'CERTIFICATE OF ACCEPTANCE, AND 'ASSUMPTION BY-LAW' ,
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-7-93 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Phase 1A of Plan 1OM-
824; and
3 . THAT Council approve the by-law attached to Report WD-7-93
assuming certain streets within Plan 1OM-824 as public
highways .

2 . 0 BACKGROUND
2 . 1 On March 8, 1989, the Town entered into a subdivision
agreement with Kiddicorp Investments Ltd. , to develop lands by
plan of subdivision, located in Courtice and described as Plan
10M-824, Phases lA and 1B (Attachment No. 1) . The agreement
required the developer to construct all roadworks, including
hot-mix paving, curb and gutter, sidewalks, boulevard sodding
and street trees, a storm drainage system and street lights,
hereinafter referred to as the 'Works ' .
2 . 2 The subdivision agreement provides for the separation of the
Works into two (2) stages:
(a) Storm Sewer System, and
(b) Roads and Above Ground Services .
2 . 3 Council previously a pp roved report WD-88-91, which
authorized
the issuance of a 'Certificate of Acceptance' for the Storm
Sewer System for plan 10M-824 (Phases 1A and 1B) .
2 . 4 The Roads and Above Ground Services for Phase lA were
completed and a 'Certificate of Completion' was issued dated

October 24, 1990 . The Works were placed on a two year
maintenance period which expired on October 24, 1992 . These
Works were subsequently inspected and found to be
satisfactory.
2 .5 It is now appropriate to issue a 'Certificate of Acceptance'
for the Roads and Above Ground Services for Phase lA
only. The subdivision agreement provides for this
certificate to be issued by the Director of Public Works,
subject to the approval of Council.

2 . 6 Further to the issuance of a "Certificate of Acceptance' , a
by-law is required to permit the Town to assume certain
streets within Plan 1OM-824 as public highways . (Attachment
No. 2 ) .

KEY MAP WD-7-93
THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Town of Newcastle as public
highways in the Town of Newcastle.
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. THAT the lands described as Blocks 307 and 308, Plan 1OM-824,
in the Town of Newcastle, Regional Municipality of Durham, are
hereby established, laid out and dedicated as public highways.
2. THAT the reserve blocks, streets and street widening in
Registered Plan 1OM-824 as described in Schedule "A" attached
hereto and forming part of this By-law, all being in the Town
of Newcastle, in the Regional Municipality of Durham, are
hereby accepted by the Corporation of the Town of Newcastle as
public highways, and assumed by the said Corporation for
public use.
BY-LAW read a first and second time this day of 1993.
BY-LAW read a third time and finally passed this day of
1993.
