THAT Report WD-33-95 be received; 2 . THAT Council authorize the Public Works Department to forward correspondence to D.G. Biddle and Associates Limited dealing with the closure of Old Scugog Road at Regional Road #57 . This correspondence contains the following specific recommendations: A) THAT Public Works commence the procedure to close a portion of Old Scugog Road. Public Works is prepared to close the road and then recommend that the Municipality either sell the Municipally-owned land or close the road to vehicular traffic only; and i B) THAT Public Works proceed to set up an information centre, specifically advising all residents abutting Old Scugog Road from Regional Road #57 to the entrance of Maryleah Court, as well as residents on Andelwood Court and Gaud Gate. Biddle and Associates from the Municipality of Clarington, Public Works Department 2.0 BACKGROUND 2 . 1 Council granted approval to Draft Plan of Subdivision 18T- 87076, Lots 1 to 6, on November 13, 1989 . Conditions of Approval No. 's 18 and 19 were as follows: 18 . That the developer will be responsible for removing the section of Old Scugog Road that connects with Highway #57 and rehabilitate same. 19 . That the developer shall contribute to the costs of reconstructing the unnamed road which connects Regional Road #57 and Old Scugog Road in accordance with Town Policy. (Note: Unnamed road has since been named Gaud Gate. ) 3.0 REVIEW AND COMMENT 3. 1 Recognizing the length of time which has passed since Draft Plan Approval in 1989, the Public Works Department deemed it advisable to inform Council of actions presently being taken i by the Public Works Department. I 4.0 CONCLUSION 4 . 1 The Public Works Department has reviewed the matter with Clarington Planning Department and Durham Region Works Department and conclude that it is appropriate to commence the procedure to close the portion of Old Scugog Road in question. Biddle & Associates Limited Consulting Engineers 96 King Street East Oshawa, Ontario L1H 1B6 Attention: Bob Annaert Dear Sir: RE: CLOSURE OF OLD SCUGOG ROAD AT REGIONAL ROAD #57 FILE NO. D3 . 15. 02 Further to previous meetings and my recent discussions with Mr. Sam Gust, this will confirm that the Public Works Department is prepared to commence the procedure to close a portion of Old Scugog Road. During a previous meeting we discussed the issue of holding an information centre and that all residents abutting Old Scugog Road from Regional Road 57 to the entrance of Maryleah Court and the property owners on Gaud Gate be advised and requested to attend. As discussed with Mr. Gust, it is very advisable to contact the new home owners and at least determine that they are not opposed to the closure of Old Scugog and improvement to Gaud Gate since the changes will directly impact their property. Staff at the Region of Durham are prepared to recommend that the portion of land owned by them be sold. Staff at the Municipality are prepared to recommend that the portion of Old Scugog owned by them be sold. However, the Planning Department have reviewed the two parcels of land and together, the total area does not meet the requirement of land area to qualify for a building permit. Therefore, unless you wish to purchase the lands (both parcels) , the Public Works Department is prepared to recommend that the road be closed to vehicular traffic only and that the applicant be responsible to restore the ditch and make some general aesthetic improvements . Please advise me if your clients wish to purchase the lands or if they are in agreement with making some specified improvements which will be addressed in the development agreement and restoring the ditches in the vicinity of the closed portion of Old Scugog Road.
