THAT Report WD-31-95 be received; 2 . THAT the request by Wolfgang Hryciuk, 2460 Concession Road 8, Haydon, to extend and open Maple Street in the Hamlet of Haydon for a distance of approximately 210 metres ( 689 ft) in accordance with Town Policy be approved subject to the applicant satisfying all conditions of the Municipality, financial and otherwise; 3 . THAT the Mayor and Clerk be authorized to execute an agreement between Wolfgang Hryciuk and the Municipality of Clarington to allow Mr. Hryciuk to construct the extension of Maple Street for approximately 210 metres (689 ft) in accordance with the i Municipal Standard for Road Construction (Attachment No. 2) and the conditions set out in the agreement which is Schedule 'A' to the proposed by-law (Attachment No. 3) ; 4 . THAT Mr. Hryciuk, the applicant, and Mr. Glenn Genge, the applicant's consultant, Greer Galloway Group Inc . , and the property owners on Maple Street (Attachment No. 4) be advised of Council 's decision. REPORT 1.0 ATTACHMENTS i No. 1: Key Map No. 2: Municipal Standard for Road Construction No. 3: Proposed By-law (Schedule 'A' ) No. 4: List and Map of Property Owners on Maple Street No. 5: By-law 75-88 2.0 BACKGROUND 2 . 1 Maple Street in Haydon was constructed by Mr. J. Liptay, in accordance with the agreement between J. Liptay and the Town of Newcastle. By-law 75-88 (as amended) (Attachment No. 5) designated Maple Street as a Class A Public Street. 2 .2 Land Severance - Hryciuk/More Mr. Hryciuk applied for an extension of the Hamlet Secondary Plan and a zoning amendment in 1987 and the applications were approved in 1990. The Land Division Committee dealt with Applications LD 014/93 through LD 017/93 at its meeting on February 13, 1995 . The decision of the Committee was to approve the application subject to several conditions. Condition No. 1 states, "that the applicant must satisfy the requirements of the Municipality of Clarington, financially and otherwise" . In summary, the Public Works Department requires the applicant to j enter into an agreement with the Municipality to construct 1018 i REPORT NO. : WD-31-95 PAGE 3 the unopened portion of Maple Street to Municipal Standards (Attachment No. 2) . 3.0 REVIEW AND COMMENT 3 . 1 Mr. Hryciuk through Glenn Genge, Greer Galloway Group, have proposed the extension of Maple Street and are currently preparing engineering data on the existing Maple Street and the design of the proposed extension. The design will incorporate and deal with as many concerns of the residents as practicable. 3.2 Meeting with Existing Homeowners Staff and a representative from Greer Galloway held an information meeting with several residents presently living on Maple Street and Mill Street on May 31, 1995, at the Haydon Hall for the following reasons: a) residents expressed concerns regarding the present condition of Maple Street and the impact of the future lots on their private property; b) the Public Works Department wished to collect information regarding the proposed design of the extension of the road. The residents were generally in support of the proposal. The Public Works Department agreed to perform some routine maintenance work on the existing road to improve drainage, site distance on the curve and surface treatment. The applicant will be required to contribute to some upgrading of the existing road because it is likely that damage will occur as a result of the proposed construction. The applicant is responsible for all costs associated with the construction of the extension of Maple Street. I' 1019 REPORT NO. : WD-31-95 PAGE 4 3.2 . 1 Summary of Concerns of the Residents Minutes of the Meeting held on May 31st records, in detail, the concerns expressed by residents and are on file in the Public Works Department. The following summarizes the concerns: 1. existing fencing and entrance abutting the Cochrane property (Attachment No. 4) 2. drainage 3 . curve - obstructions caused by foliage 4. tax impact 5 . duration of and time required to complete contract 6 . existing encroachments, hedges 7 . impact on privacy 8. installation of streetlights 9 . safety regarding exiting driveways especially below the curve on Mill St. 10. trees The residents were assured that every effort would be made to resolve their concerns and improve the existing conditions. When a design is available, staff will meet again with the residents and give them an opportunity to view the drawings. 3. 3 Extension of Maple Street Construction of the extension of Maple Street will consist of extending the existing road approximately 210 metres (689 ft) north including a turning circle (Attachment No. 1) . 3 .4 Municipal Act The appropriate by-laws must be passed by Council to establish, lay-out, open and dedicate the extension of Maple Street which requires a public hearing. These by-laws will be presented to Council when the design plans and necessary approvals are complete. 1020 i REPORT NO. : WD-31-95 PAGE 5 4.0 CONCLUSIONS AND RECOMMENDATIONS 4. 1 It is recommended that Council approve the request to extend Maple Street for approximately 210 metres (689 ft) in accordance with Municipal Policy subject to the applicant satisfying the requirements and conditions of the Director of Public Works and that staff proceed to take the necessary action to establish the road as public road allowance.
