Subject: Request for an Extension of Lettner Road by
Henk and Beatrice VanDorp, Former Township of Darlington
Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1 . THAT Report WD-15-95 be received;
2. THAT the request from Henk and Beatrice VanDorp to extend Lettner Road a
distance of approximately two hundred (200) feet, including the
construction of a turnaround be approved;
3. THAT the extension be subject to Henk and Beatrice VanDorp depositing cash
or a letter of credit in the amount of $20,000 to cover the costs for the
road extension;
4. THAT the extension be carried out by Municipal forces and that the cost
to Henk and Beatrice VanDorp be the actual costs incurred, not to exceed
$20,000 and that, if the costs are less than $20,000, the difference be
refunded to Henk and Beatrice VanDorp; and
I
5. THAT Henk and Beatrice VanDorp be advised of Council's decision.

Mr. and Mrs. VanDorp want to build a house on the west side of Lettner
Road in a location more or less as shown on Attachment No. I . The problem

is that the property in question does not front onto an improved public
road and the Zoning By-law requires that before a Building Permit can be
obtained the property must have a minimum of one hundred (100) feet of
frontage on an improved public road.
3.0 REVIEW AND COMMENT
3.1 Disagreement on the Extent of Work
A visual inspection of the road indicates that the road should be improved
from a point on the north side of an existing driveway on the east side
of Lettner Road, northerly to the south limits of the VanDorp property,
and a further one hundred (100) feet northerly to provide for the minimum
one hundred (100) feet of frontage. Also, whenever a request is made to
extend a dead-end road, the requirement is that a turnaround be
constructed to facilitate the plowing of the roadway and the turning
around of other vehicles, such as garbage trucks and recycling trucks.
Mr. and Mrs. VanDorp disagree with the extent of the work and have been
advised that, if they want to dispute the issue, they should appear as a
delegation before Committee.
3.2 Cost Estimate
The estimated cost of the work is based on a visual inspection of the
road. It is possible that, once we commence construction, we may find
that the cost will be considerably less than the $20,000 estimate. The
only way that we can define the cost estimate is to dig some holes to
determine the structure of the road base. It is not felt that this
procedure is warranted for this type of work. In order to provide some
comfort to Henk and Beatrice VanDorp, it is recommended that the cost to
them will not be more than $20,000.

REQUEST FOR REMOVAL OF 0.3 METRE RESERVE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-136-92 be received;
2 . THAT the request submitted by Mr. Irwin Hamilton on behalf of
Mr. and Mrs. VanDorp to request the Town to convey to his
client the 0. 3 metre reserve, described as part 3, 1OR-1118,
be APPROVED subject to all costs related to the legal
conveyance be borne by the VanDorp's; and
3. THAT Mr. & Mrs. VanDorp be advised of Council's actions.
1. BACKGROUND
1. 1 In January of 1992, Staff received a request from Mr. Irwin
Hamilton on behalf of Mr. & Mrs. VanDorp requesting the
lifting of a 0.3 m reserve along the eastern edge of the
VanDorp property fronting on Lettner Road. (See sketch
attached)
1.2 The 0.3 m reserve and the subject lands (60 ha) were created
through a land severance application (LD 081/80) , by the then
owners, Ralph and Judith Hill. Said severance was approved
by the Land Division Committee in February of 1980, as a
severance of a 60 ha (148 acre) parcel for the purpose of
"farm consolidation" , while retaining a 4 . 0 ha (10 acre)
parcel containing a residence and farm buildings. The
approval was granted conditional upon a one foot (0.3 m)

reserve being dedicated to the Town and Region along their
respective road frontages.
1.3 The 0. 3 m reserves were placed on the severed parcel, which
was subsequently transferred to the VanDorp's, to ensure no
further building permits would be issued on the severed lands.
However, in 1988, the VanDorp's applied to the Land Division
Committee for approval to sever a retirement lot fronting on
Regional Road # 57 from the 60 ha parcel. The application
was denied as a result of the existence of the 0.3 m reserve
and Regional Council's refusal to remove same. In the spring
of 1989 the VanDorp's approached Town Council with a similar
request to lift the 0. 3 m reserve along Concession Road 7,
their southern boundary (Part 10, 1OR-1118) . Council approved
the request at their meeting of July 11, 1989 in effect
allowing further access and building permit ability to the
subject property. The VanDorp's received Land Division
Committee approval for the creation of a retirement lot on
November 25, 1991.
2 . COMMENTS
2. 1 The request before Council at this time is to have the
remaining 0.3 m reserve on Lettner Road (Part 3, IOR-1118)
conveyed to the VanDorp's. Part 3 of 1OR-1118 is on the west
side of Lettner Road at the eastern boundary of the VanDorp's
property. Public Works Department Staff have reviewed the i
issue of access to the site and have no objection to the
removal of the 0.3 m reserve, however they note any future
access points are subject to their approval and permit
issuance as per Town policy.

the 0. 3 m reserve along Concession Road 7, to the VanDorp's,
they now have clear access to the land and may obtain further
building permit or land severance in accordance with the
Durham Region Official Plan policies and the Town's Zoning By-
law. Therefore the necessity of a 0.3 m reserve along Lettner
Road is now irrelevant. In consideration of these comments,
Staff have no objection to the transfer of part 3, IOR-1118
to the VanDorp's at no cost to the Town.
