THAT Addendum to Report WD-36-93 be received; 2 . THAT Report WD-36-93 be lifted from the table and approved; 3 . THAT, for the benefit of future Councils, let the record show that it is the intent of this Council that, if someday in the future sidewalks are to be built on Edsall and Rehder Avenues, both within Plan 18T-87005 and external to the Plan, the cost of the sidewalks would be financed by the cash deposits held in reserve and from the General Tax Levy and not be financed under the Local Improvement Act; and 4 . THAT in addition to advising Mr. Rick Spicer and Mr. R. C. Annaert as recommended in Report WD-36-93, all residents of Edsall and Rehder Avenues be advised of Council's decision. REPORT 1.0 ATTACHMENTS No. 1: Report WD-36-93 No. 2 : Correspondence dated September 13, 1993, from Iain Alexander, 35 Rehder Avenue, Bowmanville REPORT NO. : .ADDENDUM TO WD-36-93 PAGE 2 No. 3: Copy of Register kept at the Information Centre held on Wednesday, September 22, 1993 . 2.0 BACKGROUND 2 . 1 At a meeting of the General Purpose and Administration Committee held on September 20, 1993, direction was given that an Information Centre be held, FORTHWITH, with all of the residents on Edsall and Rehder Avenues to discuss the issue of construction/non-construction of sidewalks. 3.0 REVIEW AND COMMENTS 3. 1 Letter Delivered On Monday evening and Tuesday letters were hand delivered to all residents on Edsall and Rehder Avenues, both within Plan 18T-87005 and external to the Plan, advising them of an Information Centre to be held during the hours of 4:00 to 7:00 p.m. on Wednesday, September 22, 1993 . 3.2 Good Attendance There was an excellent turn-out of residents at the Information Centre. Councillor O'Toole and the Director of Public Works were available to answer questions and to discuss the concerns of the residents. 3 . 3 Lengthy Discussion I Discussion with the residents took place non-stop from 4:00 p.m. to about 6 :45 p.m. The majority of the residents in attendance from Edsall and Rehder Avenues, external to the subdivision, indicated that they were strongly opposed to the construction of sidewalks in front of their homes, either now or in the future. The residents within the Approved Plan of Subdivision still wanting sidewalks stated that they had paid for the sidewalk in the price of their lot and/or their home. REPORT NO. : ADDENDUM TO WD-36-93 PAGE 3 3 .4 Near the end of the meeting Michael Haskins and Iain Alexander, who are two of the three residents who want the sidewalks constructed, as planned, were swayed by the desires of the long term residents of the older sections of Rehder and Edsall Avenues who had not been petitioned about the sidewalks . Whereas they would like to see the sidewalks constructed, they agreed not to challenge Staff's report or the decision of Council. This agreement is also based on the understanding that the cash payment of $5,522 .50 and the $10,000 paid by the developer as a contribution towards the cost of the construction of sidewalks sometime in the future on Edsall Avenue external to the subdivision be kept in reserve and used to help pay the costs of the construction of sidewalks if and when they are constructed in the future and that the record show it is the intent of this Council that, if sidewalks are constructed in the future, any cost additional to the funds held in reserve come from the General Tax Levy and not be financed under the Local Improvement Act. Lyle and Ruth Boland, who are one of the three property owners who did not sign the original petition, indicated on the Register that they "don't care" whether the sidewalks are built or not. THAT Report WD-36-93 be received; 2 . THAT a cash payment of $5,522.50 be accepted from 67.1461 Ontario Limited in lieu of the construction of sidewalks in front of 20 to 38 Rehder Avenue and 15 Edsall Avenue within Plan 18T-87005 and in front of 12 to 16 Rehder Avenue, external to Plan 18T-87005; 3. THAT the $5,522.50 be kept in a reserve fund to help pay the cost of constructing the sidewalks at some future date if requested by a majority of the property owners within Plan 18T-87005 and the property owners at 12 to 16 Rehder Avenue; and 4. THAT Mr. Rick Spicer and Mr. R: C. Annaert be advised of Council's decision. Biddle & Associates Limited 2 .0 BACKGROUND 2 . 1 On July 10 , 1989 , the Town of Newcastle entered into a Subdivision Agreement with 671461 Ontario Limited for a Plan of Subdivision with seventeen ( 17) lots at the west limits of Edsall and Rehder Avenues in Bowmanville (Attachment No . 1) . The Agreement required that a sidewalk be constructed in front of 20 - 38 Rehder Avenue and 15 Edsall Avenue within Plan 18T- 87005 and in front of 12 to 16 Rehder Avenue external to Plan 18T-87005 . The Agreement also required that the developer pay a cash contribution of $10, 000 towards the cost of the future construction of a sidewalk on the south side of the existing Edsall Avenue. 3.0 REVIEW AND COMMENT 3 . 1 Petition As illustrated on Attachment No. 2, eleven ( 11) of the fourteen (14) property owners in the subdivision have signed the Petition requesting that the sidewalks not be constructed. Also, all of the property owners who own homes on the same side of the street as the sidewalk signed the petition. The issue of deleting the construction of the sidewalk was discussed with Iain and Christie Alexander, who are one ( 1) of the three (3) property owners who did not sign the petition. %-� i ' I REPORT NO. : WD-36-93 PAGE 3 They discussed the matter with Lyle and Ruth Boland, 37 Rehder Avenue, and Mike and Jill Haskins, 39 Rehder Avenue, and obtained their signatures on the letter dated August 24 , 1993 (Attachment No . 4) . 3 . 