Report#: File#: By-Law# Subject: PROPOSED AMENDMENTS TO CONSOLIDATED TRAFFIC BY-LAW 91-58 REGULATORY SPEED ZONES Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report WD-15-93 be received; and 2 . THAT in response to the public's concerns about safety, regulatory speed zones be reduced from 80 km/hr to 60 km/hr on the following roads : a) Cobbledick Road from Highway No. 2 southerly; b) Best Road from Regional Road 4 to Concession Road 7; c) Squair Road from Concession Road 4 to Concession Road 5; d) Trulls Road from 1200 metres south'of Regional Road 4 to Pebblestone Road; 3 . THAT Council pass the proposed By-law attached to Report WD- -93; and 4 . THAT Mr. Randy Ferguson, Ms Betty Richards, Police Constable D. McFeeters and Mr. Gary Shmyr be advised of Council's decision and be provided with a copy of Report WD-15-93. No. 4 : Proposed By-law Amendment to Schedule XX of By-law 91-58 . 2.0 BACKGROUND 2 . 1 At a meeting held on September 14, 1992, the Council of the Town of Newcastle passed Resolution #C-585-92: "THAT the correspondence dated August 19, 1992, from Randy L. Ferguson, requesting signage on Cobbledick Road be received; THAT the correspondence be referred to the Director of Public Works for appropriate action; and THAT Randy L. Ferguson be advised of Council 's decision. " 2 .2 This speed reduction request has been combined with similar requests and are being submitted in a single report for the sake of efficiency. 2 .3 Authority of Council to Regulate Speed Excerpt from Highway Traffic Act, Chapter 198 109 : " ( 1) No person shall drive a motor vehicle at a rate of speed greater than, a) 80 kilometres per hour, (i) on a highway not within a city, town, village, police village or built-up area or, I REPORT NO. : WD-15-93 PAGE 3 b) Subject to clause (a) 50 kilometres per hour on a highway within a city, town, village, police village or built-up area; (2) The council of a municipality may, for motor vehicles driven on a highway or a portion of a highway under its jurisdiction, by by-law prescribe a rate or speed different from the rate set out in subsection (1) . (a) The rate of speed prescribed under section (2) shall be 40, 50, 60, 70, 80, 90 or 100 kilometres per hour" . 3.0 REVIEW AND COMMENT 3. 1 Cobbledick Road, from Kings Highway #2 Southerly This 1 km section of roadway is built to rural standards, has no sidewalks or streetlights and is not within a recognized hamlet. This section of road is used as an access/exit by the residents of Wilmot Creek Development. The proposed by-law (Attachment No. 4) provides for the reduction of the regulatory speed from 80 km per hour to 60 km per hour. The area has one ( 1) home on the east side and six (6) homes on the west side which would benefit from a posted regulatory speed of 60 km/hr. The proposed by-law (Attachment No. 4) will reduce the regulatory speed from 80 km/hr to 60 km/hr. Mr Ferguson has been informed that: i i (a) The requested "Watch For Children" signs can not be installed as there is no recognized playground on the j street; and (b) Speed signs will be installed only after Council has passed the appropriate by-law to reduce the speed from 80 REPORT NO. : WD-15-93 PAGE 4 km per hour to 60 km per hour. 3.2 Best Road, from Regional Road 4 to Concession Road 7 A request was received by telephone from Ms Betty Richards for a speed reduction in this section of road. This 2 . 1 km section of roadway is built to rural standards, has no sidewalks or streetlights and is not within a recognized hamlet. There are three (3) homes on the east side and thirteen ( 13) homes on the. west side. Of the sixteen (16) homes, four (4) have visibility problems caused by the rolling nature of the road. The four (4) driveways have visibility restricted to 80 metres (260 feet) . The proposed by-law (Attachment No. 4) will reduce the regulatory speed from 80 km/hr to 60 km/hr to improve safety at the driveways . Samples of visibility required for safe stopping distances: Vision - Distance in Metres Recommended Speed km/hr 60 50 85 60 110 70 135 80 3. 3 Sauair Road from Concession Road 4 to Concession Road 5 A written request was received from Police Constable McFeeters for a speed reduction on this section of road. This 1. 8 km section of roadway is built to rural standards, has no i sidewalks or streetlights and is not within a recognized hamlet. The area is presently posted at 60 km/hr for a distance of 450 metres ( 1475 feet) at the south portion and 80 km/hr at the north portion. The north portion has thirteen ( 13) homes (6 on the east side, 7 on the west side) and is also characterized by a curve at a box culvert which was the scene of an accident in 1991. Advisory signing was installed in 1991 to improve safety. The new regulatory speed signs will be posted to emphasize the existence of residential driveways . The proposed by-law (Attachment No. 4) will reduce REPORT NO. : WD-15-93 PAGE 5 the regulatory speed from 80 km/hr to 60 km/hr for the north portion of Squair Road. 3 .4 Trulls Road, 1200 Metres South of Taunton Road to Pebblestone Road A verbal request was received from Mr. Gary Shmyr for a speed reduction on this section of Trulls Road. This 1 km section of roadway is built to rural standards, has no sidewalks or streetlights and is not within a recognized hamlet. This is a small area connecting a 50 km/hr zone in Mitchell Corners and a 60 km/hr zone south of Pebblestone Road. The road section with two (2) homes on the west side and one ( 1) on the east side is characterized by a steep hill with an intersection at the bottom. Durham Regional Police have expressed their preference for a continuous 60 km per hour speed zone in this area. The hill has been the scene of a few accidents over the past several years including a school bus in January, 1993. The proposed by-law (Attachment No. 4) would reduce the speed from 80 km/hr to 60 km/hr. I 4.0 CONCLUSIONS 4 . 1 From the above, it is concluded that reduced regulatory speed zones on these roadways will improve safety for motorists and residents alike and are consistent with other speed zoning i areas within the Town. i Respectfully submitted, Recommended for presentation to the Committee, Walter A. Please let me explain. My family, including three children under the age of five (with another one on the way) live at 1926 Cobbledick Road, Newcastle, Ontario. As you are no doubt aware this road runs from Highway # 2 , south, to the service road entering the Wilmot Creek retirement park. We have lived here for four years now, and it seems the traffic along our road is increasing in both volume and in speed, to the point the road is becoming dangerous . We have had a couple of close calls this summer with our children, this is why I am writing. Currently along this road there is no speed limit posted nor "watch for children" signs. What I was wondering is if you could assist me with the necessary steps to bring this to the attention of the appropriate parties to hopefully rectify this situation. NO ;'_ CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 93- Being a by-law to amend By-law 91-58 being a By-law to Regulate Traffic on Highways, Municipal and Private Property in the Town of Newcastle WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to amend By-law 91-58; NOW THEREFORE the Council of the Corporation of the Town of Newcastle enacts as follows: 1) Schedule XX "MAXIMUM RATE OF SPEED - 60 KILOMETRES PER HOUR" of By-law 91-58 is amended by; A) deleting the following reference: Squair Road Concession Road 4 450 m north of (Clarke) Concession Road 4 and B) adding the following reference: Column 1 Column 2 Column 3 Highway From To Squair Road Concession Road 4 Concession Road 5 (Clarke) Cobbledick Road Kings Highway 2 South limit of (Clarke) Cobbledick Road Best Road Durham Regional Concession Road 7 (Clarke) Road 4 Trulls Road 1200 m south of Pebblestone Road (Darlington) Durham Regional Road 4 2. This By-law shall come into Force on the date that it is approved by the Council of the Regional Municipality of Durham and when signs to the effect are erected.
