HomeMy WebLinkAboutWD-42-95 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON REPORT Meeting: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE File# Date: OCTOBER 2, 1995 Res' #& Ry-Law# Report#: File #: _C�D2.29w003 Subject: REMI COURT SUBDIVISION, PLAN 1OM-828, NEWCASTLE VILLAGE, 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY—LAW' , ROADS, STREET LIGHTS AND OTHER RELATED WORKS Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-42-95 be received; 2 . THAT the Director of Public Works be authorized to issue a 'Certificate of Acceptance' for the roads, street lights and other related Works, constructed within Plan 1OM-828; and 3. THAT Council approve the proposed By-law attached to Report WD-42-95 assuming certain streets within Plan 1OM-828 as public highways. REPORT 1.0 ATTACHMENTS No. 1: Key Map No. 2 : Proposed Road Dedication By-law for Plan 1OM-828 2.0 BACKGROUND 2 . 1 The former Town of Newcastle entered into a subdivision agreement on April 11, 1989, with Foster Creek Developments 1001 iws rEureo wnewcco nnneu REPORT NO. : WD-42-95 PAGE 2 Ltd. to develop lands by plan of subdivision, located in Newcastle Village and described as Plan 10M-828 (Attachment No. 1 ) . The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system, and street lights, hereinafter referred to as the 'Works' . 2.2 The subdivision agreement provides for the separation of the Works into two (2) stages: (a) Storm Sewer System, and (b) Roads and Above Ground Services. 2. 3 Council previously approved Report WD-35-92, which authorized the issuance of a 'Certificate of Acceptance' for the Storm Sewer System for Plan 1OM-828. 2.4 The Road and Above Ground Services were completed and a 'Certificate of Completion' was issued dated October 31, 1992. The Works were placed on a two (2) year maintenance period which expired on October 31, 1994 . These Works were subsequently inspected and all deficiencies have now been rectified to the satisfaction of the Director of Public Works. I 2 .5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services. The subdivision agreement provides for this certificate to be issued by the Director of Public Works, subject to the approval of Council. I i 2 .6 Further to the issuance of a 'Certificate of Acceptance' , a by-law is required to permit the Municipality to assume 1OX12 REPORT NO. : WD-42-95 PAGE 3 certain streets within Plan 1OM-828 as public highways. THAT the streets and street widening Block 37, described in Registered Plan 1OM-828 (described in Schedule "A" attached hereto and forming part of this By-law) all being in the former Town of Newcastle, now known as the Municipality of Clarington, in the Regional Municipality of Durham, are hereby accepted by The Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use. BY-LAW read a first and second time this 16th day of October, 1995. BY-LAW read a third time and finally passed this 16th day of October, 1995.
