'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW' ,
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-6-93 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Plans 10M-818, 1OM-819
and 1OM-825; and
3 . THAT Council approve the by-laws attached to Report WD-6-93
assuming the streets within Plans IOM-818, 1OM-819 and 1OM-825
as public highways .

2.0 BACKGROUND
2 . 1 On November 9 , 1988, the Town entered into a subdivision
agreement with 317980 Ontario Limited to develop lands by plan
of subdivision, located in Newcastle Village and described as
Plans 1OM-818, 1OM-819 and 10M-825 (Attachment No. 1) . The
agreement required the developer to construct all roadworks,
including hot-mix paving, curb and gutter, sidewalks,
boulevard sodding and street trees, a storm drainage system
and street lights., hereinafter referred to as the 'Works ' .
2 . 2 The subdivision agreement provides for the separation of the
Works into two (2) stages:
(a) Storm Sewer System and;
(b) Roads and Above Ground Services .
2 . 3 Council previously approved Report WD-88-91, which authorized
the issuance of a 'Certificate of Acceptance' for the Storm
Sewer System.
2 .4 The Roads and Above Ground Services were completed and a
'Certificate of Completion' was issued dated August 31, 1990. ,
The Works were placed on a two year maintenance period which
expired on August 31, 1992 . These Works were subsequently
inspected and found to be satisfactory.
2 .5 It is now appropriate to issue a 'Certificate of Acceptance'
for the Roads and Above Ground Services . The subdivision
agreement provides for this certificate to be issued by
the Director of Public Works, subject to the approval of
Council.

2 . 6 Further to the issuance of a "Certificate of Acceptance' , a
by-law is required to permit the Town to assume all the
streets within Plans 10M-818, 1OM-819 and 1OM-825 as public
highways . (Attachment No.s' 2, 3 and 4) .

BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. THAT the lands described as Blocks 53, 54 and 55, Plan 1OM-
818, in the Town of Newcastle, Regional Municipality of
Durham, are hereby established, laid out and dedicated as
public highways.
2. THAT the reserve blocks, streets and street widenings in
Registered Plan 1OM-818 as described in Schedule "A" attached
hereto and forming part of this By-law, all being in the Town
of Newcastle, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for
public use.
3. THAT the Clerk be authorized to apply to the Land Registrar of
the Land Titles Division of Durham (No. 40) to have the
Corporation of the Town of Newcastle shown as the owner of the
streets and street widening blocks in Registered Plan 1OM-818.
BY-LAW read a first and second time this day of 1993.
BY-LAW read a third time and finally passed this day of
1993.

within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:

Town of Newcastle, Regional Municipality of Durham, are hereby
established, laid out and dedicated as public highways.
2. THAT the reserve blocks and streets in Registered Plan 1OM-819
as described in Schedule "A" attached hereto and forming part
of this By-law, all being in the Town of Newcastle, in the
Regional Municipality of Durham, are hereby accepted by the

Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of

Schedule "A" attached hereto and forming part of this By-law,
all being in the Town of Newcastle, in the Regional
Municipality of Durham, are hereby accepted by the Corporation
of the Town of Newcastle as public highways, and assumed by
the said Corporation for public use.
2. THAT the Clerk be authorized to apply to the Land Registrar of
the Land Titles Division of Durham (No. 40) to have the
Corporation of the Town of Newcastle shown as the owner of the
streets in Registered Plan 1OM-825.
