Subject: COURTICE HEIGHTS SOUTH, PHASES 5 AND 6,
PLANS 1OM-820 AND 1OM-821,
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ,
ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS
AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-4-93 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage
system, street lights and other related Works, constructed
within Plans 1OM-820 and 1OM-821; and
3 . THAT Council approve the by-law attached to Report WD-4-93
assuming the streets within Plans 1OM-820 and 1OM-821 as
public highways .

2.0 BACKGROUND
2 . 1 On May 22, 19 8 3, the Town entered into a subdivision agreement
with Claret Investments Limited and Rexgate Holdings Limited
to develop lands by plan of subdivision, located in Courtice
and described as Plans 1OM-820 and 1OM-821 (Attachment No. 1) .
The agreement required the developer to construct all
roadworks, including hot-mix paving, curb and gutter,
sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works ' .
2 .2 This particular subdivision agreement does not permit the
separation of the Works into Initial and Final Stages .
Instead, it provides for the issuance of a single 'Certificate
of Completion' , to be issued upon the completion of all of the
Works .
2 . 3 The final stage Works for Plans 1OM-820 and 1OM-821 were
completed simultaneously and a 'Certificate of Completion' was
issued dated October 31, 1990 . The Works were placed on a two
(2) year maintenance period which expired October 31, 1992 .
2 .4 All of the Works were subsequently re-inspected and were found
to be satisfactory.

2 .5 It is now appropriate to issue a 'Certificate of Acceptance'
for all of the Works . The subdivision agreement provides for
this certificate to be issued by the Director of Public Works,
subject to the approval of Council.

2 . 6 Further to the issuance of a "Certificate of Acceptance' , a
by-law is required to permit the Town to assume all the
streets within Plans:
1OM-820, (Attachment No. 2)

BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. THAT the lands described as Block 142, Plan 1OM-820, in the
Town of Newcastle, Regional Municipality of Durham, are hereby
established, laid out and dedicated as public highways.
2. THAT the reserve blocks, streets and street widenings in
Registered Plan 1OM-820 as described in Schedule "A" attached
hereto and forming part of this By-law, all being in the Town
of Newcastle, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for
public use.
BY-LAW read a first and second time this day of 1993.
BY-LAW read a third time and finally passed this day of
1993.

BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of

1OM-821, in the Town of Newcastle, Regional Municipality of
Durham, are hereby established, laid out and dedicated as
public highways.
2. THAT the reserve blocks, streets and street widenings in
Registered Plan 1OM-821 as described in Schedule "A" attached
hereto and forming part of this By-law, all being in the Town
of Newcastle, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for
public use.
