Subject: SAFETY CONCERNS AT 4272 LAKESHORE ROAD, NEWCASTLE,
WILLIAM PANTAIS PRIVATE FARM CROSSING AT
MILE 153.10 CP RAIL BELLEVILLE SUBDIVISION AND
MILEAGE 281.77 CN RAIL KINGSTON SUBDIVISION
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-13-93 be received for information.

2.0 BACKGROUND
2 . 1 At a regular meeting held on July 13, 1992, Council passed the
following Resolutions:
#C-468-92
"THAT the correspondence dated June 26, 1992,
from C.F. Stephens, Regional Engineer, Ontario
Region, Transport Canada, regarding safety
concerns, Mr. William Pantals Farm Crossing,
be received for information"

submitted to the General Purpose and Administration
Committee. "
2 .2 Due to limited visibility at Mr. Panta's private farm
crossing, Transport Canada instituted a 70 mph slow order for
east bound trains . This slow order would only be lifted if
the crossing could be improved by either removing an earth
embankment in the northwest quadrant or closing the crossing
permanently by providing a new access road to the east.
3.0 REVIEW AND COMMENT
3 . 1 Mr. Don Smith of Durham Appraisal Services Inc. , was retained
to confirm the ownership of the land to the east of Mr. Panta.
The owners were consulted to see if they were interested in
having their land severed into two (2) parcels with a 66 foot
wide access road recorded as either an easement or outright
sale in the name of Mr. Panta.
3 .2 During discussions between Mr. Smith and the property owners
it was clearly indicated that they were not interested in the
Towns proposal. They were only interested in having their
land severed into three distinct separate lots. Accordingly
they were advised that there would be no future proposal and
that this matter is now terminated.
3 . 3 During October of 1992, C.F. Stephens of Transport Canada was
advised that the owners to the east of Mr. Panta were not
receptive to the Towns proposal and that no further action was
being taken.
3 .4 During February of 1993, the earth embankment was removed by
the rail authorities to improve safety at Mr. Panta's private
crossing. The slow order was removed by Transport Canada to
reflect the improved conditions at this crossing.

3.5 Although the present safety concern has been eliminated
Canadian National Railway has initiated its own negotiations
with the land owner to purchase the 66 foot strip of land in
the railway's name. If successful the new access road will
eliminate the need of the level crossing on the north side of
Mr. Panta's property. Removal of the existing private farm
crossing will reduce the railways maintenance costs and
eliminate any safety concerns which may arise in the future.
3 .6 Mr. Panta has been advised that the Town will not be taking
any further action on this matter.
4.0 CONCLUSIONS
4 . 1 From the above, it is concluded that this safety matter has
been resolved and that no further action should be taken by
the Town of Newcastle.

RE: . SAFETY CONCERNS, MR. WILLIAM PANTA'S FARM
CROSSING - 4272 LAKESHORE ROAD IN THE TOWN OF
NEWCASTLE, ONTARIO, AT MILEAGE 281.77 KINGSTON
SUBDIVISION CN RAIL AND 153 . 10 BELLEVILLE
SUBDIVISION CP RAIL.
Reference is made to the recent site meeting on June 19,
1992 , between representatives of the.town, railways, landowner
and this office concerning the options available in order to
improve safety at this crossing.
It should be made clear that prior to this meeting and
acting in the interest of safety, CN Rail instituted a 70 mph.
slow order for east bound trains. The restriction was
necessary due to an earth embankment in the northwest
quadrant. Presently, the sight lines at CP Rail 's crossing
are becoming marginal due to the recent growth of tall grass.
CP Rail indicated that this small area would be corrected
2before any safety problem arose.
Mr. Panta suggested that both railways and with the
assistance of the town may wish to consider a relocation of
his farm crossing so that he accesses Lakeshore Road south of
the tracks thus eliminating any need for a crossing.

The Canadian National Railways agreed with this
suggestion in that monies allocated for the removal of earth
in the northwest quadrant and future maintenance costs could
be better diverted to the relocation of this farm crossing.
The CP Rail representative also acknowledged the fact that
they would benefit from the crossing relocation both
financially- and operationally.
At this point, it was the opinion of those concerned that
the railways should evaluate the finanicial benefit obtained
by eliminating this farm crossing. Based on this proposal,
the town is requested to contact the owners of the land
blocking access from Mr. Panta's property eastward to the
Lakeshore Road to determine if they would be willing to accept
an easement that would permit the construction of the proposed
access or what terms they might accept. The results of this
contact to be supplied to the railways. CP Rail to evaluate
the closing of the farm crossing of their line and supply the
other parties with their comments. Based on these inputs, CN
Rail is requested to review the relocation concept and provide
the parties with their findings.
I trust this approach will expedite a final solution to
the safety problems associated with this crossing.
