THAT Report WD-38-95 be received; and 2 . THAT Council approve the proposed By-law attached to Report WD-38-95, amending By-law 92-116 which provides for the levying of taxes for street lighting services within The Municipality of Clarington. REPORT 1.0 ATTACHMENTS No. 1: Copy of By-law 92-116 which provides for the levying of taxes for street lighting services within The Municipality of Clarington No. 2 : Proposed By-law amending By-law 92-116 I 2.0 BACKGROUND 2. 1 In 1992 By-law 92-116 repealed By-law 84-20 which provided for the levying of taxes for street lighting services within The Municipality of Clarington I 1001 � RECYCLED LA11C REAPER iH iSi PRftMED M RECYCLED PAPER REPORT NO. : WD-38-95 PAGE 2 2 .2 By-law 92-116 (Attachment No. 1) was passed and defined the external limits of lighting areas for taxation purposes. Those lighting areas include all those properties which are thirty (30) metres or less from the last street light on the street. The by-law states the rate to be charged for rural areas should include those areas which are under the jurisdiction of Ontario Hydro, including Courtice, and that the rate to be charged for urban areas should include those areas which are under the jurisdiction of the Clarington Hydro Electric Commission. 3.0 REVIEW AND COMIENT 3. 1 During the past three (3) years the external boundaries, which were defined in Schedules "A" and "B" of By-law 92-116, have expanded due to residential development, mainly in Bowmanville and Courtice. 3.2 Due to the expanded street lighting service areas, it is now appropriate to revise the external boundaries defined in Schedules "A" and "B" of By-law 92-116. NOW THEREFORE the Council of The Corporation of the Town of Newcastle enacts as follows: 1. By-law 84-20, as amondod, is horoby amondod byt (a) deleting the first four lines of section 1 of the aforesaid By-law 84-20 and replacing them with the following: That all properties shown on the last revised assessment roll of The Corporation of The Town of Newcastle on the date in each year on which $ by- law is passed to impose a special tax for street lighting which is located within a street lighting area shown on a map contained in either Schedule "A" or Schedule "B" attached to and forming part of this By-law and all properties which are not shown on such a map but any portion of which, in fact, is located within thirty meters from a street light within any such street lighting area shall so that section 1 as amended will read: That all properties shown on the last revised assessment roll of the Town.of Newcastle on the date in each year on which a by-law is passed to impose a special tax for street lighting which is located within a street lighting area shown on a map contained in either Schedule "A" or Schedule "B; attached to and forming part of this By-law and all properties which are not shown on such a map but any portion of which in fact is located within thirty meters from a street light within any such street lighting area shall be taxed for 100% for the capital and annual operating costs of the Town of the street lighting services provided within a street lighting area.
