Subject: APPLEWOOD ESTATES SUBDIVISION, PLAN 1OM-793, BOWMANVILLE,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW',
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-44-95 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Plan 1OM-793; and
3. THAT Council approve the proposed By-law attached to Report
WD-44-95 assuming certain streets within Plan 1OM-793 as
public highways.

2.0 BACKGROUND
2 . 1 The former Town of Newcastle entered into a subdivision
agreement on August 18, 1987, with Rossert Taunus Construction
Ltd. to develop lands by plan of subdivision, located in
Bowmanville and described as Plan 1OM-793 (Attachment No. 1) .

The agreement required the developer to construct all
roadworks, including hot-mix paving, curb and gutter, drainage
system, and street lights, hereinafter referred to as the
'Works' .
2 .2 The Initial and Final Stages of Road Construction were
completed and a 'Certificate of Completion' was issued dated
December 30, 1991. The Works were placed on a two (2) year

maintenance period which expired on December 30, 1993;
however, the outstanding deficiencies were not rectified until
recently. These works have now been rectified to the
satisfaction of the Director of Public Works.
2 .3 It is now appropriate to issue a 'Certificate of Acceptance'
for the Roads and Above Ground Services. The subdivision
agreement provides for this certificate to be issued by the
Director of Public Works, subject to the approval of Council.
2 .4 Further to the issuance of a 'Certificate of Acceptance' , a
by-law is required to permit the Municipality to assume
certain streets within Plan 1OM-793 as public highways

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 95-
Being a By-law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follows:
1. THAT the streets and street widening Block 13 and Block 14,
described in Registered Plan 1OM-793 (described in Schedule
"A" attached hereto and forming part of this By-law) all being
in the former Town of Newcastle, now known as the Municipality
of Clarington, in the Regional Municipality of Durham, are
hereby accepted by The Corporation of the Municipality of
Clarington as public highways, and assumed by the said
Corporation for public use.
BY-LAW read a first and second time this 16th day of October, 1995.
