Subject: TEMPORARY MODULAR STRUCTURES (BAILEY BRIDGES)
JACKMAN ROAD BRIDGE
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report WD-52-93 be received;
2 . THAT the Municipality of Clarington enter into a rental or
lease agreement with the Ministry of Transportation Ontario to
reimburse the Ministry for the loan of the Temporary Modular
Bridge material located on Jackman Road;
3. THAT the proposed By-law attached to Report WD-52-93 be passed
authorizing the Mayor and Clerk to execute the appropriate
Lease Agreement;
4 . THAT provision be made in the 1995 current Budget for payment
of the lease in the amount of $3,658; and
5. THAT S. E. Gwartz, P.Eng. , Assistant District Engineer
Municipal, Ministry of Transportation Ontario, be advised of
Council 's decision.

2.0 BACKGROUND
2 . 1 The Jackman Road Bridge was acquired by the former Town of
Bowmanville in 1970.
In 1970, the former Town of Bowmanville installed a bailey
bridge over the Bowmanville Creek on Jackman Road. The bridge
was loaned to Bowmanville by the Ministry of Transportation
Ontario.
2 .2 In 1983, the structure was considered unsafe and was replaced
with the existing bailey bridge loaned to the former Town of
Newcastle by the Ministry of Transportation Ontario.
2 .3 Correspondence dated October 25, 1993, from the Ministry of
Transportation Ontario (Attachment No. 2) provided the
Municipality with three (3) options:
i) To return the temporary modular components (bailey
bridge) to the Ministry of Transportation Ontario by
November 1, 1995;
ii) Enter into a Purchase Agreement with the Ministry of
Transportation Ontario to be effective November 1, 1995,
at a purchase price of $34,030; or
iii) Enter into a rental or lease agreement with the Ministry
of Transportation Ontario of which payments would

commence on November 1, 1995. Rental payments are
approximately $3,658 per year.
3.0 REVIEW AND COMMENT
3. 1 Future Development
The Northwest Bowmanville Development Group has proposed
development plans for the area bounded by Scugog Street to the
west, Concession Road 3 to the north, and Liberty Street to
the east (Attachment No. 1) . It is proposed that, when this
development occurs, a new bridge will be constructed north of
the existing bridge. The existing Jackman Road will be closed
and a cul-de-sac constructed where Jackman Road is terminated.
The bailey bridge will then be returned to the Ministry of
Transportation Ontario.
3.2 Development Charges Policy Report
The Development Charges Policy Report, dated February 5, 1992,
indicates probable development of this site in five (5) to ten
( 10) years; subsequently, construction of the new bridge
should occur in approximately the same time frame.
3. 3 Funding
The major source of funding for construction of the new bridge
will be acquired from the Development Charges Reserve Fund.
4.0 RECOMMENDATIONS
4 . 1 It is, therefore, recommended that, since reconstruction of
the Jackman Road Bridge is proposed in the five to ten year
plan and the bailey bridge will no longer be required, the
Municipality endorse Option 3 which requires that a rental or
lease agreement be made with the Ministry of Transportation
Ontario with payments comm encing on November 1, 1995.

4 .2 Rental payments of approximately $3, 658 have been calculated
in accordance with Schedule B-(B3) of QST-B-20 as summarized
in the table attached to correspondence of October 25, 1993.

Re: . Temporary Modular Structures (Bailey .Bridges)
Further to my letter of August 9 , 1993 I wish to provide you with
'the options available -to you, as detailed in the MTO Directive
QST-B-20, to reimburse the Ministry for the loan of the Temporary
Modular Bridge material located on Jackman Road.
Option 1 - Return the Temporary Modular Components to MTO by
November 1, 1995 .
Option 2 Enter into a purchase agreement with MTO to be
effective November 1, 1995 . The purchase price
(depreciated value) of $34, 030 . 00 has been
calculated in accordance with Schedule B 7(B2 ) of
Directive QST-B-20, as summarized in the attached
table.
Option 3 - Enter into a rental or lease agreement with MTO of
which payments would commence on November 1, 1995 .
Rental payments of approximately $3, 658 . 00 per
year has been calculated in accordance with
Schedule B 7(B3) of QST-B-20 as summarized in the
attached table.
It would .be appreciated if you could review these options and
provide MTO with your selected plan by December 1, 1993 . Upon
receiving your decision the Ministry will proceed with the
appropriate documentation to complete -the transaction..

BY-LAW 93-
Being a By-law to authorize the execution of
an Agreement between The Corporation of The
Municipality of Clarington and the Ministry of
Transportation Ontario
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of The Corporation of The Municipality of Clarington
and seal with The Corporation's seal, an agreement between the
Ministry of Transportation Ontario and the Municipality.
2 . THAT the agreement attached hereto as Schedule "A" forms part
of this By-law.
BY-LAW read a first and second time this 13th day of December,
1993.
BY-LAW read a third time and finally passed this 13th day of
December, 1993.
