Subject: DEDICATION OF PUBLIC HIGHWAY
PART 6 OF IOR-813
PART 20 AND 21 OF IOR-933
Recommendations:
It is respectfully recommended that Council recommend the
following:
1. THAT Report WD-79-91 be received;
2 . THAT a By-law be passed to dedicate Part 6 of Plan 10R-813
and Parts 20 and 21 of Plan 1OR-933, as public road
allowance and that the Mayor and Clerk be authorized to
execute the attached By-law;
3 . THAT the Town's solicitor, take the necessary action to
complete this transaction; and
4 . THAT Mr. Freeman Reid, Solicitor, be advised of Council 's
decision.

2.0 BACKGROUND
2 . 1 Attached is correspondence from Mr. Freeman Reid, dated
October 2 , 1991, (Attachment No. 2) requesting that the
following lands be dedicated as public road allowance:
a) Part 6 of Plan 1OR-813; and
b) Parts 20 and 21 of Plan 1OR-933 .
2 .2 The purpose of Mr. Reid's request is to provide a clear and
unobstructed access to his clients ' property within Plan
1OR-3164, using Cigas Road as access .
2 . 3 The subject parts are shown as Cigas Road and Marnie Road
within the former Township of Darlington (Attachment No. 1) .
a) Part 6 of Plan 1OR-813 was originally transferred to
the Town through the development of Plan 1OR-813 in
1978 .
b) Parts 20 and 21 of Plan 1OR-933 were originally
transferred to the Town through the development of Plan
1OR-933 in 1979 .

3.0 RECOMMENDATION
3 . 1 It is, therefore, recommended that Part 6 of Plan 1OR-813
and Parts 20 and 21 of Plan 1OR-933, be dedicated as public
road allowance and that the Mayor and Clerk be authorized to
execute the attached by-law.

Dedication as a Public Highway
I confirm our telephone conversation of the date instant , wherein
you advised that you would be prepared to bring the matter before
council on Monday , Octoberlq'th , 1991 , and request passage of a By-
Law dedicating the above mentioned parts as a Public Highway . I
have also enclosed a copy of Plan IOR-3164 which may be of some
assistance to you . Our search notes indicate that Part 3 has
previously been dedicated as a Public Highway .
I will forward to you by fax copies of the Deeds transferring
Parts 20 and 21 to The Corporation of the Town of Newcastle. The
Deed conveying Part 6 on IOR-813 will be sent to you by fax on
October 3rd, 1991 ,

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 91-
Being a by-law to dedicate certain lands as a public
highway in the Town of Newcastle (Concession 1,
Lot 29, former Township of Darlington) .
WHEREAS the Council of The Corporation of the Town of Newcastle
deems it desirable to dedicate certain lands as .public highway.
BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE
CORPORATION OF THE TOWN OF NEWCASTLE BY THE COUNCIL THEREOF AS
FOLLOWS:
1. THAT the land described as Part Lot 29, Concession 1,
Geographic Township of Darlington, Town of Newcastle, Regional
Municipality of Durham, designated as Part 6 on Plan 1OR-813,
be and the same is established, dedicated and assumed as a
public highway known as Cigas Road;
2. THAT the land described as Part Lot 29, Concession 1,
Geographic Township of Darlington, Town of Newcastle, Regional
Municipality of Durham, designated as Parts 20 and 21 on Plan
1OR-933, be and the same is established, dedicated and assumed
as a public highway known as Cigas Road and Marnie Drive as
each of such public highways are set out in Schedule "A" to
this By-law.
By-law read a first and second time this 25th day of October 1991.
By-law read a third time and finally passed this 25th day of
October 1991.

SCHEDULE "A"
ALL AND SINGULAR THAT certain parcel or tract of land
and premises, situate, lying and being in the
Town of Newcastle, in the Regional Municipality of
Durham, located in Part Lot 29, Concession 1, of the
former Township of Darlington, now within the limits
of the Town of Newcastle, Regional Municipality of
Durham, more particularly described as Part 6 on
Registered Reference Plan 1OR-813 and Parts 20 and 21
on' Registered Reference Plan 1OR-933, deposited in the
Land Registry Office of the Registry Division of
Newcastle (No. 10) , on April 13, 1978, and March 1, 1979
respectively.
