Subject: HIGHLAND GARDENS SUBDIVISISON, PHASE 2A
(PART OF) PLAN 1OM-826, COURTICE
'CERTIFICATE OF ACCEPTANCE' AND 'ASSUMPTION BY-LAW',
ROADS, STREET LIGHTS AND OTHER RELATED WORKS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report WD-51-93 be received;
2 . THAT the Director of Public Works be authorized to issue a
'Certificate of Acceptance' for the roads, street lights and
other related Works, constructed within Phase 2A of Plan 1OM-
826; and
3. THAT Council approve the by-law attached to Report WD-51-93
assuming certain streets within Plan 1OM-826 as public
highways.

2.0 BACKGROUND
2. 1 The former Town of Newcastle entered into a subdivision
agreement registered on June 30, 1988, with H. Kassinger
Construction Limited to develop lands by plan of subdivision,
located in Courtice and described as Plan 1OM-826 (Attachment
No. 1) . The agreement required the developer to construct all
roadworks, including hot-mix paving, curb and gutter,
sidewalks, boulevard sodding and street trees, a storm
drainage system and street lights, hereinafter referred to as
the 'Works' .
2 .2 The subdivision agreement provides for the separation of the
Works into two (2 ) stages:
(a) Storm Sewer System, and
(b) Roads and Above Ground Services.

2.3 Council previously approved report WD-30-92, which authorized
the issuance of a 'Certificate of Acceptance' for the Storm
Sewer System for plan 1OM-826.
2 .4 The Roads and Above Ground Services for Phase 2A were
completed and a 'Certificate of Completion' was issued dated
August 30, 1991. The Works were placed on a two year
maintenance period which expired on August 30, 1993. These
Works were subsequently inspected and all deficiencies have j
now been rectified to the satisfaction of the Director of
Public Works.
2 .5 It is now appropriate to issue a 'Certificate of Acceptance'
for the Roads and Above Ground Services for Phase 2A
only. The subdivision agreement provides for this
certificate to be issued by the Director of Public Works,
subject to the approval of Council.

2. 6 Further to the issuance of a "Certificate of Acceptance' , a
by-law (Attachment No. 2 ) is required to permit the Town to
assume certain streets within Plan 1OM-826 as public highways.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 93-
Being a By-Law to assume certain streets
within the Municipality of Clarington as
public highways in the Municipality of
Clarington.
NOW THEREFORE, the Council of The Corporation of the Municipality
of Clarington enacts as follows:
1. THAT the streets described in Registered Plan 1OM-826
(described in Schedule "A" attached hereto and forming
part of this By-Law) all being in the former Town of
Newcastle, now known as the Municipality of Clarington,
in the Regional Municipality of Durham, are hereby
accepted by The Corporation of the Municipality of
Clarington as public' highway, and assumed by the said
Corporation for public use.
BY-LAW read a first and second time this 13th day of December,
1993.
BY-LAW read a third time and finally passed this 13th day of
December, 1993.

SCHEDULE "A" TO BY-LAW NUMBER 93-
Firstly: Leith Court, Dunkin Avenue and Kintyre Street, Plan
1OM-826;
Secondly: Part of George Reynolds Drive lying south of the
line extending from the south east corner of Lot 28
to the south west corner of Lot 100, Plan 1OM-826;
Thirdly: Part of Mull Crescent lying south of the line
extending from the intersection of the northerly
limit of Leith Court and Mull Crescent to the south
west corner of Lot 195, Plan 1OM-826; and
Fourthly: Part of Arran Court lying south of the line
extending from the south east corner of Lot 106 to
the south west corner of Lot 131, Plan 1OM-826;
All in the Municipality of Clarington, Regional Municipality of
Durham.
