CONSUMERS GAS EASEMENT THROUGH
Subject: PETER'S PIKE PARKETTE
LOCATED BETWEEN PETER'S PIKE AND MILL STREET, ORONO
Recommendations:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. THAT Report WD-57-95 be received;
2. THAT the following actions of the Director of Public Works be confirmed:
a) Based on a majority poll of Council, Consumers Gas was given
permission to start work on Tuesday, November 22, 1995, within
Peter's Pike Parkette; and
b) Based on the same majority poll of Council, the Municipality of
Clarington granted to Consumers Gas an easement through Peter's Pike
Parkette, as depicted on the attached plan (Attachment No. 2) , for
the sum of $1,575.00 as compensation for the easement;
3. THAT Consumers Gas prepare and place on title a registered plan which
accurately depicts the limit of the easement;

4. THAT the Consumers Gas payment to the Municipality of $1,575.00 for the
easement be credited to the Parkland Reserve Account 1110-166-X;
5. THAT Consumers Gas pay all legal and other expenses involved in the
transaction;
6. THAT the proposed By-law attached to Report WD-57-95 (Attachment No. 3) be
passed authorizing the Mayor and Clerk to execute the agreement;
7. THAT the solicitor for Clarington be directed to take the necessary steps
to complete the transaction; and

8. THAT Mr. C. F. Clark, General Supervisor, Consumers Gas, be notified of
Council's decision.

2.0 BACKGROUND
2.1 Clarington Public Works Department is in receipt of a letter and plan from
Consumers Gas requesting an easement for services through Peter's Pike
Parkette, Orono (Attachment No. 2) . The easement will allow the extension
of natural gas to the northern limits of Orono.
2.0 PRECEDENCE
2.1 Two (2) easements have been given across parkland in recent years. In
July of 1989, Council approved the sale of a sanitary sewer easement to
the Regional Municipality of Durham through the undeveloped Courtice
Community Park. Based on an appraisal report, a 0.60 ha (1.49 acre)
easement was sold to the Regional Municipality of Durham for $70,000.
2.2 In April, 1992, Council approved the sale of a connecting easement in
Courtice Community Park to Halcorp Holdings Limited to service their
proposed Nantucket Condominiums. To avoid the cost of an appraisal
report, it was approved by Council to use the previous appraisal as the
basis for determining the value for this easement.
2.3 Consumers Gas requested an easement approximately 3 m wide and 45 m long.
Similar to the previous situation, the small easement requested did not
warrant the expense of a land appraisal, and the same alternate approach
was taken. Based upon the appraisal prepared for Courtice Community Park,
it was recommended that the requested easement of 0.0135 ha would be sold
for a price of $1,575.00. This recommendation was supported by a majority
poll of Council on Monday, November 21, 1995.

3.0 COMMENTS
3.1 Peter's Pike Parkette is a lineal park connecting Mill Street to Peter's
Pike (Attachment No. 1) . Other than a small playground, the parkette
functions as a walkway and an access route between streets. The potential
uses of the parkette are limited and the selling of the easement will not
infringe upon the parkette function.
3.2 No alternate route is readily available, and, for this reason, it was our
recommendation that the easement be sold as requested.

BY-LAW NO. 95-
Being a By-law to authorize the entering into
of an Agreement between Consumers Gas and The
Corporation of the Municipality of Clarington
for an easement through Peter's Pike Parkette
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of The Corporation of The Municipality of Clarington,
and seal with the Corporation's Seal, an Agreement between
Consumers Gas and said Corporation, which is attached hereto
and marked Schedule "A".
BY-LAW read a first and second time this th day of December,