2 Cash In Lieu The principals of 671461 Ontario Limited were asked to consider contributing the cost of the sidewalks as cash in lieu of the construction of sidewalks . The developer's view was that, if the sidewalks were not needed and were not to be constructed, they should not be required to pay anything. However, as a compromise, 671461 Ontario Limited agreed to make a contribution of $5,522 .50 as detailed in correspondence dated August 31, 1993, from Mr. R. C. Annaert (Attachment No. 5) . 3 . 3 Sidewalks on Edsall and Rehder Avenues External to the Subdivision As illustrated on Attachment No. 1 there exists a two foot (2 ' ) wide sidewalk on part of Rehder Avenue. There are no sidewalks on Edsall Avenue. Drainage on Rehder and Edsall Avenues is by means of open ditches with culverts at the entrances . If either of these streets is reconstructed sometime in the future, it is quite likely that the construction would include a sidewalk. This would be achieved by reconstructing the road with curbs and gutters and storm sewers to provide a location for the sidewalk. At that time, the property owners in Plan 18T-87005 might consider it desirable to construct a sidewalk within the plan. . 4.0 CONCLUSIONS AND RECOMIENDATIONS 4. 1 From the above; it is concluded that the construction of the i REPORT NO. : WD-36-93 PAGE 4 sidewalk within 18T-87005 should be deferred and that the cash in lieu of the construction of sidewalks from 671461 Ontario Limited should be accepted and placed in a reserve fund for possible future use . In the event that the Municipality should decide not to construct the sidewalks, we request that all monies dedicated for this purpose, and/or improvements to the older sections of Rehder and Edsall Avenues be held in reserve, until such time as both these streets are brought up to urban standards . (curbs, storm sewers, sidewalks etc . ) This will avoid the need to increase taxes under the Local Improvement Act when Rehder and Edsall Avenues are brought up to urban standards in the future . It is understood that a petition has been forwarded to the Municipality requesting that the sidewalk not be constructed within this development, contrary to the terms of the Subdivision Agreement between the Municipality and 671461 Ontario Limited . As our client wishes to proceed with the construction of the boulevards and surface works as quickly as possible, they have agreed to your request to a cash contribution of fifty percent ( 50%) of the cost of the sidewalk in lieu of constructing the sidewalk. The tender amount for constructing the sidewalk is 235 linear meters at $53 . 00 per meter = $12 ,455 . 00 . A credit for additional sodding in the boulevard should be granted in the amount of $1,410 . 00, giving a total of $11, 045 . 00 . The contribution to the Municipality is therefore $5, 522 . 50 . Bowmanville, Ontario L1C 3C1 September 13, 1993 Mayor Diane Hamre and Members of Council The Corporation of the Municipality of Clarington 40 Temperance Street Bowmanville, Ontario I was disappointed with the General Purpose and Administration Committee 's recommendation that Report WD-36-93 be received by Council . There is not one valid reason given in this report for Council to support the recommendation to do away with sidewalks included in an "APPROVED" plan of subdivision. It would seem that the recommendation is based upon a petition signed by a "MINORITY" of property owners suffering from the N . I .M.F.Y. (not in my front yard ) syndrome which is substantiated by the very wording of the petition. I ask that Council not approve this report for the following reasons : 1 . All property owners in Plan 18T-87005, the joining of Edsall Rehder Avenues, bought knowing that sidewalks were included in the approved plan of subdivision. Those of us that purchased our property based on the approved plan and all it entailed should not have to settle for anything less than what we bought and paid for . 2 . Sidewalks are safe interconnected access routes for pedestrian traffic . They are intended for the use of ALL the residents Clarington not just the homeowners whose street they front on . Who is entrusted with safeguarding the interest of the entire Municipality and ensuring urban standards exist? 3 . Rehder and Edsall Avenues are now irreversibly connected and Rehder avenue has existing sidewalks on a portion of it . Contrary to Councillor O'Toole 's opinion as stated at the G.P . & A. Committee Meeting, the existing sidewalk is as good and serviceable as other existing sidewalks within the Town of Bowmanville . The completion of sidewalks on the newer portion of the streets, connecting to the existing sidewalk would be progressive development for pedestrian access . . . /2 ATTACHMENT NO. 2 ADDENDUM TO WD-36-93 35 Rehder Avenue September 13, 1993 2 - 4 . There are 47 residents fronting on Edsall and Rehder Avenues . Of the 47 only 21 were petitioned, 26 residents were not even consulted, several of whom already have sidewalks . Surely this petition is not the basis for Council 's decision. 5 . There are 21 children living on the new sections of the streets alone, many more if the older sections are included . Is Council will to accept the responsibility should any pedestrian be injured while walking on the roadway due to the absence of sidewalks? G . As outlined in the very petition that Council is apparently basing it ' s decision on people were told by the Public Works Department that sidewalks were in the approved plan of subdivision and therefore not open for debate . This would appear to be the correct response from a Municipality that upholds urban standards and abides by their approved plan of subdivisions . It should be clear from the above, that Council 's moral obligation is to not approve Report WD-36-93 or at the very least table it back to Staff for a thorough review. Council must decide if urban standards are to be a variable within the Municipality of Clarington especially in light of the future development it wishes to attract . Yours truly, Mr . lain W.
