Being a By-law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follows:
1. THAT the streets described in Registered Plan 40M-1669
(described in Schedule "A" attached hereto and forming part of
this By-law) , all being in the Municipality of Clarington, in
the Regional Municipality of Durham, are hereby accepted by
The Corporation of the Municipality of Clarington as public
highways, and assumed by the said Corporation for public use.
BY-LAW read a first and second time this 13th day of March, 1995.
BY-LAW read a third time and finally passed this
13th day of March, 1995.
