Subject: ENNISKILLEN ESTATES SUBDIVISION, (SUNNY RIDGE TRAIL) ,
PLAN 1OM-815, 'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-
LAW' , ROADS, STORM DRAINAGE SYSTEM, STREET LIGHTS AND OTHER
RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-41-93 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, storm drainage
system, street lights and other related Works, constructed
within Plan 1OM-815; and
3 . THAT Council approve the by-law attached to Report WD-41-93
assuming the streets within Plan 1OM-815, as public highways .

2.0 BACKGROUND
2 . 1 On June 26, 1987, the former Town of Newcastle entered into a
subdivision agreement with Sunny Ridge Corporation to develop
lands by plan of subdivision, located in Enniskillen and
described as Plan 1OM-815 (see Attachment No. 1) . The
agreement required the developer to construct all roadworks
including hot-mix paving, granular shoulders, sodded ditches,

storm drainage system and street lights, hereinafter referred
to as the 'Works ' .
2 .2 All of the Works were completed and a 'Certificate of
Completion' was issued dated November 1, 1990. The Works were
placed on a two (2) year maintenance period which expired on
November 1, 1992 . These Works were subsequently re-inspected
and any deficient Works have been corrected and are now found
to be satisfactory.
2 . 3 It is now appropriate to issue a 'Certificate of Acceptance'
for the Works . The subdivision agreement provides for this
certificate to be issued by the Director of Public Works,
subject to the approval of Council.
2 .4 Further to the issuance of a 'Certificate of Acceptance' , a
by-law is required to permit the Town to assume all the
streets within Plan 1OM-815 (see Attachment No. 2) .

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
Public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follows:
1. THAT the street described in Registered Plan 1OM-815
(described in Schedule "A" attached hereto and forming part of
this By-Law) all being in the former .Town of Newcastle, now
known, as the Municipality of Clarington, in the Regional
Municipality of Durham, is hereby accepted by The Corporation
of the Municipality of Clarington as public highway, and
assumed by the said Corporation for public use.

2. THAT the Clerk be authorized to apply to the Land Registry
Office to have The Corporation of the Municipality of
Clarington shown as the owner of the street on Plan 1OM-815.
BY-LAW read a first and second time this 12th day of October, 1993.
BY-LAW read a third time and finally passed this 12th day of
October, 1993.
