THAT Report WD-16-93 be received; 2 . THAT the quotation from Novacor Construction Company Ltd. for additional work on King Street East in the amount of $88,425 .50 be accepted; 3 . THAT the additional cost of $4,478 . 10 over and above the funds provided for in the approved 1993 Budget be obtained from the Development Charge Fund; and 4 . THAT the attached By-law (Attachment No. 3) authorizing a purchase order to be issued to Novacor Construction Ltd. be approved. REPORT 1.0 ATTACHMENTS No. 1: Correspondence dated March 12, 1993, from Totten Sims Hubicki Associates No. 2 : Project Detail Sheet from the approved 1993 Capital Budget No. 3: Proposed By-law REPORT NO. : WD-16-93 PAGE 2 2 . 0 BACKGROUND AND COMMENT 2 . 1 In 1992, the Town entered into a contract with Novacor Construction Company Ltd. for the reconstruction of King Street East from Simpson Avenue to the West Branch of the Soper Creek and Mearns Avenue from King Street East to Orchard Park Drive. The contract is a two year contract, with completion in 1993. 2 .2 At a meeting held on March 23, 1992, Council passed Resolution #C-118-92 and #C-119-92 as follows: "THAT the correspondence received from Rev. Jake Binnema, regarding several recommendations contained in the CAUSE Report, be received for information and that it be referred to the Director of Public Works for review and preparation of a report back to the General Purpose and Administration Committee regarding the possibility of the installation of a sidewalk and/or path from the Bowmanville Mall to the Marantha Christian Reformed Church. " 2 .3 The Town's contract for the reconstruction of King Street East terminated 95 meters west of the East Branch of Soper Creek. The Ministry of Transportation's contract for the .reconstruction of Highway 2 started at Haines Street and ended at the west limit of Newcastle Village. This left a section of King Street/Highway 2, which was not considered either by the Town or the Ministry of Transportation for reconstruction or resurfacing. 2 .4 During the discussion with the Ministry of Transportation regarding the construction of a sidewalk on this section of road (as requested by Reverend Jake Binnema) , the Ministry asked the Town to extend our contract with Novacor Construction Company Ltd. to resurface this section of roadway. The items required for the construction of the sidewalk and for the resurfacing of King Street East are IJ90 REPORT NO. : WD-16-93 PAGE 3 listed on Attachment No. 1. The Town's share of this work is $48,278 . 10. 2 .5 The prices quoted are the same as those in the original contract, where applicable. The prices for the other items were negotiated. Council may be concerned that we are not in a very good position to negotiate prices with the contractor. All contracts contain a provision to carry out extra work on a time and material basis for those items for which a reasonable price cannot be negotiated. 2 . 6 At the time of preparing the 1993 Budget, the estimated cost of the project was $88,000 with a cost to the Town of $43,800. The Town's share of the cost, based on prices from the contractor, is $48,278. 10, a difference of $4,478. 10 . It is recommended that the additional cost be financed from the Development Charge Fund. 2 . 7 This report has been reviewed with the Treasurer, who concurs with the recommendations. NOW THEREFORE, the Council of The Corporation of the Town of Newcastle enacts as follows: 1. THAT the Purchasing and Supply Agent be authorized to issue a Purchase Order to Novacor Construction Company Ltd. in the amount of $88,425.50 for an extension to Contract NW 92-28. 2. THAT the Purchase Order to Novacor Construction Company Ltd. , attached hereto as Schedule "A", form part of this By-law. BY-LAW read a first and second time this 13th day of April, 1993.
